Blended Learning Program
The concept of Intellectual Property (IP) Law has evolved with the development of our
legal system. It ensures the enforcement of proprietary rights arising out of intangible
assets and technological innovation in contemporary times. The international
development of IP law has been marked by the enactment of national and international
laws, conventions, and treaties for the global protection of IP in an increasingly connected
and inter-dependent global business landscape. India has been a member of the World
Intellectual Property Organization since 1975 and signed the TRIPS Agreement in 1994 to
align its IP law regime with international standards. The increasing alignment of the Indian
legal system with the international standards for enforcement of IP can be further
demonstrated by the adoption of a National Intellectual Property Rights (IPR) Policy in
2016, setting the roadmap to promote creative and innovative enterprises.

The policies, laws, conventions, and practices of IP enforcement are underscored by the
emerging technology markets of the 21st century. With the advent of technologies such
as the Internet of Things (IoT), Machine Learning and the evolution of Artificial Intelligence
the field of IP too has undergone a sea change in the last two decades. The developments
in the Indian IP regime have been fast-paced and dynamic keeping in line with the
associated technological advances. At the international level, knowledge-based
economies driven by information have transcended tangible and conventional
boundaries of property and the legal mechanisms to protect and enforce proprietary
rights. Since such technological growth holds the key to the future, it is imperative that the
legal system be dynamic enough to address the needs of the changing technological
environment. It becomes even more important for legal professionals to train and upskill
to be able to meet the novel and complex IP and technology-related issues and
challenges.

The LL.M. in Intellectual Property & Technology Laws has been designed to provide such
training through a focus on multidimensional aspects of IP law, tech law, policy, and
enforcement. The program covers a wide range of advanced topics such as the interplay
of IP with Cyber Laws, Patents, and Healthcare, Domain Names, Liability of Intermediaries
under the Indian IT Act, Artificial Intelligence, Blockchain, Biotechnology, 3D printing, and
Virtual Reality. The course will also cover interdisciplinary perspectives in the context of
Data Protection and Investment Law, for a holistic approach to the study and practice of
IP and Technology Laws

In the post-pandemic world of intangibles, where courtrooms and other legal spaces have
moved to internet-based infrastructure, the blended mode of the program will enable
students to better adapt to the changing workspace ecosystem. It will also help to analyze
the legal foundations upon which such ecosystem exists and flourishes. It is in this context
that the LL.M. in Intellectual Property & Technology Laws becomes an essential upgrade
to the knowledge base and expertise of any legal professionals.

Students enrolled in the program will master not only the fundamental principles of IP

technology, comparative study of IP legislations across jurisdictions, issues concerning
data regulation, and the socio-economic impact of IP and technology on emerging
markets. The program will examine the interplay between IP and new technologies, to
allow legal practitioners to comprehend the nuances of the Indian IP regime within the
global context, with the aim of formulating effective legal strategies for individuals, legal
entities, and corporate conglomerates.

The rich industry and research experience of JGLS faculty members will provide
students in the program with strong foundations in IP law, critical reasoning skills, and
the adaptability required to apply conventional rules to un-conventional practices. Each
course has been curated to equip legal professionals with the appropriate tools for
creating, managing, and enforcing IP strategies in domestic and international matters.

Through the blended mode of delivering the program, students will be given a fresh
perspective to the changing dimensions of technology and its regulations. Be it a public
policy manager of an OTT platform, a pharmaceutical patent attorney or a legal
researcher, this program will open doors to new avenues for career growth, in the form

This advanced course on Intellectual Property and Cyber Laws is built on the
foundations of IPR taught as part of the undergraduate program. This course will delve
into different perspectives of intellectual property rights and concerns of the
developing countries in relation to international transfer of technology. The course
aims to provide participants an insight into the intellectual property issues in the
digital medium. It explores trademark concerns in cyberspace that take the form of
domain names and the disputes arising from such concerns. The liability of service
providers under the Information Technology Act will also be in this context.

General Data Protection Regulation or GDPR is a robust data protection law across
varied jurisdictions. In this course, you will learn in greater detail about the nuances

MUSIC AND COPYRIGHTS


This course seeks to provide a thorough understanding of copyright law in musical
works. It introduces students to the economic analysis of the music industry and the
justifications for copyright in musical works. It enables students to understand the
different rights that the owners of musical works can exercise and the possible ways
through which revenues can be maximized. Digitalization of music poses problems
like unauthorized file-sharing and concerns about digital piracy which results in loss
of revenue to copyright owners. This course will aim to understand the complexities
involved in the dissemination of musical work through digital platforms as well as
address issues like moral rights and copyright infringement.

INTERNATIONAL INVESTMENT LAW
AND INTELLECTUAL PROPERTY
Under international law, there are several treaties that protect IP. However, in recent
years, Bilateral Investment Treaties (BITs) and investment chapters in Free Trade
Agreements (FTAs) - the most important source of international investment law (IIL) -
have emerged as important instruments for the protection of IP because these
treaties recognize IP as a protected investment. Through the investor-State Dispute
Settlement (ISDS) mechanism, these treaties empower foreign investors to sue the
host State’s for their IP-related regulatory measures as treaty breaches. This course
would study the interactions and interrelations between the IIL regime and IP.

Evolution of the IIL regime to enable protection of IP rights under


international law
Significance and consequences of IP as a protected investment in
BITs and FTA investment chapters
Evaluation of IP-related regulatory measures (such as compulsory
licensing) liable to challenge by foreign investors before ISDS

TRIPS AND PUBLIC HEALTH
Public health has taken center stage in international law and policymaking in the era
of COVID-19. This course will offer a window into the interrelation between
intellectual property and globalization in context of the long running theme of global
public health. The course mainly focuses upon how international legal rules and
arrangements regarding IPRs, especially since the beginning of the TRIPS-era, have
been crucial in constituting frameworks for managing this important aspect of our
globalized society. To achieve this, the course will provide a bird’s eye view of the
process of globalization in the public health related IP regime covering the major
legal, political, and historical aspects. The course would also incorporate relevant
discussion on the contemporary issues related to IP and Covid-19 pandemic.
