I. Answer the following question.

1. What is the process of creating and composing the Board of Mechanical Engineering?
 The process of creating and composing the Board of Mechanical Engineering,
first the PRC will make a list for 5 candidates for each member which is the
Chairman and two (2) other board members from the duly accredited association
of mechanical engineering here in the Philippines. Most probably 15 max
candidates but the commission itself will rank three (3) best for each position.
After that they will submit to the President of the Philippines who has the
Philippines who has the power to appoint the members of the Board. After that,
the board shall be organized no later than six (6) months.
2. What are the qualifications required of Applicants for Professional Mechanical
Engineering?
• Citizen of the Philippines.
• Not convicted by a court of law of a crime.
• Valid registration certificate and professional license.
• Graduated from recognized engineering school or college.
• Completed approved course in mechanical engineering.
• Record of four years or more active mechanical engineering practice.
• Competent to practice, attested by at least two professional engineers.
3. What are the qualifications required for Applicants for Mechanical Engineers?
 Citizen of the Philippines.
 Not convicted by a court of law of a crime.
 Holds a Bachelor of Science in Mechanical Engineering from a recognized
institution and duly accredited government.
4. What are the grounds for the suspension and revocation of licenses, cancellation of
temporary/ Special Permits.
 The Board can revoke or suspend mechanical engineers' licenses or cancel
permits for various reasons, including fraud, negligence, illegal practice, and
violations of the Act, Rules, and Regulations. However, these actions can be
appealed to the aggrieved party, who can seek relief from the appropriate
Regional Trial Court.
5. What are the subjects in which the applicant for Mechanical Engineers shall be examined?
Include the corresponding percentage weights?
 Machine Design, Material and Shop Practice 30%
 Industrial and Power Plant Engineering 35%
 Mathematics, Engineering Economics and Basic Eng.- Services 35%
6. What are the subjects in which the applicant for certified plant mechanic shall be
examined? Include the corresponding percentage weights?
 Elements of Power Plant machinery 30%
 Elements of Industrial Plant Machinery 35%
 Shop Machinery Practice 35%
7. Discuss who are the personnel required in every mechanical work project or plant in
operation.
 The personnel required in every mechanical work project or plant operation shall
have not less than the following complement of resident licensed professional
mechanical engineer, mechanical engineer or certified plant mechanic. For
example, 100 kw or over but not more than 300 kw: one (1) certified plant
mechanic, or one (1) mechanical engineer, or one (1) professional mechanical
engineer
8. What are the qualifications does the members of the Board should possess?
• Must be a natural born citizen and resident of the Philippines.
• Must be at least 35 years old.
• Holds a Bachelor of Science in Mechanical Engineering or its equivalent.
• Must be a Professional Mechanical Engineer with a valid license for at least 10 years.
• Must not be a faculty member or have administrative supervision over any institution of
learning for three consecutive years.
• Must not be connected with a review center or group for three consecutive years.
• Not convicted by a court of law of a crime.
9. What is an obligation and explain with your own illustrations its requisites?

 Passive subject – obligor or debtor, siya yung need magbigay
10. What are the rules in the case of improvements, loss or deterioration of the thing before
the fulfillment of the suspensive condition.

11. What is a quasi-contract and explain each kind. Include illustrations.
 Negotorium gestio – voluntary
 Solutio indebiti – pay for mistake
12. What is a quasi-delict and how it is differentiated with delicts? Give illustrations.
- involve intentional wrongdoing.
13. Enumerate and explain the special forms of payment.
 Dacion in payment – ito yung same amount ng utang kapalit bagay.
 Payment by cession – di na kaya bayaran ang utang.
 Tender of payment or consignation – by court.
14. When may an obligor be relieved from his obligation by reason of loss of thing due?
- Fortuitous event – not forseen event
15. X promises the use of his one-door apartment to Y provided the latter passes the Board
Examination for Mechanical Engineers. In this case, what kind of obligation is established?
Explain.
- Conditional obligation is one whose consequences are subject in one way or
another to the fulfillment of a condition.
