Revision worksheet 4

The French philosopher Montesquieu advanced the Separation of Power doctrine. The basic
philosophy behind the theory of separation of power is that there be no concentration of
Government power in a single authority. The French Revolution taught us that one individual
with unchecked power might wreak devastation. In the 16th and 17th centuries, French
philosopher Justice Bodin and British politician Locke both published their opinions on this
topic.
Separation of powers was first included in a national constitution by the United States which
became independent of British rule in 1776. The United States developed a Presidential
form of government abandoning the parliamentary system practised in Great Britain. In India
on the other hand, which is a young democracy as compared to USA, the parliamentary
system of governance was adopted as a structure established by the British colonial rulers
was already in existence.
In a presidential system, the president is the head of state and government, elected
separately from the legislature. They have significant powers to enforce laws, make
executive decisions, and represent the country internationally. The legislative branch,
such as the Congress in the United States, is separate from the executive and has its
own powers to make laws. There is a clear separation of powers between the executive
and legislative branches, with each having distinct roles and responsibilities.
In contrast, in a parliamentary system, the executive branch is intertwined with the
legislative branch. The head of government, usually called the prime minister, is chosen
from the majority party in the legislature. The prime minister and their cabinet members
are accountable to the legislature and can be removed through a vote of no confidence.
This system allows for quicker decision-making and smoother implementation of policies
compared to the presidential system. Additionally, there's often a clearer line of
responsibility since the executive is drawn from the legislative body.

They, therefore, determined it would be wise to steer clear of adopting the American model
of complete division of powers. Typically, there are three branches: the legislative, executive,
and judicial. In a parliamentary system where the executive and legislative are combined, it
can be distinguished by the merging of the two branches of government.
