AGREEMENT OF SALE

This Sale Agreement is made and executed on this XX day of XX 20XX


(22.03.2020) by and between:

Hereinafter called the “VENDOR” of the One Part (which term shall mean
and include his legal heirs, representative, administrators, successors and
assigns) and in favour of:

Mr. XXXX

Hereinafter called the “PURCHASER” of the Other Part. (Which term shall
mean and include his legal heirs, representative, administrators, successors
and assigns)

NOW THIS AGREEMENT OF SALE WITNESSETH AS FOLLOWS: -

WHEREAS the VENDOR is the absolute owner of Residential Flat


bearing No.XX, Presently bearing Bruhat Bangalore Mahanagara Palike
PID NO. XX measuring XX Sq.feet Super Built Up Area containing Two
bedrooms with RCC Roofing, Ceramic Tiles Flooring and Honne Wood
Doors and Windows, together with One Covered Car Parking Space
including proportionate share in common area such as Passage,
Lobbies, Staircase and Lift, constructed on Schedule ‘A’ Property
known as “XX” which is more fully described in the schedule hereunder
which is acquired from XX through Absolute Sale Deed registered as
document No.
XX, dated XX registered in the office of Sub-Registrar, Hebbal, Bangalore

WHEREAS the VENDOR for want of funds for his domestic and family
necessities, does hereby agree to sell the schedule property to the purchaser
for a sale consideration amount of Rs.XX/- (Rupees XX Lakhs Only) and the
Purchaser have agreed to purchase the same.

WHEREAS the Purchaser has paid an advance of Rs. XX,000


(Rupees XXX Only) by way of Cheque bearing No. xxx, dated: XXXX, drawn
on State Bank of India, R.T Nagar Branch, Bangalore and agreed to pay
remaining balance of sale consideration of Rs. XXX/- (Rupees XXXX Only) at
or before the time of registration within Three (3) months from the date of this
agreement.

WHEREAS the VENDOR agrees to execute and assured to the


Purchaser that the Sale Deed will be executed in the name of Purchaser.

WHEREAS, If the purchaser fails to pay the balance sale consideration


and get the sale deed executed in his favour, then the vendor shall return the
advance to the purchaser.

WHEREAS, likewise if the vendor fails to execute the sale deed in


favour of purchaser then the vendor shall refund the advance amount to the
purchaser.

Whereas the Vendor have assured and promised to the purchaser that
the schedule property is free from all kinds of encumbrances, court
attachments, Mortgage, Family Rights, Stridana Rights, Minor claims,
Maintenance Rights, Acquisition proceedings and other litigation.

Whereas the vendor agrees to handover all the original relevant


documents in respect of schedule property at the time of registration to the
purchaser.

Whereas the Vendor agrees to pay upto date tax, katha extract, katha
certificate before execution of sale deed.

Whereas the Vendor agrees to produce required legal documents for


execution of Sale Deed in favour of purchaser at the time of registration.
Whereas the VENDOR declares that, he has not entered into any
agreement whatsoever of sale, with any other person or persons except the
purchaser herein, in respect of the schedule property.

Whereas both the parties hereby agree that if there are any breaches
in of the covenants herein made, then they are at liberty to approach the
competent court for the specific performance of this agreement.

All the expenses, incurring, for the preparation of sale deed such as
purchase of stamp papers, drafting, typing, registration fees and other
miscellaneous fees etc. shall be borne by the purchaser alone.

SCHEDULE ‘A’ PROPERTY

All that piece and parcel of immovable property bearing Bangalore


Mahanagara Palike Katha No.XX (PID NO. XX) earlier property No.XX,
measuring on the East Side XX, on Western side XX and on the North XX
and on the South XX in all measuring XX Sq.ft. situated at XX, Bangalore
North Taluk and bounded on the:

East by : XX
West by : XX
North by : XX
South by : XX

SCHEDULE ‘B’

XX Sq. Feet undivided interest in the immovable property mentioned in


Schedule ‘A’ above, i.e., proportionate to the super built up area.

SCHEDULE ‘C’
Flat bearing No. XX, in XX Floor, Presently being Bruhat Bangalore
Mahanagara Palike Katha No. XX, (PID NO. XX) measuring XX Sq.feet
Super Built Up Area containing XX bedrooms with RCC Roofing,
ceramic Tiles Flooring and Honne Wood Doors and Windows, together
with One Covered Car Parking Space including proportionate share in
common area such as Passage, Lobbies, Staircase and lift, Constructed
on Schedule ‘A’ Property known as “XX”

IN WITNESSES WHEREOF the VENDOR and the PURCHASER here
