The policies, laws, conventions, and practices of IP enforcement are underscored by the
emerging technology markets of the 21st century. With the advent of technologies such
as the Internet of Things (IoT), Machine Learning and the evolution of Artificial Intelligence
the field of IP too has undergone a sea change in the last two decades. The developments
in the Indian IP regime have been fast-paced and dynamic keeping in line with the
associated technological advances. At the international level, knowledge-based
economies driven by information have transcended tangible and conventional
boundaries of property and the legal mechanisms to protect and enforce proprietary
rights. Since such technological growth holds the key to the future, it is imperative that the
legal system be dynamic enough to address the needs of the changing technological
environment. It becomes even more important for legal professionals to train and upskill
to be able to meet the novel and complex IP and technology-related issues and
challenges.
The LL.M. in Intellectual Property & Technology Laws has been designed to provide such
training through a focus on multidimensional aspects of IP law, tech law, policy, and
enforcement. The program covers a wide range of advanced topics such as the interplay
of IP with Cyber Laws, Patents, and Healthcare, Domain Names, Liability of Intermediaries
under the Indian IT Act, Artificial Intelligence, Blockchain, Biotechnology, 3D printing, and
Virtual Reality. The course will also cover interdisciplinary perspectives in the context of
Data Protection and Investment Law, for a holistic approach to the study and practice of
IP and Technology Laws

different legal systems and in the context of certain chosen domains of transnational
law, namely trade law, investment law, food safety law, and insolvency law.

COMPARATIVE PUBLIC LAW
You will be able to apply techniques of investigation and inquiry to real issues of
corporate practice, which typically involve interaction with the public law.

ADVANCED IPR AND IT LAW
This advanced course on Intellectual Property and Cyber Laws is built on the
foundations of IPR taught as part of the undergraduate program. This course will delve
into different perspectives of intellectual property rights and concerns of the
developing countries in relation to international transfer of technology. The course
aims to provide participants an insight into the intellectual property issues in the
digital medium. It explores trademark concerns in cyberspace that take the form of
domain names and the disputes arising from such concerns. The liability of service
providers under the Information Technology Act will also be in this context.

INTELLECTUAL PROPERTY AND
NEW TECHNOLOGY, AI
In this course you will study about the nature of IP Law in the context of new
technologies. You will learn about the theoretical complexities created in IP law and

positions across jurisdictions and larger socio-economic implications of these
changes.

GDPR: A EUROPEAN EXAMPLE
OF DATA PROTECTION LAW
General Data Protection Regulation or GDPR is a robust data protection law across
varied jurisdictions. In this course, you will learn in greater detail about the nuances
concerning GDPR and what it is likely to entail for those engaged in the processing
of personal data. The use of case studies and judgments pronounced by the Court
of Justice of the European Union will help understand the objectives that the GDPR
intends to fulfill.

INTERNATIONAL INVESTMENT LAW
AND INTELLECTUAL PROPERTY
Under international law, there are several treaties that protect IP. However, in recent
years, Bilateral Investment Treaties (BITs) and investment chapters in Free Trade
Agreements (FTAs) - the most important source of international investment law (IIL) -
have emerged as important instruments for the protection of IP because these
treaties recognize IP as a protected investment. Through the investor-State Dispute
Settlement (ISDS) mechanism, these treaties empower foreign investors to sue the
host State’s for their IP-related regulatory measures as treaty breaches. This course
would study the interactions and interrelations between the IIL regime and IP.

TRIPS AND PUBLIC HEALTH
Public health has taken center stage in international law and policymaking in the era
of COVID-19. This course will offer a window into the interrelation between
intellectual property and globalization in context of the long running theme of global
public health. The course mainly focuses upon how international legal rules and
arrangements regarding IPRs, especially since the beginning of the TRIPS-era, have
been crucial in constituting frameworks for managing this important aspect of our
globalized society. To achieve this, the course will provide a bird’s eye view of the
process of globalization in the public health related IP regime covering the major
legal, political, and historical aspects. The course would also incorporate relevant
discussion on the contemporary issues related to IP and Covid-19 pandemic.
