1.1. Police : they are in charge of looking into the reported offenses, obtaining
information and making arrests.
They are crucial in guaranteeing the efficient execution of the preliminary phases of the
criminal justice system. They were In charged of looking into the report of the 4 year old
girls tape in the Bokgabo Poo case and into the Hillary case.
Prosecutors are stateappointed attorneys who are in charge of putting the case forward
in court against the accused.After gathering information and speaking with potential witn
esses, they decide whether to press charges and hold a trial.They might also be involve
d in parole hearings and recommendations for sentences at the post-trial stage.
Defense Lawyers: Throughout the trial, defense lawyers stand up for the accused and
make sure that their rights are upheld. The defence lawyer would have to stand up for
Bokgabo Poo and Hillarys suspects.
They offer an accused person's defense and refute the prosecution's evidence.
Following the trial, they might additionally participate in court cases and initiatives to
shorten penalties.
Judges: As the trial's presiding authority, judges make sure that everything is done legall
y and fairly.
They decide which evidence is admissible, give the jury instructions, and, in the event th
at the accused is found guilty, finally impose the sentence.

se.
Jury: In situations when a jury trial is held, the jury is essential in deciding whether the a

1.2. In the Hillary Gardee case Hillary was the primary victim herald as all as
the 4 year old girl that was raped by Bokgabo in the Bokgabo Poo case They
directly experienced the alleged crimes, including gender-based violence, and
suffered the physical, emotional, and psychological consequences. These
were the people who the crime was committed against and who are the
victims of tape and gender based violent d hence they are the primary victims
as primary victims are people who suffer or have they rights infringed due to
the result of an act caused by another person. The secondary victims are the
people affected by the act as they are close to the primary victims in these
cases could include family members, friends, and the broader community
affected by the tragic events. They may experience emotional distress,
trauma, and the long-term impact of the alleged crimes on their lives.
Additionally, the secondary victims may also face challenges in providing
support and coping with the aftermath of the incidents As it could be trauma to
their lives. In the Bokgabo Poo case he’s family and friends are now
secondary victims to his crime as it now affects their lives and how others view
them in the society. In the Hillary case her family and friends are secondary
victims they are affected immensely by her death and her murder. The people
in the same community where crimes happen are heavily victimized by the
fear of the same happening to them. Bokgabos death was traumatizing to he’s
family and friends and that makes them a secondary victims as they were
affected by the act even though it did not directly happen to them.

1.3.” A Victim Impact Statement is a written or oral statement presented to the court at
the sentencing of the defendant”. 1Victim impact statements play a crucial role in cases

of gender-based violence, such as those of Hillary Gardee and Bokgabo Poo. These
statements are typically made by the victims themselves, their family members, or other
individuals affected by the crime. The value of victim impact statements in these cases
is significant for several reasons:

Empowerment of Victims: Victim impact statements provide an opportunity for the


victims to express the physical, emotional, and psychological impact of the crime. This
can empower them by giving them a voice in the legal process and allowing them to
confront the perpetrator. Humanizing the Impact: These statements humanize the
impact of the crime, allowing the court to understand the full extent of the harm caused.
They shed light on the trauma, fear, and suffering experienced by the victims,
emphasizing the real-life consequences of gender-based violence. Influencing
Sentencing: Victim impact statements can influence the sentencing phase by providing
the court with a deeper understanding of the harm caused. They can sway the judge’s
decision by highlighting the need for appropriate punishment and the importance of
holding the perpetrator accountable for their actions. Raising Awareness: These
statements also contribute to raising awareness about the prevalence and devastating
effects of gender-based violence. They can serve as a call to action for societal change
and the implementation of more effective measures to prevent such crimes. In
conclusion, victim impact statements in cases of gender-based violence serve to
empower the victims, humanize the impact of the crime, influence sentencing, and raise
awareness. They are a crucial component of the legal process, ensuring that the voices
of the victims are heard and considered in the pursuit of justice. Victim impact
statements really are important for the community.
