the mid-20th century. A key moment was the 1956 Dartmouth Conference, where John
McCarthy first used the term "artificial intelligence." Pioneers like Marvin Minsky, Allen
Newell, and Herbert A. Simon wanted to create machines that could think like humans,
which laid the foundation for today's AI. AI also helps with global sustainability and
supports the UN’s 2030 agenda for a better world. However, it comes with challenges like
ethical issues, data biases, and regulation concerns, making it important to find a balance
between its benefits and its impact on society.

2. Challenges in AI

 Ethical and Legal Questions: AI presents challenges, including bias in data


collection, unequal implementation, and privacy/security concerns. These issues
require multi-disciplinary solutions involving legal, technological, and cultural
analysis.
 Regulation and Policy: Governments are debating whether to modify existing
regulatory frameworks for AI. More laws may not necessarily be the solution; instead,
the focus is on balancing AI’s benefits with its potential negative impacts.

3. What is Artificial Intelligence?

 Definition: AI involves programming machines to perform tasks that reduce human


effort (e.g., virtual assistants like Alexa, face recognition, autopilots).
 Various Definitions:
o Obama’s administration defined AI as a computerized system that solves
complex problems.
o Microsoft in a 2018 book defines AI as technologies enabling computers to
learn and assist in decision-making.
o The European Commission views AI as systems that display intelligent
behavior autonomously to achieve goals.
 AI and Automation: AI is not merely automation; it involves cognitive processes
similar to human intelligence (e.g., reasoning, planning, strategizing).

 Narrow AI (Weak AI): AI focused on specific tasks (e.g., stock trading, reading X-
rays, self-driving cars, language translation).
 General AI (Strong AI): Aims to perform tasks in multiple domains, solving new
problems and learning independently.

 Turing Test: The Turing Test is a method of inquiry in artificial intelligence (AI) for

test is named after Alan Turing, the founder of the Turing Test.
 Reverse Turing Test: A variant where a human tries to prove they are not a machine.

Lastly, explicability stresses the importance of making AI systems and their decisions

Penal Code (Section 11), a "person" can include a company or group, meaning legal
personality can extend beyond humans.

Types of Persons:

1. Natural Persons: These are living human beings. To qualify as a natural person, one
must be alive and recognized as a legal person, meaning they cannot be slaves or
under absolute control.
2. Legal (Artificial) Persons: These are non-human entities like corporations or
companies. Legal persons are created by law and recognized as having legal rights
and duties. For instance, corporations are treated as individuals by law, even though
they are artificial creations.

Theories of Legal Personality:

1. Fiction Theory: This theory, supported by jurists like Savigny and Salmond,
suggests that legal persons, other than humans, are artificial creations of the law. They
exist only because the law recognizes them as persons. The classic case of Salomon
v. Salomon established that corporations are separate legal entities distinct from their
members.
2. Concession Theory: This theory states that legal personality is a concession by the
state. Corporations and other legal persons only exist because the state grants them
personality. Jurists like Savigny and Dicey supported this view, highlighting the
state's role in creating legal entities.
3. Purpose Theory: This theory suggests that legal persons exist to fulfill certain
purposes, especially in the case of charitable organizations. The juristic person
doesn’t have inherent rights but serves a specific objective.
4. Realist Theory: Unlike the fiction theory, this theory claims that corporations are real

 In this case, the rivers Ganga and Yamuna were granted legal personality by the
court. The rivers, along with their tributaries, were recognized as living entities with
legal rights and duties, similar to humans. This ruling was meant to help protect and
preserve the rivers.

Salomon v. Salomon & Co. Ltd. (1897):

 This case is one of the most important in corporate law. It established the principle of
separate legal entity, meaning that a corporation is legally independent from its
members. In this case, it was ruled that once a company is legally formed, it is a
separate entity from its shareholders.

New Legal Status of Robots in the European Parliament (2017):

 The European Parliament adopted a resolution calling for the recognition of a


specific legal status for robots, particularly autonomous robots, as electronic
persons. This was to ensure that robots could be held responsible for any damage
they cause due to their autonomous decision-making.

prevent discrimination.
 Transparency: Detailed documentation must be kept to explain how the AI system
works and how it complies with the law.
 Human Oversight: AI systems must allow human intervention, especially in critical
situations.
 Security and Accuracy: AI systems must be secure from cyber threats and operate
accurately and reliably.

Accountability and Penalties:

The Act introduces serious penalties for non-compliance. Companies can face fines of up to
€30 million or 6% of their global revenue. Additionally, the Act establishes a European
Artificial Intelligence Board to oversee the application of the rules across the EU.

safety.
