SEARCH & TITLE REPORT

With reference to request of M/s. Sukhwani Chawla Constructions,


through its Partner Shri. Gurumukh Jangaldas Sukhwani, Office at: - Office No. 3,
Prasun Akards, Near Gokul Hotel, Pimpri, Pune 411018. I have taken the search
of the records made available to me, Index If maintained by Sub-Registrar,
Haveli No. I to XXVI, in respect of the below mentioned property for the year
1992 to 2021 (Hereinafter referred as said Land/plot) and I have pursued the
title

2 deeds. On the basis of the perusal of the available documents and search of the
records I have came across the following transactions, mentioned as under.

1. Scope Of Work:-

The scope of my legal due diligence exercise, as per instructions has


been
restricted to review of (a) 7/12 extract (b) Zone Certificate (c) Prima fascia
legality and validity of the ownership rights of the persons appearing in the
column ofOwners and kabjedars in 7/12 extract ofbelow schedule property.

2. Description of the Land:

Registrar, Haveli I to XXVI District Pune and bounded as under :

4. Brief History;

1) That the Property i.e. land bearing Survey No. 27/1 & 27/2A, situated at
Village Thergaon Thergaon, Taluka Haveli, Dist- Pune, within the Limits of
Pimpri Chinchwad Municipal Corporation was ancestral property of Shri.
Hari Khandu Bare, Shri. Moru Khandu Bare & Shri. Babu Pandu Bame
and they was recorded owner of the said plot as per revenue records, vide
Mutation Entry No. 620 & 587,

2) That the said owner Shri. Babu Pandu Barne was expired on Since 1967 and
after his death as per the application and affidavit, the names of legal
heirs
were recorded being owners of the said property i.e. Survey No. 272A &
27/2B i.e. Smt. Shantabai Babu Barne (Wife) & Smt. Tanhabai Babu Barne
(Wife), Shri. Bhaguji Babu Bare (Son), Shri. Lala Babu Bare (Son), Shn.
Vitthal Babu Barne (Son), Shri Kisan Babu Barne (Son), Shri. Kundalik
Babu Barne (Son), Shri. Vilas Babu Bame (Son), Shri. Vijayanand Babu
Barne (Son), Sou. Putalabai Sudhakar Ranawade (Daughter), Sou. Fulabai
Genu Tapkir (Daughter), Miss. Dwropadabai Babu Barne (Daughter), Miss.

Changunabai Babu Barne (Daughter). That as per the application and


affidavits on records the above legal heirs were recorded being owners of
the said property in records, vide Mutation Entry No. 667.

3) That the said owner Shri. Hari Khandu Barne was expired on 08/07/1974

and after his death as per the application and affidavit, the names of
legal
heirs were recorded being owners of the said property i.e. Survey No. 27/1

(Part) ie. Shri. Maruti Hari Barne (Son), Shri. Namdeo Hari Barne (Son),
Shri. Sopan Hari Bame (Son), Sou. Tanhabai Morya Pawar (Daughter).
That as per the application and affidavits on records the above legal heirs

were recorded being owners of the said property in records, vide Mutation

Entry No. 789.

4) 'That the said owner Shn. Moru Khandu Barne was expired on 25/10/197¢

and after his death as per the application and affidavit, the names of legal

heirs were recorded being owners of the said property i.e. Survey No. 27/]

(Part) ic. Smt. Shantabai Babu Barne (Wife), Shri. Gopal Moru Barne

(Son), Shri. Bhausaheb Moru Barne (Son), Shri. Govind Moru Barne (Son),

Shri. Balasaheb Morn Barne (Son). That as per the application and

affidavits on records the above legal heirs were recorded being owners of

the said property in records, vide Mutation Entry No. 875.

5) That the said co-owner Shri. Vitthal Babu Barne (unmarried) was expired

Since 1968 and after his death as per the application and affidavit, the

names of legal heirs were recorded being owners of the said property i.c.

Survey No. 272A & 27/2B i.e. Smt, Tanhabai Babu Barne (Mother), Shri.

Bhaguji Babu Barne (Brother), Shri. Lala Babu Barne (Brother), Shri. Kisan

Babu Barne (Brother), Mrs. Dwropadabai Baban Jadhav (Sister), Mrs.

