CASE STUDY
DU law student charged with cyber stalking
NEW DELHI
ADelhi Universitylaw student has
been accused of stalking and
threatening a woman online.
He created her fake profiles on social
networking sites to defame her.
The woman, from Vasco-da-Gama,
Goa, lodged a complaint with Delhi
Police alleging the accused has been
harassing her for over a year now.

STALKER has been making obscene phone


calls and sending threatening emails.
The victim, while working in Delhi last year,
became acquainted with the accused. "He
asked her to marry him. She alleged that
when she refused, he assaulted her at Sarita
Vihar, also threatened to kill her,".
After this, he apologized and promised not to
bother her in future," the officer said. The
accused had reportedly given a written
statement to police that he will not stalk her.
After this, she withdrew her complaint.

Cyber Legislation
INDIA
Prior to February 2013, there were no
laws that directly regulate
cyberstalking inIndia but now, Indian
Parliament has made amendmentsto
theIndian Penal Code, introducing
cyberstalking as a criminal offence.
A man committing the offence of
stalking would be liable for
imprisonment up to three years for
the first offence, and shall also be
liable to fine and for any subsequent
conviction would be liable for
imprisonment up to five years and
with fine.

INFORMATION ACROSS THE INTERNET!

The more active a person is on the


Internet, the more information becomes
available to others to view about you.

Dont use a gender specific or


provocative screen name or e-mail
address.
Dont share your password with anyone.
Use a good anti-virus program and
update daily.
Be very cautious when meeting online
friends in person.
Discover if your ISP has a cyberstalking
policy, incase of legal action.

IF BEING STALKED!!

Make clear to stalker that you dont want to be


contacted anymore
Stop replying to emails, or text messages since
this will only encourage the behavior.
If threats are issued, make a complaint to the
harassers ISP.
Remove all personal information.
At any time if you feel endangered physically, call
police.
Save all logs between the stalker and yourself.
Block the user from your email and IM contact list.
