THE CODE ON SOCIAL SECURITY ACT,2020.

CHAPTER - III

Section 14 - Appointment of officer of central board.

Meaning - Appointment of officers of Central Board means selecting and designating individuals to
manage and administer social security schemes, such as provident funds, pension schemes, and
insurance schemes, under the Central Board's oversight.

- Central Provident Fund Commissioner:

- Appointed by Central Government


- Chief Executive Officer of Central Board
- Head of Employees' Provident Fund Organisation
- Financial Advisor and Chief Accounts Officer:

- Appointed by Central Government


- Assists Central Provident Fund Commissioner
- Additional officers:

- Appointed by Central Board


- Include Additional Central Provident Fund Commissioners, Deputy Provident Fund
Commissioners, Regional Provident Fund Commissioners, Assistant Provident Fund Commissioners,
and other officers and employees
- Consultation with Union Public Service Commission:

- Required for appointments to certain posts


- Exceptions for temporary appointments or appointments of certain government officials
- Terms and conditions of service:

- Specified by Central Government


- Include method of recruitment, salary, allowances, discipline, and other conditions

- Required for appointments to posts with scale of pay equivalent to Group 'A' or Group 'B' posts
under Central Government
- Exceptions:
- Temporary appointments (less than 1 year)
- Appointments of:
- Members of Indian Administrative Service
- Central Government or Central Board employees in Group 'A' or Group 'B' posts

Terms and Conditions of Service

- Specified by Central Government


- Include:
- Method of recruitment
- Salary and allowances
- Discipline
- Other conditions of service
- Salary and allowances of Central Provident Fund Commissioner and Financial Advisor and Chief
Accounts Officer paid out of Provident Fund

Additional Provisions

- Social Security Organisations may assign additional functions to existing officers or appoint/engage
new officers
- Terms and conditions of discharging functions specified by Central Government
- Expenditure incurred in discharging functions borne by Central Government
- Powers of Social Security Organisation specified by Central Government
- Expenditure made by Social Security Organisation after prior approval of Central Government

SECTION 109 – FRAMING OF SCHEMES FOR INORGANIZED WORKERS.


CHAPTER- IX

Meaning - Framing of Schemes for Unorganized Workers" means creating programs to support
informal sector workers, providing benefits like social security, health insurance, and financial
assistance.
The Central Government and State Governments shall frame and notify welfare schemes for
unorganized workers, covering aspects like:

- Life and disability cover


- Health and maternity benefits
- Old age protection
- Education
- Provident fund
- Employment injury benefit
- Housing
- Skill upgradation
- Funeral assistance
- Old age homes

These schemes may be funded by:

- Central Government
- State Government
- Contributions from beneficiaries or employers
- Corporate social responsibility funds
- Other specified sources

Each scheme shall include details on:

- Scope
- Implementing authority
- Beneficiaries
- Resources
- Implementing agency
- Grievance redressal
- Other relevant matters

CHAPTER III

SECTION 6- DUTIES OF EMPLOYER AND EMPLOYEES

MEANING -Employers' duties: Ensure a safe and healthy work environment, comply with safety
standards, and provide necessary protections and benefits for employees.

It shall be the duty of every employer to:

1. Ensure a hazard-free workplace


2. Comply with occupational safety and health standards
3. Provide annual health examinations for employees
4. Maintain a safe working environment
5. Ensure proper disposal of hazardous waste
6. Issue appointment letters to employees
7. Not charge employees for safety and health measures
8. Ensure safety and health of all persons on work premises

Additionally, employers in factories, mines, docks, construction, and plantations must:

1. Provide and maintain safe plant and systems


2. Ensure safe handling, storage, and transport of materials
3. Provide information, instruction, training, and supervision for employee safety
4. Maintain safe places of work and access routes
5. Provide a safe working environment and monitor employee welfare

These duties aim to ensure a safe and healthy work environment for all employees.