Changunabai Maruti Jadhav (Sister). That as per the application and

affidavits on records the above legal heirs were recorded being owners of

the said property in records, vide Mutation Entry No. 1091.

6) That the said co-owner Smt. Shantabai Babu Bame was expired on Since

1984 and after her death as per the application and affidavit, the names of

legal heirs were recorded being owners of the said property i.e. Survey No.

272A & 27/2B i.e. Shri. Kundalik Babu Barne (Son), Shri. Vilas Babu

Barne (Son), Shri. Vijayanand Babu Barne (Son), Sou. Putalabai Sudhakar

Ranawade (Daughter), Sou. Fulabai Genu Tapkir (Daughter). That as per

the application and affidavits on records the above legal heirs were recorded

being owners of the said property in records, vide Mutation Entry No. 1091.

7) That the said co-owner Shri. Kisan Babu Barne was expired 19/07/1989 and

after his death as per the application and affidavit, the names ofJegal heirs
were recorded being owners of the said property i.e. Survey No. 27/2A &

27/2B i.e. Smt. Bhamabai Kisan Barne (Wife), Shr. Dnvaneshwar Kisan
Bame (Son), Miss. Vanita Kisan Barne (Daughter), Miss. Jayashree Kisan
Barne (Daughter). That as per the application and affidavits on records the
above legal heirs were recorded being owners of the said property in
records, vide Mutation Entry No. 1321.

8) That the said co-owner Shri. Bhau Moru Barne was expired on 07/11/1988
and after his death as per the application and affidavit, the names of legal
heirs were recorded being owners of the said property i.e. Survey No. 27/1
(Part) i.e. Smt. Surubai Bhau Barne (Wife), Shri. Shivati Bhau Bare (Son),
Shri. Gorakh Bhau Barne (Son), Shri Ramdas Bhau Bame (Son. That as
per the application and affidavits on records the above legal heirs were
recorded being owners of the said property in records, vide Mutation Entry
No. 1253.

9) That the said co-owner Shri. Gorakh Bhau Barne was expired on
18/02/1998 and after his death as per the application and affidavit, the
names of legal heirs were recorded being owners of the said property ie.
Survey No. 27/\ (Part) ie. Smt. Lilabai Gorakh Bhau Barne (Wife), Shri.
Sagar Gorakh Barne (Son), Shri. Swapnil Gorakh Barne (Son), Miss.
Swapna Gorakh Barne (Daughter). That as per the application and affidavits
on records the above legal heirs were recorded being owners of the said
property in records, vide Mutation Entry No. 1253.

10) That the said co-owner Shri. Govind Moru Bame has his share as per the
application, the names of legal heirs were recorded being owners ofthe said
property i.e, Survey No. 27/1 (Part) ic. Shri. Nandu Govind Barne (Son),
Shri. Dilip Govind Barne (Son), Shri. Devdas Govind Barne (Son), Sou.
Kalpana Jeevan Khanekar (Daughter). That as per the application on

records the above legal heirs were recorded heing owners of the said

property in records, vide Mutation Entry No. 1385.

11)That the said co-owner Shri. Devdas Govind Barne was expired on

15/04/1999 and after his death as per the application and affidavit, the

names of legal heirs were recorded being owners of the said property i.e,

Survey No. 27/1 (Part) i.e. Smt. Chhaya Devdas Bare (Wife). That as per
the application and affidavits on records the above legal heirs were recorded
being owners of7the said property in records.

12) Thus (1) Shri Maruti Hari Barne, (2) Shri. Namdeo Hari Barne, (3) Shri.

Sopan Hari Bame, (4) Shri. Gopal Morn Bame, (5) Late Shri, Bhausaheb
Moru Bame Through his legal heirs ic. Smt. Surubai Bhausaheb Barne,
Shivaji & Ramdas Bhausaheb Barne & Smt Lilabai Gorakh Barne, (6) Shri.
Govind Moru Barne, (7) Shri. Balasaheb Moru. Barne, (8) (Shri. Bhaguji
Babu Bame (9) Shri. Lala Babu Barne, (10) Late Shri. Kisan Vitthal Barne

Through his legal heirs i.e. Smt. Bhamabai Kisan Barne, Shri. Dnyaneshwar
Kisan Barne, Miss Jayashri Kisan Barne & Mrs. Vanita Prabhakar Wavale,

owners of land bearing Survey No. 27/1 area admeaguring 04 Hectare 48

27/2B area admeasuring 02 Hectare 86 Ares, having corresponding City
Survey No. 2378, 2380, 2388, 2396 to 2399, 2400 to 2418, 6260 to 6266.

