1.Period of Contract: The Contract shall ini ally be valid for a period of one year and may be extended
further for a period of one-year subject to sa sfactory performance, on the same terms and
condi ons. The rates quoted by the bidder shall remain unchanged during the period of contract.
ESIC, however, reserves the right to terminate the contract by serving one months’ no ce, in
wri ng.
2.Earnest Money Deposit (EMD): EMD of requisite amount to be deposited in the form of Demand
Dra drawn in favor of “ESI Fund A/c No.1" payable at Varanasi. The scanned copy of the same to
be uploaded on GeM portal. Firm/Establishment registered under MSME will be exempted from
submission of EMD as per exis ng guidelines, but will be required to ll Bid-Securing Declara on
form.
3.Scanned copy of all the following documents are mandatory to be uploaded for technical Evalua on.
All documents are to be signed, stamped and numbered by the bidder. Bids received without
scanned copy of any of the following documents will be rejected. Please Note that bid shall be liable
to be rejected if legible scanned copies of documents listed above are not uploaded in Technical bid.
4.Sa sfactory work comple on cer cates will be accepted only for ful lling experience criteria. Same
is to be issued on the organiza ons’ le erhead where work was taken place, duly signed and
stamped by authorized signatory. Mere uploading Contracts will not hold the ground for experience
cer cates.
5.The Deputy Director In charge reserves the right to reject all Bid in whole, or in part, without
assigning any reason thereof.
6.Number of Security Guards to be hired is 04 (03 male, 01 female).
7.The earnest money shall be refunded to the unsuccessful Bidders a er naliza on of the contract. It
shall be refunded to the successful Bidder on receipt of performance security deposit. No interest is
payable on the EMD.
8.In case the successful Bidder declines the o er of Contract, for whatsoever reason(s), their EMD shall
be forfeited.
9.A formal contract shall be executed/ entered into with the successful Bidder. In this contract, the
successful Bidder shall be de ned as Contractor.
10.Bids which are incomplete or Condi onal in any form shall be rejected out rightly. The successful
Bidder will have to deposit 5% Performance Security Deposit as per Bid Details on GEM in the form
of Demand Dra in favor of “ESI Fund A/c No.1” payable at Varanasi.
11.The successful Bidder will have to deposit the Performance Security and execute the contract within
15 days from the date of award of the contract through GeM, failing which, the competent
authority may cancel the award of work and forfeit the EMD and take other appropriate ac on as
deemed t.
12.Minimum wages as xed and revised from me to me by the o ce of the Chief Labour
Commissioner (central) as applicable to “WATCH AND WARD” – “without arms” should be paid by
the contractor. Whenever Minimum wages is revised by the respec ve Labour authori es, it shall
be duty of the contractor to immediately pay such revised minimum wages to the contract
personnel deployed and then re-imbursement may be claimed from The Deputy Director In charge
of ESIC, Sub Regional O ce, Varanasi (UP).
13.The Agency shall comply with Contract Labour (R&A) Act, PF provisions, ESI provisions, Payment of
Bonus Act etc. whichever applicable and all other statutory payments will be the liabili es of the
Security Agency, applicable from me to me.
14.Although a empt will be made by ESIC SRO Varanasi to make payment to the security agency on
me but the payment to deployed security personnel by the agency shall not be linked to clearance

15.The Contractor must provide three number standard liveries (uniform) at his own cost to the
Security sta . The sta shall be in proper uniform as approved by ESIC Sub Regional O ce
Authori es and with their iden ty card properly displayed.
16.The Deputy Director In charge can direct to security agency for replacing of a security person who is
not discharging his du es sa sfactorily or his role is found dubious in nature.
17.The agency shall not engage any sub-contractor or transfer the contract to any other person.
18.Female Civilian Guard will be paid as per the minimum wages rates prescribed by Chief Central
labour Commissioner (Central), New Delhi or the rates prescribed by the State Govt, whichever is
higher. The rates/VDA will be enhanced as and when the minimum wages are revised by CLC(c)/
state govt. as the case may be.
19.The Eight Hours Shi will normally commence from 06:00 hrs. to 14:00 hrs., 14:00 hrs. to 22:00
hrs.and 22:00 hrs. to 06:00 hrs. and would be called Morning, Evening and Night Shi s respec vely.
