Right to Information Act, 2005

History and development of the act

• First RTI law developed by Sweden in 1766.


• Followed after two decades by the US (1966), Norway (1970), France and
Netherlands (1978), Australia, New Zealand and Canada (1982), Denmark
(1985), Greece (1986), Austria (1987) and Italy (1990).

• Tamil Nadu became first Indian state to pass RTI law in


1997.
• Freedom of Information (FOI) Act, 2002 passed.
• RTI Act passed October 12, 2005.
Introduction – What is RTI?

• Right available to the general public to demand


information from the duty-bound Government and/or
private bodies.
• Article 19(1)(a) of the Constitution of India.
• Universal Declaration of Human Rights (UDHR).

• Inspect work.

• Inspect Records - Any file, document or any soft copy.

• Take notes from certified copies of documents.


RTI Process

• Indentify the issue


• Make an application with prescribed fee
1st Step

• Wait for Response of 30 days


• Information received…Then Job Done
2nd Step

• 1st Appeal
• 2nd Appeal to RTI Commissioner
3rd Step • Penalty and Compensation
Time limits

• 30 days in case of General Application.

• 48 hours for information concerning the life and liberty


of a person.
Fees

• Application Fee Rs 10/-


• Material cost to be paid by applicant (photocopy, CD,
sample etc.)
– Rs 2 per A4/A3 page
– inspection of documents- no fee for first hour, Rs. 5 for every
subsequent hour or fraction thereof
– Rs 50 for CD
• No application Fee for BPL applicants
• No cost of information if supplied after 30 days period
RTI ACT 2005 - who is not covered..???

• Intelligence Bureau, Research & Analysis Wing, Directorate of


Revenue Intelligence, Central Economic Intelligence Bureau,
Department of Enforcement, Narcotics Control Bureau, Aviation
Research Centre, Special Frontier Force, Army,BSF, CRPF, ITBP,
CISF, NSG, Special Service Bureau, Assam Rifles, Special Branch
(CID) Andaman & Nicobar, Crime Branch (CID) Dadra And Nagar
Havelli, Special Branch Lakshaweep Police…….list is expanding
• However no exemption –in matters relating to human rights
Time limit 45 days
Success stories of the RTI act

• Chandigarh- Smoke Free City- Hemant Ghosh -Head of


NGO called ‘Burning Brain Society’.
• Employees get IT Refund, Road Tax Refund.
• FIR Application Status.
• Corruption Cases.
