OF
PLAINTIFF

This Judicial Affidavit of the plaintiff is executed to serve


her direct testimony in the instant case.

I, President A, of legal age, and living at Betes Aliga, Nueva Ecija,


plaintiff in this case, state under oath as follows:

PRELIMINARY STATEMENT

The person examining me is Atty. Chat Meks with office address at


Nobody Law Office, 25th Floor Zoro Bldg., Luffy Street, Nueva Ecija.
The examination is being held at the same address. I am answering
her questions fully conscious that I do so under oath and may face
criminal liability for false testimony and perjury.

PURPOSE: This affidavit/testimony of plaintiff president A is


being offered to prove that the defendant B1 and co-defendant B2,
entered into a Contract for the exclusive supply of crushed ice, and ,
herein defendants have knowledge and/or participate to the said
transaction alleged in the subject complaint.
Plaintiff will also prove that the checks, allegedly issued for security of
the alleged loan, which is in her name, were not issued by her for the
said purpose.

1. Q. Please state your name and other personal circumstances for


the record.
A. I am president A of A Corporation, a Filipino and of legal age. I
live at Betes Aliaga Nueva Ecija.

2. Q. Do you know why you are here?


A. Yes, because I am the plaintiff in this suit filed against B1 and B2.

3. Q. Do you know B1 and B2?


A. Yes, Sir.

4. Q. But have you met them personally?


A. Yes, Sir.

5. Q. What is the nature of their job?


A. They were manufacture crushed iced.

6. Q. Do you know their relationship or connection with B


Corporation?
A. Yes, Sir.

7. Q. But with the best of your knowledge, what kind of transaction


did you entered into?

A. A Contract of exclusive supply of crushed iced.

8. Q. I am showing you this document, herein referred to as “Exhibit


C.” Do you know this document?
A. Yes Sir.

9. Q. What is this document?


A. A Contract of exclusive supply of crushed iced .

10. Q. Who signed this document?


A. Myself.
11. Q. What is your purpose for signing it?
A. It was intended for the payment for we are planning to buy.

15. Q. What did you do after you signing it?

A. I called B1 the Project Manager and B2 inform them the


terms of the contract. I also sent them a letter informing the
same and that the contract stipulated therein, that if neither
of the party notified the other of their choice not to
renew the agreement within 30 days prior to its expiration
dates the agreement would be automatically renewed for the
another year.
16. Q. Do you have proof of such acknowledgment?
A. Yes Sir. I have the acknowledgment letter (Annex “5”).
