RE EXPORT BOND

Whereas M/s VSL INDIA PVT. LTD 36, Annai Indra Nagar old Mahabalipuram Road
Thuraipakkam Chennai Tamil Nadu 600096.India (Hereinafter referred as the Importer)
which expression shall include its successors/heirs, executors, administrators, and legal
representatives has received containers of strand lifting unit from M/s. VSL
SINGAPORE PTE LTD (herinafter referred to as Supplier)

WHEREAS THE importer has received lifting unit under invoice no.
296.2241-01/VSLSI/10/08 dated 07/10/2008 under order no. on
returnable basis.

Whereas the goods have arrived and the importer is seeking the duty free custom
clearance of the inputs under customs Notification No 27/02 Dated 01/03/2002 as
amended by Notification No.27/08 Dated 01/03/08
NOW THIS BOND WITNESSES AS FOLLOWS

1. The aforesaid consignment vide B/E NO-244879 dt.-10.10.2008 has been


imported by the importer from the supplier of the lifting unit.
2. That the importer shall Re-Export the goods within the period prescribed in
the custom notification referred above 6 months but before 9 months.
3. That the importer undertakes to observe, adheres and to comply with the terms
and conditions of the custom notification No.27/02 dated 01/03/2005 as
amended by Notification No. 27/08 dated 01/03/2008
rules/Order/notifications made there under:
4. The Bond Shall remain valid till the finalization of the matter from the date
hereof and the obligation and liability of the importer shall be continuing one
in respect of all goods imported from time to time by the importer between the
period.
5. That at the time of the export a clear mention shall be made on the shipping
Bills that the exports are under Notification No.27/02 dated 01/03/2005 as
amended by Notification No. 27/08 dated 01/03/2008
6. That in the event of default by the importer to perform its export obligation or
of any other condition of the this bond, the importer shall be liable to pay to
the Govt/Custom authorities the amount of Rs.1348803/-. (Duty Amount for
Assessable Value Rs.5433188/-.) together with interest leviable as per
customs Act 1962 and the export policy.
7. That the importer undertakes that in the event of non fulfillment of the export
obligation, the importer shall upon instructions of the Govt., hand over the
imported goods in subject to the custom authorities or to any other agency
nominated by them, for disposal in any manner and the amounts so realized
may be appropriated by the Govt., towards fulfillment of the export obligation
payment of customs duty, fine, penalty, and the expenses incurred by the
agency.
8. That the payment of the amount demanded by the Govt. under this bond for
failure to comply with any of the terms and conditions of this bond will not
affect the liability of the importer to any other action including the initiation
of legal proceedings for confiscation of the imported material and other
penalties liabilities and consequences and recover sub section 1 of section 142
under the provisions of the Custom Act 1962 and the Foreign Trade
Development and regulation) Act, 1962 and orders and rules made thereunder
or under any other law of the land that may be applicable.
9. That the importer irrevocably undertakes to secure the performance of export
obligation and other terms and condition under this bond by execution of a
bank guarantee for an amount and in the manner to the custom authorities.