13) That the said owners Bame Family & others have entered into Partition
Deed on 21/02/2009 & accordingly the said property i.e. (1) Survey No.
27/2A, admeasuring said 00 H 49 R, came under share of Mr. Vilas Babu
Barne, (2) Survey No. 27/2A, admeasuring said 00 H 23.90 R, came under
share of Mr. Gopal Moru Barne, (3) Survey No. 27/1, admeasuring said 00
H 28 R, came under share of Mr. Namdeo Hari Barne, (4) Survey No. 27/1,

admeasuring said 00 H 23.49 R, came under share of Mr. Kundlik Babu
Barne, (5) Survey No. 27/24, admeasuring said 00 H 23.75 R, came under
share of Mr. Shivaji Bhausaheb Barne, (6) Survey No. 27/1, adiecasuring
said 00H 34.50 R, came under share of Mr. Dnyaneshwar Kisan Barne, (7)
Survey No. 27/1, admeasuring said 00 H 34.50 R, came under share of Mr.
Nandu Govind Bame, 8) Survey No. 27/2A, admeasuring said 00 H 19 R,
came under share of Mr. Vijay Babu Barne, which is also registered in the
office of Sub-Registrar Haveli No. 17, vide its serial No. 1754/2009, Dt.
21/02/2009 and accordingly the name of the said owner Mr, Bhaguji
Baburao Barne was recorded in record of rights, vide Mutation Entry No.
8991

14)That the said owner Mr. Vilas Babu Bame has agreed to sale the said
property 1.e. plot admeasuring 00 Hectare 49 Ares i.e. 4900 Sq.Mtrs, out of
Survey No. 27/2A total area admeasuring 01 H 62 R, by the Agreement to
Sale & Power of Attorney favour of M/s. Sulllwan Chawla
Constructions, through its Partner Shri. Gurumukh Jangaldas Sukhwani,
which is rgistered in the office of Sub-Registrar, Haveli No. 14, Serial No.
1417/2008 & 1418/2008, both dated 08/05/2008.

15) That the said owners Mr. Gopal Moru Barne, Mrs. Kamal Gopal Bare,
Mrs. Sharda Raju Sathe, Mrs. Shobha Bharat Dumare, Mrs. Malan
Sambhaji Sapkal, Mrs. Anjana Ramesh Bhoir, Mr. Kaluram Gopal Bame &
Mrs. Rohini Kaluram Barne have agreed to sale the said property i.e. plot

admeasuring 00 Hectare 23.90 Ares i.e. 2390 $q.Mtrs. out of Survey No.
27/2A total area admeasuring 01 H 62 R, by the AgreementtoSale &
Power of Attorney in favour of M/s. Chawla Constru:

through its Parmer Shri. Gurumukh Jangaldas Sukhwani, which is

registered in the office of Sub-Registrar, Haveli No. 14, Serial No.

1428/2008 & 1429/2008, both dated 07/03/2008.

16) That the said owner Mr. Namdeo Hari Barne, Mrs. Gangubai Namdeg
Barne, Mr. Suresh Namdeo Barne, Mrs. Maina Suresh Barne, Kumar
Sunny Suresh Bare, Smt. Shila Raju Barne, Mr. Somnath Namdeo Bare,
Mrs. Deepali Somnath Bame have agreed to sale the said property i.e. plot
admeasuring 00 Hectare 28 Ares i.e. 2800 4qSq.Mtrs, out of Survey No, 27/1_
total area admeasuring 04 H 48 R, by the Apreement.to.Sale & Power of
Attomey in favour of M/s. Sukhwani. Chawla Constructions, through its
Partner Shr. Gurumukh Jangaldas Sukhwani, which is registered in the
office of Sub-Registrar, Haveli No. 14, Serial No. 14242008 & 1425/2008,
both dated 07/03/2008.

