MEMORANDUM OF UNDERSTANDING

(For Mutual Consent Divorce under Section 13B of the Hindu


Marriage Act, 1955)

This Memorandum of Understanding ("MoU") is executed on this ___ day of __________, 20__, at
New Delhi, by and between:

1. Mr. [Husband’s Full Name], son of Shri [Father’s Name], aged about ___ years, presently
residing at [Full Address], hereinafter referred to as the “First Party” or the “Husband”.

2. Mrs. [Wife’s Full Name], daughter of Shri [Father’s Name], aged about ___ years, presently
residing at [Full Address], hereinafter referred to as the “Second Party” or the “Wife”.

Collectively referred to as the “Parties.”

RECITALS:
A. The Parties were lawfully married on _______________ at _______________ in accordance with
Hindu rites and customs.

B. Due to serious and irreconcilable differences, the Parties have been living separately
since ___________, and all attempts at reconciliation have failed.

C. The Parties have voluntarily and with mutual consent agreed to seek dissolution of their
marriage under Section 13B of the Hindu Marriage Act, 1955.

TERMS AND CONDITIONS:


1. 1. CONSENT FOR DISSOLUTION OF MARRIAGE - The Parties agree to jointly file a
petition for divorce by mutual consent under Section 13B of the Hindu Marriage Act,
1955.
2. 2. FINAL SETTLEMENT OF MAINTENANCE / ALIMONY - The First Party shall pay the
Second Party a sum of Rs. __________/- as full and final settlement towards all financial
claims.
3. 3. STRIDHAN AND DOWRY ARTICLES - The Second Party acknowledges receipt of all
her Stridhan, jewellery, and belongings.
4. 4. CHILD CUSTODY & VISITATION - The custody of the child shall remain with
[Father/Mother] and visitation rights shall be mutually agreed upon.
5. 5. WITHDRAWAL OF PENDING LITIGATION / COMPLAINTS - All pending cases, FIRs or
complaints shall be withdrawn unconditionally.
6. 6. NON-INTERFERENCE - Post-divorce, neither Party shall interfere in the life of the
other.
7. 7. FULL AND FINAL SETTLEMENT - This MoU constitutes a full and final settlement of
all matrimonial disputes.
8. 8. BINDING EFFECT - This MoU shall form the basis of the mutual divorce petition.
9. 9. GOVERNING LAW AND JURISDICTION - This MoU shall be governed by Indian law
and subject to jurisdiction of courts in New Delhi.

IN WITNESS WHEREOF, the Parties have signed this Memorandum of Understanding on the
day, month, and year first above mentioned, after fully understanding its contents and legal
consequences.
