1. What did the sites in the module tell you about each of the agencies? What do
they do(1/2 page each)?:
A. OSHA
The Occupational Safety and Health Administration (OSHA), was created by
congress to ensure that working conditions for workers are safe and healthy by
establishing and enforcing standards and by providing training, outreach,
education, and assistance (US Department of Labor). It was created so that no
worker must choose between their life and their job and makes it very clear that
the right to a safe workplace is a basic human right. OSHA covers most private
sector employees and their workers, as well as some public sector employees
and workers in the United States; it is part of the United States Department of
Labor. OSHA’s administrator answers to the Secretary of Labor, who is a
member of the cabinet of the President of the United States (US Department of
Labor).
Under OSHA law, workers are entitled to working conditions that do not pose risk
or serious harm. Workers have the right to file a confidential complaint with
OSHA to have their place of business inspected, receive information and training
about hazards, methods to prevent harm, and the OSHA standards that apply to
their workplace, participate in OSHA inspection, and many more (Occupational
Health and Safety Administration).
Since OSHA was formed, the agency has shown incredible progress. With their
standards and guidelines in place, workplace injuries, illnesses, and fatalities
have decreased by almost 63%. In 1970, it was estimated that almost 14,000
workers were killed on the job. In 2018, these numbers fell to about 5,200 when
at the same time, US employment has more than doubled (Occupational Health
and Safety Administration).

The Occupational Safety and Healthy Review Commission (OSHRC), is an
independent federal agency that is not part of the Department of Labor or OSHA
(Occupational Safety and Health Review Commission). It was created by
congress (just like OSHA) to decide contests of citations or penalties that OSHA
issues to employers following inspections of American workplaces.
OSHRC functions in a two-tiered administrative court with procedures to conduct
hearings, receiving evidence, and rendering decisions by its administrative law
judges. They are also able to review ALJ decisions by a panel of commissioners.
The mission of the Occupational Safety and Health Review Commission is to
give fair and timely judgment of workplace safety and health disputes between
the Department of Labor and employers. In doing this, the Commission plays a
vital role in encouraging safe and healthy workplaces for American workers
(Occupational Safety and Health Review Commission).

Agency?
The Michigan Occupational Safety and Health Administration or MIOSHA is part
of the Michigan Department of Licensing and Regulatory Affairs. The main office
is located in Lansing.
The Michigan State Plan applies to private-sector workplaces located in Michigan
and to state and local government employers. It does not apply to federal
government employers like the US Postal Service.
MIOSHA offers voluntary and cooperative programs that focus on reducing
injuries, illnesses, and fatalities. MIOSHA also offers on-site consultant services
which help employers comply with MIOSHA standards and identify and correct
potential safety and health hazards (Michigan State Plan).
3. (Short answer) what percentage change was there for Willful Violations from
2011 to 2013 (State whether it was an increase or decrease)? (Hint: enforcement

In 2011, the total amount of willful violations was 594. In 2013, the total amount of willful
violations was 319. That means that total willful violations between 2011 and 2013
decreased by 46%.
