Initially, Chidda was the recorded owner of land Area measuring 2.9110 Hect., part of Khasra no. 250, Village Yusufpur,
Chakshaberi, Pargana and Tehsil Dadar, Gautam Budh Nagar, U.P.
Thereafter, Chidda executed Will dated 19.12.2013 in favour of his Grandson Umesh Yadav, Vinod Yadav and Sanjay Yadav, duly
registered in the office of SR Dadri, as Doc No. 391, Book no. III, Vol No. 47, pages 179-192, dated 19.12.2013 and later he expired
on 09.06.2014 read with Hissa Kasi
AS PER MY OPINION THE BUILDER IS THE OWNER OF THE ABOVE SAID PROPERTY AND HAS RIGHT
ENTERED INTO AGREEMENT TO SELL WITH THE BRROWER AND THEREAFTER CAN EXECUTE THE SALE
DEED IN FAVOUR OF THE BORROWER AND CAN BE EQUIABLE MORTGAGE WITH THE HOME FIRST
FINANCE COMPANY INDIA PVT. LTD.
PART-VI- CERTIFICATE:
In view of the foregoing, I certify that the title deeds intended to be deposited relating to the property offered as
security by way of equitable mortgage and the documents of title referred to above are perfect evidence of the title
and that if the said equitable mortgage is created in the manner required by law, it would satisfy the requirements
for creation of an equitable mortgage. I further certify that NA There is no encumbrance/charge or lien on the said
property. The said property is clear having a valid & marketable title thereto.
The undersigned has verified the record of last 13 years of the above land from the O/o Sub Registrar/Office of
Tehsildar- Dadri and found that there is no encumbrance/charge of lien on the above property registered with O/o
Sub Registrar, XX, from the year 2011 to till date, vide Receipt No. X X Dated XX
The mortgage if created will be available to HFFCIL for the liability of the intending borrower. The mortgage
should be created by borrower by way of deposit of the title deeds.

NOTES:
a) We have not examined whether there is any litigation or dispute in respect of the said property, as it is
out of the scope of our work.
b) This report does not comment on the technical regularity (adherence to bye laws / approvals) or
otherwise, of the said property. Whether the said property is a subject matter of any pending
litigation, Authenticity of the originals of the document/s examined (that is to be verified through a
separate verification of the original title document/s). All the above are outside of the scope of
work in reference to this report.
c) It is advised to check & verify that there is no tenant over the said property and the said property is
possession of borrower.
d) It is advised to ensure that KYC documents of borrower/s and Seller/s be verified before disbursal
of loan amount and further, it is advised to ensure that the chain link documents should be
verified in original by the empanelled lawyer in their respective office (except in BT case), we
shall not be responsible if any kind of discrepancy found thereafter.
e) Our maximum aggregate liability to any involved parties arising from or in relation to, this (in
contract, tort, negligence or otherwise) however arising shall not be in any circumstances exceed
the professional fee payable to The Law Port of India for this specific mandate.
f) It may be noted that we are neither handwriting expert nor expert at detecting fraudulent
documents. Hence, we shall not be responsible in this regard. The inspection of index records as
being made available at the office of concerned sub-registrar, are normally incomplete, scattered
in nature & manually managed, due to which it is impossible to find out other registered entries
(if any) related to the said property.
