1. **Define the concept of « Contract » according to Algerian civil law :**

mutual obligations enforceable by law. In Algerian civil law, contracts must meet certain
requirements, including consent, a lawful object, and a lawful cause.

2. **Distinguish between Nominate and Innominate contracts :**

- **Nominate contracts :** These are contracts specifically named and regulated by
law, such as sale or lease contracts. They have established legal rules that govern their
creation, interpretation, and execution.

- **Innominate contracts :** These are contracts not specifically named in the law and
are governed by general principles of contract law. They arise from the parties’
agreement and are tailored to their specific needs and circumstances.

**Question No 02 : Translate the following terms from English to Arabic :**

- Agreement = ‫اتفاقية‬

- Vises of consent = ‫عيوب الرضا‬

- Duress = ‫اإلكراه‬

- Exclusion from public tenders = ‫االستبعاد من المناقصات العامة‬

- Detention = ‫االحتجاز‬

**Question No 03 : Translate the following terms from Arabic to English :**

= ‫ العمليات المصرفية‬-Banking operations

= ‫ المضاربة‬-Speculation

= ‫ الغرامة‬-Fine

= ‫ الشروع‬-Attempt

**Question No 04 : Translate the following paragraphs from English to Arabic using


correct legal terminology :**

1. **An acceptance is the manifestation of the will of the offeree to be bound on the
terms of the offer :**

.‫القبول هو إظهار إرادة الموجه إليه العرض لاللتزام بشروط العرض‬

2. **Silence does not constitute acceptance. But, it is considered as acceptance in


exception cases determined by the law :**
ً
.‫قبوال في حاالت استثنائية يحددها القانون‬ ‫ ولكنه يُعتبر‬.ً‫الصمت ال يُعتبر قبوال‬

3. **Error is a false representation of reality. It may result from ignorance of the


existence of something that really exists or from a wrong belief in the existence of
something that actually does not exist :**

‫ قد ينتج عن الجهل بوجود شيء موجود فعليًا أو من االعتقاد الخاطئ بوجود شيء ال‬.‫الخطأ هو تصوير خاطئ للواقع‬
.‫يوجد بالفعل‬

4. **A mistake is an essential mistake when its gravity is of such a degree that if it
had not been committed the party who was mistaken would not have concluded
the contract :**

.‫يكون الخطأ خطأ ً جوهريًا عندما تكون جديته بدرجة تجعله لو لم يرتكبه الطرف المخطئ لما أبرم العقد‬