But the mings of the shi are changeable and can be xed by this o ce from me to me
depending upon the requirements. Prolonged duty hours (more than 8 hours at a stretch) shall not
be allowed. No payment shall be made by this o ce for double duty, if any.
20.Female Security guard is to be deployed at o ce hours only, i.e. Shi will be 0900 hours to 1730
hours.
21.Weekly Day of Rest: An employee (Security Guard/Supervisor) in a scheduled employment in
respect of which minimum rates of wages have been xed under the Act, shall be allowed a day of
rest every week (hereina er referred to as “the rest day”) which shall ordinarily be Sunday, but the
employer may x any other day of the week as the rest day for an employee.
22.A endance of personnel will be maintained by the Service Provider and copy of the same shall be
provided along with the monthly bill to the o ce of the ESIC latest by 7st working day of the
following month.
23.The Agency shall deploy security personnel a er medical examina on & police veri ca on at its own
cost and related cer cates is to be submi ed to the ESIC Sub Regional O ce Varanasi authori es
at the me of deployment.
24.The list containing the names, veri ed addresses, a xing a photograph along with the signature of
each employee appointed by the Agency shall be made available to the ESIC Sub Regional O ce
authori es with their Bio-data before commencing the contract.
25.The changes in the personnel deployed will not be allowed without prior approval/permission of the
Deputy Director in charge, ESIC SRO Varanasi or any other authorized o cer.
26.The Performance security deposit shall be returned to the Agency two month a er the expiry of the
contract period on furnishing usual clearance/No Demand Cer cate. The Security Deposit shall be
returned on the expiry or termina on of the Contract subject to condi ons that the Security Agency
has indemni ed the 1st Party (The Deputy Director of ESIC, Sub Regional O ce, Varanasi (UP)) for
all payments to the sta . The Security Agency while reques ng for release of the Performance
Security Deposit shall cer fy that all payments including Labour Laws obliga ons have been ful lled
and that the ESI Corpora on authori es shall not be responsible for such payments to the sta
arising out of the decision of the Labour court, if any.
27.The Contract shall come into force from the date as agreed at Agreement signed by both the par es.
In case the Agency fails to execute the job a er signing the Agreement deed or leave the job before
comple on of the period of Contract at their own accord, The Deputy Director In charge of ESIC,
Sub Regional O ce, Varanasi (UP) shall have the right to forfeit the Performance Security Money
Deposited by the Agency for execu on of the Contract.
28.Presenta on of Bills: The Billing cycle would be the calendar month and the agency shall present its
bill complete in all respects up to 7th of each month. However, the agency must make the payment
to the workers through bank transac on on last day of each month and this payment is not linked to
the clearing of the bill by ESIC SRO Varanasi.

iv. The bill for each month shall be presented in triplicate by the Agency by 7th of every
following month duly pre-receipted. The security Agency will pay the wages to their workers
latest by 5th of every month.
v. Payment of wages shall be done through bank account only by electronic clearance system.
29.Sub Regional o ce, Varanasi shall not be under any obliga on for providing employment to any of
the worker of the contractor a er expiry of the contract.
30.The Deputy Director In charge, ESIC SRO VARANASI shall have the full powers to terminate
the tender process at any stage, without assigning any reason. The Deputy Director in charge’s
decision in this regard will be the nal.
31.If as a result of post payment audit any overpayment is detected in respect of any work done by the
agency under the tender, it shall be recovered from the agency by Sub Regional O ce, ESIC
Varanasi.
32.In case of any disagreement or dispute between the Sub Regional O ce ESIC and Security Agency
arising out of or due to the terms and condi ons of the contract agreement, The Deputy Director In
charge of ESIC, Sub Regional O ce, Varanasi shall have the discre on for se lement of such
disputes by appoin ng a sole arbitrator and the award so made by the arbitrator shall be nal and
biding on both the par es.
33.For this Bid, in case of Mul ple L1 o ers, Priority given will be based on Local O ce Availability and
experience of the services provided.
34.The tenderer shall not have any pending legal case against ESIC or Labour dispute against its
employees or have not been black listed. The Deputy Director In charge may reject any tender, if
there is a su cient ground to believe that the tenderer has acted in an -laborer manner in any
previous or running contracts or hiding any fact, that was required to produce.

