These terms and conditions, hereinafter referred to as "Terms and Conditions," regulate
the access and use of the website www.legria.com and other digital platforms, such as
mobile applications, provided by Legria SpA ("Legria") for the provision of the services
detailed in this document.
To access the services offered by Legria through the website and other platforms, it is
an essential requirement that the User understands and subsequently accepts these
Terms and Conditions, which regulate the access and use of the Site and the platforms,
and are understood to be incorporated into all operations carried out and services
contracted through it. Any User who does not fully accept these Terms and Conditions
must refrain from using the Site and the platforms.
It is noted that these Terms and Conditions generally regulate the use of the website
and platforms made available by Legria to the User. The contracting of services offered
by Legria, such as the acquisition of fractions of the offered Properties and Property
Management Services, will be governed by the respective contracts, which will be
timely provided to the client for their subscription.
On some occasions, there may be additional terms and conditions, such as rules for a
specific commercial event or other determined activity, or conditions that may
accompany certain products or services. These additional terms and conditions will be
provided in due course and will be understood to add to these Terms and Conditions.
In case of conflict, they will prevail over these Terms and Conditions once accepted by
the User.
1. Glossary
a) Legria: It is the company Legria SpA, tax identification number 77.524.992-7, legally
represented by Pedro Pablo Mir Cerda, national identity card number 17.085.328-8,
both domiciled at Avenida Apoquindo 3500, 16th floor, Las Condes.
c) Platform: It is any mobile application or digital platform that Legria makes available
to Users for the use of services and is fully governed by these Terms and Conditions.
d) User: Any natural or legal person who enters the Site either to review the content or
to carry out operations on it.
e) Property(ies): They are the properties acquired by Legria SpA, through companies
constituted for that purpose, and exhibited on the Site for the subsequent acquisition
of one or more fractions of them by the User.
2. Services
Legria offers Users the acquisition of one or more fractions of a Property, through
participation in its Property Owning Company. The specific terms for acquiring a
fraction of a particular Property (usage period, number of fractions, maintenance costs,
contributions, insurance, basic services, etc.) will depend on the specific Property and
will be duly provided to the User prior to contracting.
On some occasions, Legria will require a reservation payment before starting the
process of acquiring the chosen Property fraction by the User. In such cases, the
specific reservation conditions will be duly and timely informed to the User before
reserving the particular Property.
3. Capacity
Access and contracting on the Site and/or the Platform must be carried out by persons
over 18 years old and with legal capacity to contract.
4. User Registration
User registration on the Site and/or the Platform is an essential condition to acquire the
goods offered by Legria. As part of the registration, the User must enter some personal
data, such as their name, national identity card, address, email, phone number, and
date of birth. When registering, the User must accept each and every clause contained
in these Terms and Conditions.
By providing the data requested by Legria, the User declares that such personal data
are accurate and truthful, and must update them whenever there is a change. Legria
has no influence on the information entered by the User, so the latter guarantees and
will be responsible, in any case, for the truthfulness, accuracy, completeness, validity,
and authenticity of the data entered.
The User is responsible for taking all necessary measures to maintain the confidentiality of
their account and password. The User is obligated to notify Legria about any unauthorized
use of their account, password, or other data from the moment they become aware of it, or
any other security breach related to their account.
Legria has technical, administrative, and physical security measures designed to prevent
unauthorized access, disclosure, use, or modification of User information.
The User registered on the Site and/or the Platform may request the rectification, deletion,
and/or cancellation of their data, in accordance with the provisions of Law No. 19,628 on
Protection of Private Life.
Legria may suspend the use of the account for an indefinite period until the User guarantees
compliance with these Terms and Conditions or other conditions that may have been agreed
upon between the parties. After 15 days of account suspension without the User providing
sufficient assurance of compliance, Legria may delete the account.
The suspension and/or deletion of the account will not affect the rights and obligations
already contracted between the parties.
It is prohibited to sell, assign, or transfer the account in any manner and under any title.
If the User's account is deleted and Legria confirms that, despite this, the User is operating
or is associated with another account, Legria may suspend or delete the respective related
account.
