Katarungang Pambarangay

Katarungang Pambarangay is a community-based, out-of-court system


designed for the amicable settlement of disputes at the barangay level. It
allows residents to resolve conflicts without the intervention of lawyers,
under the guidance of the Punong Barangay .

Key Features:

1. Lupon Functions :

- Supervises conciliation panels.

- Meets monthly to discuss dispute resolution and improve conciliation


processes.

- Exercises powers and duties as prescribed by law.

2. Lupon Composition :

- Secretary : The barangay secretary serves as the Lupon’s secretary,


recording and reporting mediation proceedings.

- Pangkat ng Tagapagsundo : A three-member mediation group from the


Lupon, chosen by the disputing parties or by drawing lots.

3. Pangkat Tagapagkasundo :

- Conducts mediation when the initial efforts by the Punong Barangay fail.

- Serves as the second attempt to resolve disputes amicably.

Disputes and Offenses Covered:

- Civil disputes and minor criminal offenses (punishable by up to one year in


prison or a fine of up to ₱5,000) between residents of the same city or
municipality.
Excluded Cases:

- Involvement of government entities or public officials in the performance of


their duties.

- Serious criminal offenses exceeding the one-year imprisonment or ₱5,000


fine limit.

- Disputes involving real properties in different cities or municipalities unless


both parties agree to settlement by the Lupon.

Venue of Disputes:

- Disputes are settled in the barangay where the parties reside, where the
property is located, or where the workplace/institution is situated.

- Objections to venue must be raised during mediation.

Amicable Settlement Process:

- Initiated by either party.

- Involves mediation, suspension of prescriptive periods, and written


agreements in a language known to both parties.

- Settlements are formalized and witnessed by the Lupon or Pangkat


chairman.

When Parties Can Go to Court:

- In cases of detention, personal liberty issues, provisional remedies, or when


barred by the statute of limitations.

This system promotes local dispute resolution to avoid formal litigation,


ensuring a peaceful community.