PENALTY CLAUSE:
1.In case of any loss/the of property, The Deputy Director In charge, ESIC SRO VARANASI will
consider the circumstances leading to the loss/the and if the responsibility is xed upon the
Agency by the competent authority, the Agency will make good the loss within a speci ed
period or else deduc on of the cost will be made from the Agency’s bills of the following
month/months.
2.For Inten onal and consistent delay in payment of salary/wages shall not be tolerated by The
Deputy Director In charge, ESIC SRO VARANASI and a penalty of Rs. 1,000/- may be levied per
day for delay in payment of salary wages to engaged employees at the discre on of the
competent authority. Said penalty, if imposed, shall be deducted from the total bill.
3.The contractor shall ensure the payment of Wages disburse as per terms & condi ons of
agreement. If, it is established that contractor is exploi ng its employees by disbursing the
wages less than the prescribed, the contract shall be terminated apart from legal ac on as
deemed t.
4.If it is found that in spite of imposi on of penalty, agency is con nuing the contraven on of
Payment of Wages Act, 1936 and Contract Labour (Regula on and Prohibi on) Act, 1971
deliberately, Contract shall be terminated.
5.For that Security sta s, as de ned by Competent Authority at the me of execu on of contract,
which are required to be in posi on 24x7, if the a endance falls short of contracted minimum
number of persons, an addi onal penalty of Rs. 500 per person per day shall be deducted from
the monthly bills submi ed by the agency. The amount so deducted shall be nal and no claim
whatsoever will be entertained.
6.If the behavior of any Security sta deployed by the agency is found harsh/rude and non-
coopera ve towards pa ents/a endants/sta a penalty of Rs. 500/- per instance shall be
deducted from contractor’s bill and security sta to be removed instantly.
7.In case of any the or damage due to negligence of the security guard. The recovery of the cost
of the item/ar cle shall be recovered from the agency.
8.The competent authority may decrease, waive o or enhance the penalty prescribed in this
Clause depending on the past performance of that contractor and the decision of competent
authority shall be nal with regard to imposi on of penalty.
9.If the lapse is repeated again, the extent of penalty will be doubled on each such occasion. The
Decision of The Deputy Director In charge, ESIC SRO VARANASI in this regard shall be nal and
binding upon the Agency.

DUTIES AND RESPONSIBILITIES OF SECURITY STAFF
1. The security personnel shall watch that there are no uniden ed /unclaimed /suspicious
objects/persons in the buildings/premises.
2. The security personnel shall also ensure that all the electrical equipment/instruments/ lights
and fans must be switched o at the me of closure of the o ce or part of the o ce.
3. The security personnel should not leave the point unless and un l the reliever comes for
shi du es.
4. The security supervisor will maintain all the registers viz A endance Registers, and
visitors’ register, which are kept at the main gate.
5. To check people on entry/exit based on produc on of iden ty cards, issue of visitor passes
only a er the con rma on of concern authority/sta etc. and maintain visitor’s record.
6. Thorough checking of incoming and outgoing material against proper Gate pass duly signed
bythe authorized signatory.
7. To ensure that no hawkers, marke ng persons or vendors are allowed into the campus
without permission. For the said persons monthly pass shall be issued by ESIC authority
subject to receipt of request/applica on from the concern sta .
8. The security personnel must have the telephone numbers of the nearest Police Sta on, Fire
Sta on, Ambulance, etc. for the sake of emergency if any.
9. The Agency shall have to provide the Mobile Phone Nos. of all the security guards for
records.
DISPUTE SETTLEMENT:
It is mutually agreed that all di erences and disputes arising out of or in connec on with this
Agreement shall be se led by mutual discussions and nego a ons if such disputes and di erences
cannot be se led and resolved by discussions and nego a ons then the same shall be referred to
the Sole Arbitrator appointed by the Deputy Director In charge, ESIC SRO VARANASI whose
decision shall be nal and binding on both the par es.
ESIC is a statutory autonomous body under Ministry Labour of Employment, Govt. of India and
accordingly all no ca ons order/guidelines of Govt of India/ESIC as applicable, shall also be a
part of this tender /Contract as and when made mandatory.
JURISDICTION:
The disputes, legal ma ers, court ma ers, if any shall be subject to Courts at Varanasi U.P
jurisdic on only.
