THE NAROK COUNTY FINANCE ACT, 2023


AN ACT of the Narok County Assembly to provide for the imposition
or variation of various charges, fees, rents and taxes and for
other revenue raising measures of the county government and for
matters incidental thereto
ENACTED by the County Assembly of Narok as follows—
PART I—PRELIMINARIES
Short title and commencement
1. This Act may be cited as the Narok County Finance Act, 2023 and
shall come into operation upon publication in the Kenya gazette.
Interpretation
2. In this Act, unless the context otherwise requires—
“County Government” means County Government of Narok;
“Authorized channel” means making payment to the County through
an officer appointed by the County to collect revenue or through any other
mode of payment as may be prescribed by the County;
“Cess” means tax or fees chargeable on goods specified under
various schedules in this Act.
“Business” means—
(a) trade, commerce or manufacture, profession, vocation or
occupation;
(b) any activity carried on by a person or entity continuously or
regularly, whether or not for gain or profit and which involves,
in part or in whole, the supply of goods or services for
consideration;
“Executive Committee Member” means the County Executive;
Committee Member for the time being responsible for matters
relating to finance in the County Government;
“County public officer” means a county public officer within the
meaning of section 2 of the County Governments Act, 2012;
“County Receiver of Revenue” means the persons appointed pursuant
to section 157 of the Public Finance Management Act, 2012;
“County Revenue Collector” means the county public officer
appointed pursuant to section 158 of the Public Finance Management Act,
2012 for the purpose of collecting revenue for the County Government
and remitting it to the County Receiver of Revenue;

“License” shall refer to authorization for any person to conduct a


particular business or line of business within a certain jurisdiction within a
County;
“Permit” shall refer to license granted or issued by County
government of Narok to any business operating within Narok County;
“Person” shall mean a natural or juristic person;
“Property rates” means the actual amount of money to be paid by a
rateable owner as tax on their property based on valuation and area;
“Park entry fees” –An amount charged for entry into Maasai Mara
from (6.00am – 6.00pm) time of entry notwithstanding;
“High Season” –1st of July to 31st December;
“Low Season” –1st of January to 30th of June”;
“Property rates” means the actual amount of money levied on rate
payer on their property based on valuation and area. As long as the
property is a running concern notwithstanding whether the land is a lease
or freehold;
“Rateable Property”: Includes lands, except
i. Any land used for roads, streets (private streets, public car parks,
public squares and public open and closed spaces means a Cent amount in
the Rand levied on the market value of immovable property (that is, land
and buildings).
“Zoning”
(1) Zoning refers to categorizing fees and charges according to the
business geographical location and economic potential.
(2) For effective collection of own source revenue, the county will
have three zones; Zone A, Zone B and Zone C.
Zoning will apply under the following categories of fees and
charges—
(a) Single Business Permit;
(b) Liquor Licenses;
(c) Property Rates, Housing and Stall Rent.
“Zone A” Highly economically viable Areas (includes all towns and
areas including Narok Municipality, Kilgoris Municipality, Ewuaso Ngiro,
Ololulunga, Suswa, Enairagia Ngare, Ntulele, Lolgorian, , Emurua Dikirr,
Sekenani, Talek, and Masai Mara National Reserve);