The User must use the Site and/or Platform in accordance with applicable law, these Terms
and Conditions, and any other agreement entered into between the parties. Furthermore, the
User may only use the Site and/or Platform in good faith and exclusively for the purpose for
which it was designed.
a) Use the Site and/or Platform for purposes other than those established in the Terms and
Conditions;
b) Use any method or technique to access the source code or elements of the Site and/or
Platform;
c) Take any action or omit any action that may give rise to claims, fees, fines, penalties, or
other liabilities of any nature for Legria, or that may affect its commercial reputation;
d) Take any action or omit any action that may damage, interfere with, intercept
surreptitiously, or expropriate any platform, system, data, or information;
f) Spread, or facilitate the spread of, any type of virus, worms, or other malicious software
that may damage or alter in any way, interfere with, intercept surreptitiously, or expropriate
any platform, system, data, or information of Legria or any of its Users;
g) Violate or infringe intellectual property laws and/or the prohibitions stipulated in these
Terms and Conditions, including copyright, patents, trademarks, trade secrets, or other
intellectual property rights or publicity or privacy rights of Legria or third parties, nor
disclose or market information collected through the Site and/or Platform.
h) License, sublicense, sell, resell, rent, lease, transfer, assign, distribute, or otherwise
commercially exploit or make available to any person their account and password;
i) Monitor or copy the Site and/or Platform using robots, spiders, other computer programs,
or any other process, manual or technological;
j) Use any automated means of data extraction to access, query, or otherwise collect
information related to the advertisements on the Site and/or Platform;
k) Post on the Site and/or Platform any content or image that is illegal (or obtained illegally),
immoral and/or harmful to the physical and psychological integrity or dignity of persons,
including promoting or inciting hatred, discrimination, any illegal activity or product, or
contrary to good customs;
l) In general, perform any act that may give rise to an infringement or damage of laws, these
Terms and Conditions, intellectual or material property of Legria or third parties; and,
Legria declares that it fully complies and will comply with the current legislation on the
protection of Users' privacy and their personal data, especially Law No. 19,628 on the
Protection of Private Life.
The personal data provided by the User through the Site and/or the Platform will be processed
for the purpose of providing the services, and in particular: (i) contacting the User; (ii)
sending all kinds of informational material related to the provision of services; (iii) sending
advertisements, promotions, contests, and any other material aimed at promoting Legria's
services and products. The User will always have the option to request the suspension of
advertising material; and (iv) sending surveys and other consultation systems to evaluate
Legria's services and products.
The information collected will be stored for the time necessary to fulfill contractual
obligations, legal requirements, or during the legal prescription period of possible legal
and/or contractual liabilities. Once this period has elapsed, the data will be deleted or
anonymized so that the owner cannot be identified.
In accordance with the provisions of Law No. 19,628 on the Protection of Private Life, the
User may exercise their rights of access, rectification, cancellation, opposition, and all rights
conferred by the Law, through any of the contact means provided by Legria.
The User accepts that the Site and/or Platform may not be available due to technical
difficulties or Internet failures or any other circumstance beyond Legria's control.
Legria will make its best efforts to keep the Site and/or Platform permanently operational;
however, it may occasionally be inaccessible, unavailable, or out of operation due to: (i)
periodic maintenance or repairs; (ii) equipment malfunction; (iii) network attacks or other
hostile actions; or (iv) other reasons beyond Legria's control. These circumstances, among
other things, may affect the availability of the Site and/or Platform, so its availability is not
guaranteed.
All rights, including intellectual property rights, regarding the Site and the Platform belong
to Legria.
Both the content and photographs published on the Site and/or the Platform, as well as the
programs, databases, networks, and files that allow the User to use the Site, the Platform, and
access the services, are the property of Legria or have a license for their use, publication,
and/or distribution, which the User accepts and acknowledges, and are protected by
copyright, trademark, patent, industrial design laws, and international treaties.
11. Jurisdiction and Applicable Law
Any dispute arising regarding the existence, validity, compliance, interpretation, validity,
execution, or any other matter related to these Terms and Conditions will be submitted to the
jurisdiction of the competent Ordinary Courts.
