WHEREAS, it is the policy of the state to promote and protect the physical, moral, spiritual
intellectual and social well-being of the youth in our country.
WHEREAS, it has been observed that group of children and young adults keep on roaming
strolling and lounging around in public places especially at night.
WHEREAS, most cases of accidents, crimes and other related incidents frequently take place
at night due to various compelling reasons;
WHEREAS, prohibiting our children from continuously dwelling on with such unpleasant
pastime is one way to discipline and regulate their extra activities with their group mates or
company;
WHEREAS, the Barangay Government believes that a curfew imposed on minors or those
under the age of eighteen (18) is logical and such move is in the best interest not only of the
young constituents but of the public in general as what will promoted is the entire
community’s safety and welfare.
BE IT RESOLVED, to enact:
BARANGAY ORDINANCE NO. 05
Series of 2023
Section 1. TITLE. This Ordinance shall be known as the “BARANGAY PALAO, SOLANA,
CAGAYAN CURFEW ORDINANCE FOR MINORS”.
Section 2. SCOPE. This curfew ordinance shall apply to minors aged seventeen (17) years
and below from loitering in public places within the barangay. Curfew for the following age
bracket is as follows:
a. Loitering – to hang around idly and linger in certain public places (this shall
include the act of loitering while inside any vehicle stationed in herein stated
public places during the barangay –wide curfew)
b. Public Places – shall include but not limited to the following: schools,
theaters/movie houses, bars/restaurants/canteen/kiosk, and other enclosed
public eating places, dance houses, department stores, markets/groceries and
other places where people stay or gather for social, sports or entertainment
purposes.
Section 4. EXEMPTIONS. This ordinance shall not apply to minors loitering within the
time and place mentioned herein above with sufficient justifiable reasons, (i.e. school or work
related or religious activities). Provided that students must present their ID’S, while out of
school youth’s and working students must present their job I.D’S to the apprehending officer.
Likewise, minors accompanied by their parent or legal guardians are exempted;
1. FIRST OFFENSE – a minor found violating this ordinance for the first time will be
referred to the nearest barangay hall or police station. The Barangay Council for
Protection of Children shall conduct counselling before the minor will be properly
turned over to his/her parent/s or guardian/s; A Community Service of Three (3) hours
or a Fine of Two Hundred Fifty Pesos (P250.00) shall be imposed to the
parent/guardian;
2. SECOND OFFESENSE – a minor found violating this ordinance for the second time
will be referred to the nearest barangay hall or police station and required to attend,
together with his/her parent/s or guardian/s, two (2) consecutive regular sessions of
the Sangguniang Barangay for the Protection of Children for counseling, which shall
include this matter as part of its session’s agenda; the parent/s or guardian/s of the
minor who violated this ordinance for the second time shall be required to render A
Community Service of Six (6) hours or a Fine of Five Hundred Pesos (P500.00) shall
be imposed to the parent/guardian;
3. THIRD OFFENSE – a minor found violating this ordinance for the third time will be
referred to the nearest barangay hall or police station and required to attend, together
with his/her parent/s or guardian/s, three (3) consecutive sessions of the Barangay
Council for the Protection of Children for counseling, which shall include this matter
as part of its session’s agenda; the parent/s or guardian/s of the minor who violated
this ordinance for the third time shall be required to render a Community Service of
Nine (9) hours or a Fine of Seven Hundred Fifty Pesos (P750.00) shall be imposed to
the parent/guardian; and
4. FOURTH AND SUCCEEDING OFFENSES – the minor shall be turned over to the
Municipal Social Welfare and Development Office (MSWDO) for custody and for
appropriate Intervention Program for a period which will depend upon the findings
and recommendation of the MSWDO. His/her parent/s or guardian/s of the minor who
violated this ordinance for the fourth and succeeding time shall be penalized with a
fine of One Thousand Pesos (P1,000.00) or a Community Service of Twelve (12)
hours at the discretion of the court. Public or Private Agency duly appointed by the
court to have custody/intervention over the minor shall not be subject to the penalty of
imprisonment.
Section 6. PROCEDURE. To protect the rights of the juvenile offender, the legal
guardian/parents of the child shall properly be informed of the violation committed before the
sanctions are carried out by the apprehending officer/s.
Section 10. EFFECTIVITY. This Ordinance shall take effect immediately upon approval,
after its posting in at least three (3) conspicuous places within the barangay.
