14. ‘B’ owes ‘B’ owes to ‘C’ a debt guaranteed by ‘A’. The debt becomes payable. ‘C’ made some
attempts to recover money from B but felt it will be easy for him to recover from ‘A’ and he
instituted legal action against ‘A’. What will be the liability of A. Decide?
15. ‘A’ allowed his car to be taken away by ‘B’ to show it to a potential customer. ‘B’ used the car for a
week and then sold it to the ‘C’. ‘A’ claimed the car from ‘C’. ‘C’ claimed estoppels against ‘A’.
Decide.
16. ‘X’ finds a golden ring and makes reasonable efforts to discover the true owner, but could not
find him. Later, the finder ‘X’ sells it to ‘Y’ who buys it without knowledge that the ‘X’ was
merely f finder. Can the true owner recover the ring from ‘Y’?
17. A, B and C are partners in a firm. ‘C’ retris and ‘D’ is admitted as a new partner. No public notice
of the change is given but the firm continues its business in its old name. ‘M’ a customer of the
firm, deals with the firm becomes indebted to ‘M’ sues A, B,C and D to recover his dues, will he
succeed. Decide.

15. ‘X’ an editor of a newspaper published a statement of an M.L.A. in the course of business of
the House in the morning session. In the evening session, the statement is expunged by the
speaker of the legislative. House. Whether the editor was guilty for such publication
statement or not. Decide.
16. National Emergency was imposed and all the fundamental right were suspended by
Presidential Declaration. A civil liberties activist approached the High Court for violation of
his right to life and personal liberty. Decide.
17. By means of an Amendment to the Constitution the election disputes of the Prime minister
and Speaker were kept beyond the scope of the courts and judicial scrutiny. Examine the
validity of such an Amendment.

others suffered severe health deisorders. Public Interest Litigation is filled against the
industry. Decide.
15. Ramesh purchased a nano car from Tata Company. The car was emitting smoke and the Road
Transport Authorities refused to give Pollution under Control Certificate to Ramesh. Ramesh
filed a case in Consumer Forum asking for replacement of the car-----Decide.
16. The Government had given permission for the construction of a thermal power plant near a
monumental site. The local non-governmental organization objected to the permission on the
ground of destruction to monumental site. Decide.
17. A mining Company ‘M’ limited, obtained a mining lease from the Government of A.P. In 1972
for a period of 30 years. The lease is for mining “bauxite” from a forest land. The state
Government renewed the contract in 2002 for a term of ten years. Is this valid?

reservoir owned by the State. This happened due to the negligence of State Authorities in
leaving the construction incomplete. Plaintiff brought an action against the State. Decide
15. A Military truck carrying ammunition through a school Zone knocked down a student
crossing the road. The military authorities are sued by the parent of the deceased student for
compensation on the ground of negligent driving—discuss the liability issues?
16. Parliament enacts a law making Hindi as compulsory and official language for all transactions
and prohibits use of Telugu and other languages in the schools, government offices ect.
Discuss the validity of law and elaborate on the limitations of legislative authority of
parliament.
17. The Union legislature wants to pass a law conferring unbridled authority on the Prime
Minister to appoint judges of the Supreme Court without laying down any procedure. This
law is challenged as violating the basic structure of the Constitution—discusses the validity of
such a Law.

15. “L” the Chief Commissioner of Income Tax, refused permission to produce fresh evidence
before him, on the ground that he was an appellate authority, thus, no evidence is allowed at
this stage. Discuss the action of ‘L’, in the light of decided cases.
16. “S” the son of a UPSC member appeared for the interview before the Committee Consisting of
his father also. However, when ‘S’ was called for interview, his father, a member of the
committee was absent from the Panel of the committee. ‘S’ was appointed on merits’’ who
could not be successful, challenged the appointment of ‘S'. Argue?
17. The State Excise Act empowered the State Government to fix the rate of excise duty. It also
empowered the Government to make rules. Both the provisions were challenged on the
ground of excessive delegation of legislative power. Decide.