“Zone B” Medium economically viable Areas (includes all towns and


areas excluding all towns and areas within these areas comprising Zone
A);
“Zone C” Lower economically viable Areas (includes all small
centres in villages).
Object and purpose of the Act
3. This Act seeks to prescribe the rates of taxes, fees and charges
from properties which include tourism, land and buildings, businesses,
markets, agricultural produce, outdoor advertisement, health services,
vehicle parking, heritage sites, County parks, entertainment and mining
and extraction activities.
PART II—TAXES, GENERAL FEES AND CHARGES PAYABLE
AND RATES APPLICABLE
Imposition, revision of taxes, rates, fees and charges
4. (1) The fees, charges, rents and taxes provided in the Schedules
herein shall be charged for the respective services.
(2) The taxes, charges, fees and rates applicable under (1) above shall
be based on the economic zones listed under section 2 above.
(3) A person shall not carry out any business or service within the
County without a valid licence or permit issued by the relevant County
office.
(4) A person who intends to carry out any of the businesses listed in
the or under the schedule or the single business permit regulation shall
apply for a licence or permit from any of the County offices or such other
designated agents as shall be prescribed by the County Government from
time to time.
(5) A person who applies for licence under subsection (4) shall be
issued with a licence on the payment of the applicable fee, depending on
the location and size of the business as specified in the schedule or the
single business permit regulation.
(6) Licences and permits issued under subsection (5) must be visibly
displayed at the business premise at all times.
(7)   The County Government shall issue official receipt upon
payment of the prescribed fee and thereafter grant the relevant Permit or
license to the applicant.
(8)   A license, permit or receipt issued shall be visibly displayed at
the business premises at all times and or produced on request by an
authorized county public officer.

(9)   For greater certainty, the taxes, fees and charges applicable, but
which are not included in the schedule to this Act, shall continue to apply
under other existing legislations of County Government of Narok.
(10)  A person who contravenes any of the provisions of this section
commits an offence under this Act.
Waivers and variations
5. The County Executive Committee Member in charge of finance
may exempt, waive or vary tax, fees or charges payable under this Act in
accordance to section 159 of the Public Finance Management Act and
prescribed in regulations.
Directions, resolutions made under provisions of Local Government
Act
6. (1) All directions, resolutions, orders and authorizations relating to
financial management including the collection and administration of taxes,
fees and charges given or issued by the defunct County Council of Narok,
County Council of Transmara and Town Council of Narok and subsisting
or valid immediately before the cessation of the application of the Local
Government Act (Cap. 265) shall be deemed to have been given, issued or
made by or under the authority of the county assembly until the expiry or
repeal of those directions, resolutions, orders and authorizations on
financial management and shall continue, with the necessary
modifications, apply to the payment and the administration of the taxes,
fees, charges and other levies under this Act.
(2) The provisions of section (6) do not apply to the specific
respective amounts payable in respect of taxes, fees, charges or other
levies provided for under Schedule V of this Act.
Repeal of County Government Public Finance Management Act,
transitional and savings provisions
7. (1) Notwithstanding the repeal of the County Government Public
Finance Management Act 2013, the provisions of that Act shall remain in
force and effect for purposes of the assessment and collection of any tax
and the recovery of any penalty, payable under the Act and outstanding at
the date upon which such repeal becomes effective.
(2) Any subsidiary legislation made under the repealed Act in force at
the commencement of this Act shall remain in force, so far as it is not
inconsistent with this Act, until subsidiary legislation with respect to the
same matter is made under this Act.

Payments to the County Government


8. (1) All payments to the County Government made under this Act
shall be paid through an authorized channel which include, direct deposits
through the County revenue accounts and electronic channels.
(2) A County Revenue Collector authorized by the County
Government to collect revenue shall have an identification card issued by
the County Government which shall be worn visibly by such County
Revenue Collector.
(3) An official receipt shall be issued for all payments made to the
County Government.
(4) Every person who makes a payment through an authorized
channel shall demand an official receipt for each such payment and every
payment made through an authorized channel shall be evidenced by an
official receipt.
(5) A person shall not receive or collect any money on behalf of the
County Government unless he or she has been appointed to do so or has
authority as the receiver and collector of County Government Revenue.
(6) A person who contravenes the provisions of this section commits
an offence.
Appointment and duties of an agent
9. (1) The County Executive Committee Member may by written
notice addressed to any person—
(a) appoint any person to be an agent of the County Government for
the purposes of the collection or recovery of charges, permit
fees, licence fees, rent, cess and such other fees, as may be
necessary for carrying out the purposes of this Act; and
(b) Specify the amount of charges, permit fees, licence fees, rent,
cess and such other fees to be collected or recovered by the
agent.
(2) An agent appointed under this section shall enforce and ensure
due compliance with the provisions of this Act and shall remit all revenue
collected to the County Government through the County Receiver of
Revenue or as may be otherwise instructed in the appointment notice.
(3) Where an agent claims to be, or to have become unable to comply
with subsection (2), such shall, within seven working days, notify the
County Executive Committee Member in writing, setting out fully the
reasons for his inability to comply, and the County Executive Committee

