The 2009 Tower Oaks Homeowners Association (TOHA) Board, Gainesville, FL was served by nine (9)
Directors. In an intricate and somewhat complicated fashion according to complainants, from 1996 to
currently, the Boards, assisted by a hired property management company, Bosshardt Property Management,
Inc., conspire to financially defraud Lot Owners by imposing illegal fines and fees and late fines and fees
against Lot Owners’ private property use by way of illegitimate Rules & Regulations. Even though these
illegitimate acts can be civil violations of the Association’s Governing Documents, the Documents are
intentionally and fraudulently manipulated and used to provide the means to criminally take money from
victims. Violation notices and demand for payments are delivered via the U.S. Mail. But this Boards’
sole and singular authority to control conduct by Rules & Regulations is only to control conduct upon the
Common Areas – By-Laws Article VII:
“…to adopt and publish rules and regulations governing the use of the Common Area and facilities, and
the personal conduct of the members and their guests thereon, and to establish penalties for the infraction
thereof;”. (bold/underline for emphasis)
Bosshardt illegally collected approximately $7,767.98 by use of the U.S. mail during 2009. Seniors vs.
Crime has no records for fine collections from 1996-2001, but TOHA Rules & Regulations are
documented in use from December 7, 1996. SVC has incomplete records from 2002 through 2008
showing approximately $8,766.00 collected during these years. A substantial sum of illegally collected
money profits Bosshardt Property Management, Inc. and its involved employees via their payroll.
A recently discovered 2005 email (attached) from Bosshardt Property Management, Inc. authored by their
CAM (Community Association Manager) Mr. Rik Tenaglia to Mr. Jodi Wood, then secretary of the
Tower Oaks Homeowners Association, shows knowledge of and a continuing intent to continue
collecting money by using the fines and fees schedule fraudulently adopted. Albeit Bosshardt knew, and
thereby currently knows, that Lot Owners did not officially or legally give their permission to control
private property by way of Governing Documents, Rules & Regulations, and fines and fees, the practice
continues. Also attached is a recently discovered 2008 Bosshardt letter to Lot Owners directing their
payment of annual assessments “per door,” which illegally obtains money by way of taking same from
apartment building owners within Tower Oaks. Conversely, the Association’s Declaration of Covenants,
Conditions and Restrictions only allow collection of such an assessment for “each lot.”
To collect money concerning private property use is beyond the Boards’ or Bosshardt’s authority, with
such action clearly denied by the Association’s governing documents as defined by FS 720.301(8).
Governing documents are an Association’s Declaration of Covenants, Conditions and Restrictions; Articles
of Incorporation; and By-Laws, which control any Board’s power by way of FS 720.303(1):
…“The powers and duties of an association include those set forth in this chapter and, except as
expressly limited or restricted in this chapter, those set forth in the governing documents.” ….

The Board has no power to either promulgate or enforce Rules & Regulations against private property use,
nor demand monetary fines against Lot Owners for such private property infractions. The Boards
continually hire Bosshardt Property Management, Inc. and allow Bosshardt to issue violation fine cards by
U.S. Mail and to collect violation fines and processing fees plus late fines and fees from any Lot Owner
deemed to be in violation of the Board’s illegitimate manipulation of Rules & Regulations. On August 11,
2007 the Board imposed the unlawful threat of property lien against anyone unwilling to pay a fraudulent
fine; however, 2007-2009 FS720.305(2) provides that:
“A fine shall not become a lien against a parcel.”
Bosshardt’s employees representing the Association are known as Community Association Managers
(CAM) and are required by FL statute to know matters concerning Association Governing Documents.
Education and continuing education requirements must meet Florida Statute Chapter 468.433(3) and
thereby Florida Administrative Rule 61E14-1.001 - Prelicensure Education Requirements:

V. Management/Maintenance (18%)
1. Enforce Governing Documents
a. knowledge of rights and obligations of tenants/owners
b. knowledge of violations and enforcement procedures
c. knowledge of procedures for imposing fines, penalties, and fees
d. knowledge of alternative dispute resolution
The illegal collection of money by the Boards and Bosshardt are an on-going intentional scheme to
defraud and/or an intentional theft by false pretenses against Lot Owners of Tower Oaks Homeowners
Association. In regard to the above, complaining residents to Seniors vs. Crime expect appropriate
prosecution and restitution to some 83+ year-2009 victims:

This homeowners association, presumably because of its large size of approximately 430 Lot Owners,
cannot garner a majority of members to resolve its concerns. In the past, according to our initial
complainant, attempts have failed to acquire a majority by proxy due to the Board’s accumulation of same
in order to counter such an attempt. It has reportedly also been not possible since 2005 to date to gain a
majority of members to hold an annual meeting to elect new directors, so directors since 2005 have
remained and/or filled their own vacancies as desired.
