SPECIAL POWER OF ATTORNEY

KNOW ALL MEN BY THESE PRESENTS:

I, DANIEL JR. DESTREZA PATOZA of legal age, single, with residence and postal
address at Purok Maligaya, Barangay Campo, Bacuag, Surigao del Norte do hereby name,
appoint, and constitute SHIELA TECSON GAMAYON of legal age, Filipino, single, with
residence and postal address at Purok Maligaya, Barangay Campo, Bacuag, Surigao del
Norte as my true and lawful ATTORNEY-IN-FACT for and in my place, stead and behalf, to do any
and/or all of the following acts:

1. To purchase from PRIMA CASA LAND AND HOUSES INC. (“Seller/Developer”) a


residential house &lot/ lot/ condo unit, with or without improvements thereon,
specifically identified as ANGELI TH EU Phase 3 Block/ Floor 6 Lot/ Unit 1 of the
LUMINA HOMES BUTUAN Subdivision/ Building/ Project located at B a r a n g a y
T i n i w i s a n , B u t u a n C i t y , Agusan del Norte presently covered by Transfer
Certificate of Title (TCT)/Original Certificate of Title (OCT) No. ________, and
registered in the name of the Seller/Developer, particularly described as follows:

(Hereinafter referred to as the “Subject Property”)

2. To do and perform any and all acts necessary and/or desirable to effect the purchase
of the Subject Property, including, but not limited to the following acts:

a) To negotiate and/or agree to the terms and conditions of the purchase and other
matters relating thereto, and choose as well decide on the details/particulars of the
Subject Property;

b) To enter, execute, sign and deliver all contracts and agreements, including but not
limited to the Reservation Agreement, Contract To Sell, Deed of Absolute Sale, and
other documents, papers pertinent to the purchase of the Subject Property;

c) To make payments relative to the purchase of the Subject Property;

d) To change, replace the Subject Property originally or previously chosen/reserved, if


necessary under the circumstances;

e) To withdraw from or cancel any and all agreements/contracts related to the purchase
of the Subject Property, whether entered into by me or on my behalf, and receive
refunds or any other amount (s) due to me, whether in the form of cash or check
issued in my name or in the name of my ATTORNEY-IN-FACT;

f) To receive originals or copies of the documents relative to the purchase of the


Subject Property, such as, but not limited to Reservation Agreement, Contract to Sell
and Deed of Absolute Sale, as well as any and all documents involving or affecting
the Subject Property, such as, but not limited to title, tax declaration and receipts or
clearances;

g) To receive any and all communications, notices, memos, letters and demands from
the Seller/Developer addressed to me or to my ATTORNEY-IN-FACT in relation to the
purchase of the Subject Property;

h) To receive the key to the unit (if any) and sign the relevant documents
acknowledging receipt of the Subject Property, in good and proper condition for the
purpose of absolving the Seller/Developer, as the case may be, from any liability with
respect to the Subject Property;

i) To process applications for installation and connection of utilities in the Subject


Property, such as, electrical utilities from Manila Electric Company (MERALCO), water,
telephone, cable and other utilities from pertinent service providers with the
authority to sign, execute, deliver and receive all documents and to do all acts
necessary and in connection thereto, including the right to receive refunds from
MERALCO and/or other service providers, if any; and

j) To do all acts necessary for the accomplishment of the foregoing acts and authorities.

3. To apply for, negotiate and obtain a loan from any bank or financial institution
(“Bank”) to partially or fully finance my purchase of the Subject Property in the
amount of PESOS:

or in such amount(s) that may be approved by the Bank and/or the Seller/Developer and
to constitute, encumber and convey the Subject Property in favor of the Bank, as a
security for the payment of the said loan under such terms and conditions as my said
ATTORNEY-IN-FACT may deem beneficial and convenient, with the authority to do the
following:

a. To sign, execute, deliver and receive all documents, contracts or agreements


in connection with the loan obtained from the Bank, such as, but not limited to,
Promissory Note/s, Loan Agreement, Deed of Real Estate Mortgage and Letter
of Guaranty;

b. To receive for and in my behalf, the proceeds of the loan from the Bank, and if
necessary, to assign the proceeds of the loan in favor of the Seller/Developer
and to sign, execute and deliver all documents relative to the said assignment
of loan proceeds;

c. To encash, endorse or negotiate the checks that may be issued by the Bank or
Seller/Developer in connection with the said loan;

d. To receive for and in my behalf, any and all documents, notices,


communications and legal/court processes related to the afore-said loan,
including the owners duplicate copy of the title to the Subject Property upon
full payment of the loan;

e. To compromise, settle and agree on any matters, judicially or extra-judicially,


in concerning the loan extended to me by the Bank and/or the
Seller/Developer and secured by the Subject Property; and

f. To do and perform any and all acts necessary to accomplish the foregoing acts
and authorities

HEREBY GIVING AND GRANTING unto my said ATTORNEY-IN-FACT full powers and authority to
do and perform all or any act requisite and/or necessary to carry into effect the
foregoing authorities, as fully to all intents and purposes as I might or could lawfully do, if
personally present and acting in person, and HEREBY RATIFYING AND CONFIRMING all that
my said ATTORNEY-IN FACT may also do or cause to be done under and by virtue of these
presents.