17)That the said owner Mr. Kundalik Babu Bame, Mrs. Chandrabhaga
Kundalik Barrie, Mr. Sharad Kundalik Bare, Kumari. Nilima Kundalik

Barne, have agreed to sale the said property i.e. plot admeasuring 00
Hectare 23.49 Ares i.e. 2349 Sq.Mtrs, out of Survey No. 27/| total area

admeasuring 04 H 48 R, by the Agreement to : Sale & Power of


Attorney in
favour of M/s. Sukhwani Chawla Constructions, through its Partner Shri.
Gurumukh Jangaldas Sukhwani, which is registered in the office of Sub-

Registrar, Haveli No. 14, Serial No. 14442008 & 1445/2008, both dated

07/03/2008.

18) That the said owners Mr. Shivaji Bhausaheb Barne, Mrs. Vishranti Shivaji
Barne, Mrs. Anjana Shivaji Barne, Kumari Kavita Shivaji Bame & Kumari
Ashiwini Shivaji Bame, have agreed to sale the said property i.e. plot

admeasuring 00 Hectare 23.75 Ares i.e. 2375 Sq.Mtrs, out of Survey No.

27/2A total area admeasuring 01 H 62 R, by the Agreement-toSale, &

Power of Attomey in favour of M/s, Svkhwanj fChawla Constructions,

1415/2008 & 1416/2008, both dated 07/03/2008.

19) That the said owner Mrs. Bhamabai Kisan Bame, Mr. Dnyaneshwar Kisan
Barne, Mrs. Rajashri Dnyaneshwar Barne, Mrs. Vanita Prabhakar Wavale
& Kumari. Jayashri Kisan Bame, have agreed to sale the said property i.e.
plot admeasuring 00 Hectare 34.50 Ares i.e. 3450 Sq.Mtrs, out of Survey
No. 27/1, total area admeasuring 04 H 48 R, by the Agreement to Sale &
Power of Attorney in favour of M/s. Sukbwani Chawla Constructions,
through its Parmer Shri. Gurumukh Jangaldas Sukhwani, which is
registered in the office of Sub-Registrar, Haveli No. 14, Serial No.
1426/2008 & 1427/2008, both dated 07/03/2008.

20) That the said owner Mr. Nandu. Govind Barne, Mrs. Drwapada Nandu
Barne, Mr. Vishal Nandu Barne, Kumari. Vaishali Nandu Barne, Kumari.
Vidhya Nandu Barne & Kumar. Ganesh Nandu Barne have agreed to sale
the said property 10. plot admeasuring 00 Hectare 15 Ares ie. 1500
Sq.Mtrs, out of Survey No. 27/1 total area admeasuring 04 H 48 R, by the
Agreement to Sale & Power of Attorney in favour of M/s. : Sukhwani
Chawla Constructions, through its Partner Shri. Gurumukh Jangaldas
Sukhwani, which is registered in the office of Sub-Registrar, Haveli No. 14,
Serial No. 1565/2008 & 1566/2008, both dated 13/03/2008.

21)That the said owners Mr. Vijay Babu Bare, Mrs. Sunita Vijay Barne,
Kumari. Sonali Vijay Barne, have agreed to sale the said property ic. plot
admeasuring 00 Hectare 19 Ares i.e. 1900 Sq.Mirs, out of Survey No.
27/2A. total area admeasuring 01 H 62 R, by the Agreement to.Sale &
Power of Attorney in favour of M/s. Sukhwani Chawla Constructions,
through its Parmer Shri. Gurumukh Jangaldas Sukhwant, which is
registered in the office of Sub-Registrar, Haveli No. 14, Serial No.
14192008 & 1420/2008, both dated 07/03/2008.

Thergaon and this remark being "Hollow Entry" the owners of the saig

property i.e. Mr. Namdeo Hari Bame & others preferred an appliacation to

the Hon'ble Tahasildar, Mulshi (Paud) and after due enquiry of the
adoresaid application vide case No. Kuka/Vashi/Thergaon/457/2010 -

70B/SR/65/10 in accordance with section 70-B and 84-B (B) of the

Bombay Tenancy and Agricultural Lands Act, 1948, the Hon'ble

Tahasildar, Mulshi (Paud) pleased to pass an Order on 28/01/2011 for

deletion of the remark "New Tenure" for the order nghts column of the

7/12 extract of the said property. in pursuance of the said Order of the

Hon'ble Tahasildar, Mulshi (Paud) the remark "New Tenure" from the

other rights column of the 7/12 extract of the said property is deleted and

Mutation Entry No. 9670.

