LETTER OF APPOINTMENT
The Company is pleased to offer you an employment as «Job_Type» (WBA) based at «Cost_Centre»
(«Cost__Centre__Code») with effect from «Hire_Date» based on the following terms and conditions:
1. Basic Salary
Your monthly basic salary on commencement of employment shall be RM«Basic_Pay» per month
with QEI (Quality Effort Incentive) to begin on your first day of work.
You will be eligible to receive a Sales Performance Incentive if you achieve a minimum sales target set
by the Company. The terms and conditions of the Sales Performance Incentive are stated in the
Appendix 1 enclosed herewith.
3. Probationary Period
You will have to undergo a probationary period of 3 calendar months from the date of commencement
of employment. At the end of this period, your performance will be reviewed by Management who
reserves the right to confirm or to terminate your employment, or to extend your probation period but
you will be informed in writing of this extension before the expiry of the initial three (3) months
probationary period.
4. Notice of Termination
Either party is required to serve three (3) days termination notice or three (3) days salary in lieu of such
notice during the probation period. Upon confirmation, the termination notice period is one (1) month
or one (1) month salary in lieu of such notice is required. However, if your service employment is
terminated for misconduct, you may discharge without notice.
5. Annual Leave
Ten (10) days leave with full pay will be granted for completion of one (1) year of service. An
additional one (1) day of annual leave will be added for each additional year’s of service. The
maximum number of annual leave will be sixteen (16) days. Such leave must be taken at a time
convenient to the company and subject to approval from the Management. Such leave must not be
taken during the probationary period. However, an employee shall entitle to only a prorated number of
days of annual leave, in accordance with the entitlement stated in the Employment Act, if the service is
terminated before completing a full year’s service.
6. Medical Benefit
The Company will reimburse you medical fees, as per company’s policy and following company’s
rules and regulations pertaining to the medical benefit. The medical benefits do not include dental,
obstetrics, general medical test, cosmetic surgery, hospitalization fees, consultation fees and operation
fees. The medical certificate and official receipt must be faxed to the Human Resources Department the
following day otherwise it will be treated Unapproved / No Pay Leave.
The Company shall have the absolute right to vary the working hours according to Company’s
operation requirements. You shall follow the working hours/schedule set and arranged by the
Management.
Your monthly salary payment will be paid once a month before or on the 7 th day through your
Maybank Account/ Cheque/ Cash.
a) To discharge your duties to the best of your abilities whilst maintaining the high Standards of
OSIM.
b) To maintain an excellent rapport with customers and able member of colleagues at all times.
c) You will at times, observe and carry out faithfully and conscientiously the duties and
responsibilities that are assigned additional by your Supervisor, Person In-Charge or the
Management.
d) You will be required to undertake such additional duties that may be assigned to you later which is
within your employment. The company shall have the right to assign you, on a temporary basis,
duties beside the normal nature of your employment which is reasonable, and/or to transfer you to
any of its associated company or subsidiaries in Malaysia or oversea of deem fit.
The Company reserves the rights to terminate your services without notice if:
a) You have been continuously absent from work for more than 2 (two) consecutive working
days.
b) Absent/leaving without prior leave from the Company and without giving reasonable excuse.
c) Unsatisfactory performance of work or with the intent of fraud and misconduct on the rules
and regulations of the Company.
d) If you are caught doing additional job like personal direct sales or likewise while on duty.
e) Bringing friends to the shop while on duty.
11. Transfer
You will be required to work in any departments/outlets or any other places of work or any associated
companies on duties as maybe allocated to you, and you may be transferred to or from any of these
department/outlet.
Your employment shall subject to the Company/Shop rules and regulations or others procedures as
may be make know to you from time to time.
13. Change of Particulars
You must promptly inform the Company of there is any changes in your name, address, telephone/hand
phone number and any others particulars which the Company deems necessary and requests to be
reported.
You will defend and indemnify the Company against any incalculable damage and claims, by any third
parties in any forum or before any tribunal, arising out of your engagement in any deceptive practice in
connection your activities pursuant to accepting of this Letter of Appointment.
a. “Confidential Information” shall include, but not be limited to, information in tangible, intangible
or electronical form, whether historical, current or prospective relating to or including: health
product, health device, equipment, business, product, participants, distribution, marketing,
licensing, casting, recruitment, wage information, commission scheme and calculation,
contracting, sales activities, policies, practices, training, believes, outlooks, studies, reports,
analyses, strategies or forecasts, finances, revenue, pricing, costs or profits, released or unreleased
products including, but not limited to, software, hardware, development, research, designs,
specifications, performance characteristics, code, scripts, setting, formulas, algorithms, data,
techniques, processes, inventions, testing strategies, industry, customer or consumer information
and third party confidential information.
b. This Article applies to all Confidential Information disclosed between the Company and the
Employee which the disclosing party identifies as confidential or which otherwise is reasonably
understood by the receiving party to be confidential and proprietary;
c. You shall defend and indemnity the Company against any incalculable damage and claims against
disclosing such Confidential Information to any third party, without written consent of Osim;
d. This Agreement shall remain in effect throughout the employment of the Employee.
Notwithstanding the foregoing, your obligations shall survive and shall be binding upon you for
duration of employment and for the period (2) years after the last day of your employment;
e. You may exit this Agreement voluntarily upon a sum equal to the total amount of all wages and
allowances ever received by you during your continuous period of service for Osim, has been duly
received in full by Osim.
16. Retirement
Your retirement age will be upon attaining the age of sixty (60) years.
The Company reserves the absolute right to amend, modify, add or withdraw any of its policies and
practices as it deems necessary. (at the discretion of the Company)
You are required to observe all additional and latest amendments of Company's policies and practices
regardless it occurs in any form of channel through Company's Circular, Emails, Intranet and Notice
Boards. It shall be considered circulated to all employees immediately after the following day from the
issuance date of the document.
Your appointment is based on the correctness and completeness of information provided to us.
Misrepresentation, false statements or omission of facts will cause disqualification of your employment
and will be subject to summary dismissal.
We welcome you to our organization and look forward to your contribution. Should you accept our
appointment, kindly sign and return the duplicate copy of this letter to us as acknowledgement of acceptance.

You will be entitled to receive a Sales Performance Incentive of RM200.00 per month if you achieve
a minimum Personal Sales of RM60,000.00 in a calendar month.
The Sales Performance Incentive shall not be applicable in the event of you are no longer in a position
as a Well-Being Advisor (WBA), such as you are transferred to another role or promoted to a higher
position.
The Sales Performance Incentive is subject to revision from time to time at the sole discretion of the
Management and a notice shall be served to you when it occurs.
Aside from the above, other terms and conditions of your employment with the Company shall remain
unchanged.