Member shall accept the notification and cancel/amend the appointment


notice accordingly.
(4) Unless and until a notification is given by an agent under
subsection (3), sufficient moneys for the payment of charges, permit fees,
licence fees, rent, cess and such other fees specified in the agent's
appointment notice shall be presumed to be held by him and this money
shall be due and payable to the County Government.
(5) For the purposes of this section, the County Executive Committee
Member may, by notice in writing, at any time, require any person to
furnish him or her, within reasonable time not being less than seven days
from the date of service of the notice, with information showing any
moneys which may be held by the agent for, or due by him to the County
Government.
(6) Where an agent fails to remit an amount of money collected under
this section within the time specified in the notice, the provisions of this
Act relating to the collection and recovery of tax shall apply to the
collection and recovery of that amount as if it were tax due and payable by
the agent, the due date for the remittance of which was the date upon
which that amount should have been remitted to the County Government
under this subsection.
(7) An agent who makes a remittance to the County Government
under this section shall for all purposes be deemed to have acted under the
authority of the County Government and shall be indemnified in respect of
that payment against all proceedings, civil or criminal, and all processes,
judicial or extra-judicial, notwithstanding any provisions to the contrary in
any written law, contract or agreement.
(8) Any person who makes any false or misleading statement, or
willfully conceals any material fact shall be guilty of an offence.
PART III — FINES AND PENALTIES
Penalties on Outstanding rates for property tax
10. Penalties on outstanding rates for property tax are levied as
under:
(a) Penalties shall be levied in respect of property having total
outstanding rates at the turn of the calendar year;
(b) The amount of tax computed shall be increased by penalty
calculated at 3 per cent compounded per month;
(c) The County Executive Committee Member for Finance and
Economic planning may waive the penalty imposed under this
section subject to Article 210 of the Constitution of Kenya 2010.

Penalties on outstanding house rent


11. A surcharge shall be levied for rental default at a cumulative rate
of 2 % per month.
Other penalties on outstanding business permits
12. (1) The penalty payable shall be the amount of license increased
by a penalty calculated at 3 per cent compounded per month with effect
from 1st April of every calendar year.
General penalty
13. A person who commits an offence under this Act for which no
penalty is provided shall be liable on conviction to a fine not exceeding
Ten Thousand Kenya Shillings or to imprisonment for a term not
exceeding six months or both.
Offences by staff of the County
14. A member of staff of the County government or any other
person having a duty to perform under this Act who—
(a) makes, in any record, or document required to be kept or made
by that person, an entry which he or she knows or has
reasonable cause to believe not to be true or to be false;
(b) Willfully refuses to do anything which he or she knows or has
reasonable cause to know is required to be done;
(c) interferes with any other person or process under this Act, so as
to defeat the provisions, requirements or purposes of this Act;
(d) Where required under this Act to do anything to give effect to
the provisions of this Act, fails to do such thing;
(e) Without reasonable cause omits to do something in breach of his
or her duty under this Act;
(f) Willfully contravenes the provisions of this Act to give undue
advantage or favour to another person;
(g) Fails to prevent or report to the County Government or any other
relevant authority, the commission of an offence committed
under this Act;
Commits an offence and is liable on conviction, to a fine of
three hundred thousand shillings (KSh. 300,000 or 30% of the
sum lost whichever is higher) or to imprisonment for a term not
exceeding six months, or both.

