(REGULATION OF PROMOTION, PAY AND
PENSION) ACT, 1973.

An Act to provfde for the prospective promotions of


civil servants, and to regulate the pay, seniority, pension
and other conditions of service of civil servants in rhe
State of Karnataka including those that are allotted or
deemed to be allotted to serve in connection wirh the
affairs of the State of Karnataka under or in pursuance of
section 115 of the States Reorganisation Act, 1956 ;

Whereas on the basis of the ranking of civil servants


in' the several inter.State seniority lists prepared in pur-
suance of sub.section (5) of section 115 of the States
Reorganisation Act, 1956 (Central Act 37 of 1956), courls
have directed the making of retrospective promotions to
statutory and other offi.ces ;
And whereas as held by the Suprerne Court in Ajit
Singh Vs. State of Punjab, ieported in all India Reporrer
1967, Supreme Court 856 and in Incorne-Tax Officer,
Alleppy Vs. N.C. Ponnoose, reoorr,ed in All India Reporter
1970, Supreme Coun 385 appoint{nents cf civil servants
to offices in which statutory functions are exerciseable
cannot be made with retrospective effect ;

And whereas retrospective promotions involve pay-


ment of' large sums qf money to persons rvho have not

worked in the prornotional posts of officers concerned, to
the detriment of the finances of the State, besides
involving retrospective reversions rendering invalid the
statutory functions discharged tUe persons reverted ;

And whereas retrospecti've promotions preclude the
determination of the suitability of, the civil servants to
liolci ih.e promotional posis or offices and will enablo them
t'o continue in such postF'or offices only on the ground of
i!rci;' ciiilitlility !q llriilrotions, rc$ulting in tirc continu-
ance oi evcn un$uitable civil servants in promotional posts
or oilices to the tictrimcnt of publio intcrcst;

And whereas it is oecessary and expedient to


provide against the said consequences ;

' And whereas the Central Government has given


previous approval under the proviso to sub-section (7)
bf section -l 15 of the States Reorganisation Act, 1956
(Central Act 37 of 1956) communicated in letter No.
57SlZ:-Sn1S1 dated 22nd February 1973_of the Govern-
ment of hidia, Cabinet Secretariat, Department of
Personnel and Administrative Reforms ;

Be it enacted by the Karnataka Legislature in t&e


Twenty-fourth Year of the Republic of India as follows:-

l. Short title and commencement.-(l) This Act


may be called the Karnataka State.Civil^ Ser-v199s (Regu'
lati-on of Promotion, Pay and Pension) Act, 1973.

(2t This section and sections 2,415,,617,^8,9, 10


and sei:tion 12 shall be deemed to have come into force on
the first day of November 1956, and the remainiug
sections shall come into lbrce at once.

2. Definitions.-In this Act unless the context


otherwise requiresr-

(a) ''allottee' means a Government servant allotted or
deenieit to have been allotted to serve in connection with
the affairs of the State of Karnataka under or in pursuance
of section 115 of the States Reorganisation Act' 1956
(Central Act 37 of 1956) i ,

(b)
'civil servant' means a person who ts a member
of civii service of the State of Karnataka or who holds a
civit post under the State of Karnataka and includes an
allottce ;

(c)
'final seniority list' nrcans.an intcr'litate seniority
list bi'allottees prepared in atccordancc with thc dccisigtts
of Central Government under the provisions of sub-
section (5) of section 115 of the States Reorganisation
Aot, 1956'(Central Act37 of 1956);
(d) 'inter-State
seniority list' means an inter'Stal'e
senioiily list prepared fiom time to time, on the basis of
the seniority in which the eligibility oj'. an allottee to
promotion tb higher post or posts is considered ;
(e) 'rules of recruitment' means the rules of recruit-
menirirade in respect of recruitment to any service, post'
office or class of Posts or offices.

3. Promotions, etc., of civil servants.-(l) No


civil servant shall,-

(2\ In matters not specified in sub-section {l)' the
pro'iisions contained in sections 4, 5, 6, 7 and 8 shall,

4. Promotionsr etc.r of allottees.-(l) prwisional

(3) Where consequent upon the revierv -of pronro-


tions made under sub.section (l), it is found ihat an

ll and 13 had beenpromoted to a higher class or gracle

be entitled to initial pay on the date of'actual promotion

or grade of service, but he shall not be entitled to pay-

his actual promotion. His rank in the seniority list of
the persons in the said cluss or grade shall be fixed as if
he had been promoted on th9 date immediately preceding
the date on which his immdiate junior in the lorver class
or grade was promorted to the selection class or grade of
sefvlce.

(9) An order under srrb-section (2) in respect of' arr


allottee who had been reduced to a lower stagc in a tims
scale and whose increment had been rvithhcJd shall be
subject to such modification as the State Governme nt may,
by order direct.
(10) No promotions c'allottees made on the basis of
any provisional inter-State seniority list, shall be reviewed
except after the publicatior of thc final seniority list and
in the manner provided in this section.

seniority list used as the basis for carrying on the .lay-to-.

5. Provision relating to reversion of allottees.-


(l) Where consequent upon the revicw of promotions
under section 4 any allottce promoted to any class of'

9. Officiation.-(l) Save as provided in sub-secti.on

t[9A. Rules.-(l) The State Government may make
rules to carry out the purposes of this Act.

(2) Every rule made under this Act shall be laid as


soon as may be after it rs made before each House of the
S.tate I,egislature while it is in session tbr a total period of
thirty days which may be compriserJ in one session or in
two or more successlve sessions and if before the expiry
oi the session immediately following the session or the
successive sessions aforesaid both Houses agree in making
a-ny modification in the rule or both Hoises agree thal
the rule should not^be made, the rule shall, from-the date
on which the modification or annulment is notified by the
Government in the Official Cazette, have effect oniy in
such modified fornr or be of no effect, as the' case may
be; so ho*ever, that any such modification or annulment
shall be without prejudice to rhe valitlity of anything
previously done under such rule.]

10. Removal of di{Ecutties.-If any diftieulry arises


rl the applicarion of this Act to anf case, the State
Uovernment may_nrake such orders as nray be Jreccssary
tor the purpose of'removing the difficulty.
ll. Over-riding eflect.-(l) The provisions of this
Act or of any order made thtireunddr shall have effect

under the proviso to Articie 309 of tlie Constitution of
India for the time being in fnrce or any provision regu-
lating the conditions of se.vice of any allottee or in any
order made by virtuc of any such law, rulcs or_pr<.rvisioni.

(2) Notwithstanding a{y-thing contained in any judg-


msnt, decree or order of **y'court or ol.her competent
authority thc rights to which a civil servant is entitled to
in respect oi matters to which the provisions of this Act
are applicable, shall be determined in accordance with
the provisions of this Act, a:"'i. accordingly, any jucigment,
decree or order directing prrmotion or consideiation for
promotion of civil servanri and payment of salaries and
:allowances consequent uprn such promotion sirall be
reviewed and orders made ;n accordance with the provi,
sions of this Act.

12. Repeal.-The Kr, -rataka Stat* Civil Services


(Allottees) (Special) Rules, .971are hereby repealed.

in this Act shall be deemed to affect the operation of the
provisions of the Constitution of India in relation to the
determination of the condition of serviee of persons
serving in connection with the affairs of the Siate of
Karnataka.