23)The aforesaid Mr. Shivaji Bhausaheb Bare and others through his POA

holder M/s. Sukhwani Chawla Constructions, through its Partner Shri.

Gurumukh Jangaldas Sukhwani had preferred application for permission to

sell their share out of Survey No. 27/2A to the extent of 01 H 15.65 Ares

U/s. 43 of Bombay Tenancy and Agricultural land Act, 1948. Accordingly


Sub-Divisional Officer, Pune granted permission sell_their-share i.e.

admeasuring 01 H15.65 Ares vide Order No. Kulkayda/43/SR/189/2010,


dated 21/12/2010.

24) That the said owners Mr. Vilas Babu Barne through his POA holder M/s.
Sukhwani Chawla Constructions, through its Partner Shri. Gurumukh
Jangaldas Sukhwani have transfered the said property i.e. plot admeasuring
00 Hectare 49 Ares i.e. 4900 Sq.Mtrs ont of Survey No. 77/2A.total area

in favour of M/s. Sukhwani ChawlaConstructions, through its Partner Shri.

Registrar, Haveli No. 17, Serial No. 2924/2011, dated 15/03/2011 and

accordingly the name of the Present owners i.e. M/s. Sukhwani Chawla

Serial No. 2919/2011, dated 15/03/2011 and accordingly the name of the
Present owners 1.e. M/s. Sukhwani Chawla Constructions, through its
Partner Shri. Gurumukh Jangaldas Sukhwani was recorded in record of

rights, vide Mutation Entry No. 10101.

-32)That demarcation of the said property was done on 23/03/2010 and


Certificate to that effect has been obtained vide More No. 31942010 &
3195/2010.
33) That the M/s. Sukhwani Chawla Constructions, through its Partner Shri.

Gurumukh Jangaldas Sukhwani have got the building plan approved from
PCMC vide the Commencement Certificate No. BP/Thergaon(Z2016, dt.

30/09/2016 and also got the NA order from the Office of Collectorate Pune

vide Order bearing No. PCMC/Sanad/SR/95/2017 dated 10.05.2017.

34) That | have also taken the search in the office of Sub-Registrar, Haveli
No.

Il, V, XV, XIV, XVII, XVIII & XXVI, for the last thirty years i.e. 1992
to

2021, however most of the records were in torn conditions and some

records were not available & also taken online search in IGR website. no

other entries were found which may affect the title of the vendors or
present

Promoter & Developers, Hence this Search Report is issued in respect of

the said property.

That I have also considered the documents i.e. Deeds, Agreement, 7

12 extract, mutation entries and maps issued by the City Survey Officer &

other documents. That I have taken the necessary search for the last thirty

years records available in the office of Sub-Registrar, Haveli No. Il, V, XV,

XIV, XVII, XVII & XXVI, and therefore I certify M/s. Sukhwani Chawla

Constructions, through its PartnerShri, Gurumukh Jangaldas Sukhwani are

the owners of the Property Le. land admeasuring 01H 15.65 Ares out of area

Survey No. 27/2A having total admeasuring 01 H 62 R + land admeasuring

00 H 71.99 Ares + Potkharaba area admeasuring 00 H 29 Ares i.e. total area

admeasuring 01H 00.99 Ares out of area Survey No. 27/1 having total

: admeasuring 04 H 49 R, ic. total land area admeasuring 02 H 16.64 R,

situated at Village Thergaon, Taluka Mulshi, Dist- Pune, more particularly


described in the schedule mentioned herein below & the said plot is free from

all encumbrances and reasonable doubts & M/s. Sukhwani Chawla

Constructions, through its Partner Shri. Gurumukh Jangaldas Sukhwani are

having clear_andwamarketable, title to sale/develop the said plot, which 1s

subject to the building permission rule & regulations of Pimpri Chinchwad

'Municipal Corporation, as amended from time to time.