Cancellation or suspension of a license or Permit


15. (1) The licensing authority may cancel or suspend a business or
trade license granted under this Act if satisfied that—
(a) the conduct of the business is endangering the health or safety of
persons who live or work in the neighborhood of the premises
from which the business is conducted; or
(b) the holder of the trade license has breached a condition of the
license.
Provided that the licensing authority shall give the holder of a
trade license notice not exceeding fourteen days of its intended
cancellation or suspension within which the holder of the license
may make representation to the licensing authority.
(2) Where the authority cancels or suspends a license, the licensing
authority shall give the holder of the license a written notice of the
cancellation, suspension or revocation, together with a statement of the
reasons for the decision.
(3) Upon the lapse of the fourteen day notices under subsection (2)
above, the suspension, cancellation or revocation of the license shall
commence.
(4) Upon the suspension, cancellation or revocation of a trade license,
the holder thereof shall immediately cease to conduct business which
would have been suspended or cancelled.
(5) If the licensing authority lifts the suspension, cancellation or
revocation of a license, the holder of the license shall be at liberty to
resume the business in respect thereof upon compliance with the
requirements of issuing the license.
(6) where a license or a permit is cancelled, the amounts paid for the
license or permit is forfeited.
PART IV—MISCELLANEOUS PROVISIONS
Measures to prevent non – remittance of collected revenue
16. In order to ensure all revenue is remitted, the County Executive
Committee Member responsible for Finance will issue directive—
(a)   To make use of modern technology for collection and
monitoring cash receipts;
(b)   Digitalize all county mutations to allow prompt management of
property liable to property tax;
(c)   To conduct county wide survey to establish revenue potential;

(d)   To put proper measures in place to prevent loss of revenue


including recruitment of staff, training, surprise checks and
visits to markets;
(e)   To make use of enforcement efforts, where necessary.
Amendment to schedules
17. (1) The County Executive Committee Member for Finance and
Economic Planning may by order published in the gazette amend any of
the schedules.
(2)   bAny order made under sub section (1) shall be laid before the
County Assembly without unreasonable delay, and unless a resolution
approving the order is passed by the County Assembly within the next
twenty one days on which it next sits after the order is so laid, the order
shall lapse but without prejudice to anything previously done there under.
Regulations
18. The County Executive Committee Member for Finance and
Economic Planning may make regulations for the better carrying out of
the purposes and provisions of this Act.

13. Additional charges payable where a weighing or measuring 400 400
instrument incorporate a printing device which is also examined and
tested.
14. Where a weighing or measuring instrument incorporates a
printing device which is also examined and tested, an additional 400 400
charge of Kshs. 400 shall be payable for the examination and testing
of the device.
15. Where a weighing instrument incorporates more that one
indicating device, an additional fee equivalent to the stamping fee
payable for the instrument shall be charged for the examination and
testing of each such device.
16. Where a weighing instrument has two sets of graduations (as in
the case with some milk weighers,) separate fees shall be charged for
each set of graduations according to the capacity of the instrument.
17. Where a weighing or measuring instrument is constructed to 400 400
calculate and indicate the price, an additional fee of Ksh. 400 shall be
payable for the examination and testing of the price indicating
mechanism

2. Handling Charges:
The charges payable for lifting roller and block test weights for the
purpose of either loading/offloading them into a vehicle or placing
them onto the load receptor of the weighing instrument under test
shall be as follows—
(a) Loading/off loading weights into a vehicle,
KSh. 500 per tone or KSh. 4000 per day whichever is the greater;
(b) Placing weights on or off the load receptor of
an instrument KSh. 500 per hour or part thereof.
3. Hire of roller and block test weights.
For every tone or part thereof (per day)
(i) For the first three days (minimum period)... 500
(ii) Any additional days beyond the minimum period 750
4. Hire of other weighing equipment:
(i) Weighbridge testing unit; KSh. 10,000 per hour.

PART 5—TRAVELLING COSTS
The amount payable when an officer, on application or notification
by any person, attends at any place away from his duty station for the
purpose of verification of any weighing or measuring equipment
shall be as follows-
