Skills for Academic Writing: Assignment 1

“Explain the role of the Law Commission”


Task 1
a) The purpose of my extended writing piece is to analyse and discuss the role
of the law commission. My writing will contain debates regarding the
effectiveness of law commission and how it shaped the laws in the UK. The
audience for my writing is for the general public interested in how the Law
Commission reviews laws in England and Wales the impact on changing
them.
b) One of the most important key features of an academic writing is the structure
as it allows the readers to understand the ideas written in a clean way. A
structured academic essay should include an introduction, main body and a
conclusion. The introduction will set out the structure, in the main body will
contain organised, analysed paragraphs, and the conclusion should
summarise the key points and answer the essay question. The paragraphs
should be planned by using a PEEL format. Another key feature is the writing
style. The style should be formal as it would be understood similarly by any
reader. The writing should also be precise so that the reader understands the
information written. In order to present a structured and academic writing, it
should include a correct use of grammar. Correct grammar also had a
significant role in making sure that everyone understands the work.
Task 2
a) Define term of plagiarism (100 words)\
“Plagiarism is defined as copying the presentation of the work or ideas from another
source or person as your own with or without the consent of the original source, by
incorporating it into your work without full acknowledgment.” It could also include
your own work without citations. Under this definition is covered all published and
unpublished material, whether in manuscript, printed or electronic form. It applies to
other types of work or ideas such as the ones in media, graphs, lectures, and even
unpublished classroom essays. Plagiarism is avoided by using referencing and
providing data found in any websites or other sources.

Explain the role of the Law Commission


In order to meet the current needs of society, an evolving legal system is necessary
to ensure that laws continue to protect rights and maintain justice. The Law
Commission in England and Wales has an important role in establishing and shaping
laws that need to be relevant and effective in order to address new challenges,
maintain fairness and reflecting social progress.
First of all, the Law Commission Act established in 1965 a statutory independent
body called The Law Commission. The commission is public, and it advises the
Government of England and Wales regarding law reform. In the Law Commission
Act, section 3 precisely, it is stated the function of the commissioners. Is the duty of
each Commission to shape laws in order for them to be simplified and modernised.
Second of all, in the Commission Act also established the way that the
commissioners work. Although they are independent and can choose what areas of
the law to improve, they also consider views from judges, general public or lawyers.
Before deciding the projects, they have a certain criteria which is used to select new
projects.
Each commissioner covers a certain area of the law, ensuring efficiency in reviewing
particular field of the law such as that in property, trust, family, criminal, public and
the one in Wales. For example, Professor Nicholas Hopkins is the current
commissioner responsible for property, family and trust law. His efficiency is proven
in they way he handles multiple, complex legal areas in an efficient way over his
terms. Nicholas Hopkins proved his leadership skills in multiple key projects like the
Land Registration Act, charity law, family financial riders' enforcement and the reform
on marriage law.

In addition, the Commission had a variety of impacts on the diversity of society. The
law commission posted a report in 2023, where the result show that the reform had a
positive impact on providing benefits in other areas other than the legal system. For
example, one of the highest projects of the Law Commission from 2022 is
Celebrating Marriage and it has an estimated net value of 535 million pounds over
the 10 years. The projects have a massive impact on economic gains not just for the
legal system. Economy is also a crucial factor just as the legal system in providing a
developed lifestyle for the society in UK.
Moreover, A Theory of Change was presented in original report, finding that the reform would
be beneficial in themes such as wellbeing improvement and technology. In one of the case
studies, the law commission recommended a new framework regarding inmate image
abuse. The uk government’s response to the new framework was by implementing The
Online Safety Act as a law in october 2023. With the rapid raise of technology, the Law
Commission’s role in conducts research and providing modern and fair changes for the legal
system, for the Parliament and the Government to take into consideration.

Another positive impact of their work is found in the project of the Marriage Law, as they
published their recomandations in 2022. Their aim is to change the laws regarding marriage
completely in order to provide for the citizens of the UK more freedom in deciding how aware
they could get married. Additionally, by changing the legal framework regarding marriage
laws it would be beneficial to contribute to the challenge of diversity in the U.K.’s culture and
religion. It will help getting rid personal dilemmas for couples as the religious communities
will not put necessary restrictions over interfaith marriages, Moreover, in one of their reports,
they examine the potential of impacting couples wishing to marry and that is on a scale of
4.1 million over 10 years. Additionally, this will allow couples to get married in affordable
venues from a variety of locations and increased number of society’s happiness and
freedom.

The Law Commission’s reports are highly valuable for the process of legal reform. The
reports validity are shown in the fact that they conduct research based on work of experts
such as economists and consultants. For example, in the report ‘Value of Law Reform’
published in 2019, the economic benefits of the Commission’s work were effectuated by
experienced economists. The economists found that the predicted economic gains
surpassed the expected number of 3 billion pounds. The inclusion of legal professionals in
their work shows that the work and their reports are representative and has the ability to
contribute in public trust.

One of the advantages of the Law Commission is that they are independent. Their
independence it allows the commission to review and suggest improvements on existing
laws without fear of commitment or political pressure or bias. Concluding that the law
commissions aim is to ensure far laws by working independently there will be a high
credibility of their work. Citizens of the UK are more likely to trust the recommendations of a
commission that is free from government influence as they also work with legal professionals
stakeholders and most importantly, the public. the commissioners can engage with a wide
range of stakeholders without being stopped. This proves that the consultation process has
a high-quality with the help of a range of views and evidence.

In conclusion, the law is a necessity in society in order to maintain order, protect rights and
promote social change. The Law Commission ensures to review laws that could be unfair or
discriminatory, but also promoting economic stability which creates an environment hat is
conductive to economic growth and development. With the help of skilful commissioners, the
law commission also ensures that they can suggest laws which abolishes discrimination by
promoting equality and fair laws which are essential for social development.
