ANNEX V (APPLICATION)

• Unless expressly provided otherwise, the


provisions of this Annex shall apply to all
ships.
Annex V (DEFINITIONS)
– Food wastes means any spoiled or unspoiled food
substance and include fruits, vegetables, dairy
products, poultry, meat products and food scraps
generated aboard ship.
– Garbage means all kinds of food wastes, domestic
wastes and operational wastes, all plastics, cargo
residues, incinerator ashes, cooking oil, fishing gear,
and animal carcasses generated during the normal
operation of the ship and liable to be disposed of
continuously or periodically except those substances
which are defined in other annexes to the present
convention.
Annex V (DEFINITIONS)
– Garbage does not include fresh fish and parts
thereof generated as a result of fishing
activities undertaken during the voyage, or as
a result of aquaculture activities which involve
the transport of fish including shell fish for
placement in the aquaculture facility and the
transport of harvested fish including shellfish
from such facilities to shore for processing.

• NEAREST LAND: The term from the nearest
land means from the baseline from which the
territorial sea of the territory in question is
established in accordance with international law,
except that, for the purpose of the present
convention “from the nearest land” off the north
eastern coast of Australia shall mean from a line
drawn from a point on the coast of Australia in;

Annex V (DEFINITIONS)
• Operational wastes means all solid wastes
(including slurries) not covered by other Annexes
that are collected on board during the normal
maintenance or operations of a ship, or used for
cargo stowage and handling. Operational wastes
also include cleaning agents and additives
contained in cargo hold and external wash water.
Operational wastes does not include grey water,
bilge water, or other similar discharges essential
to the operation of a ship, taking into account the
guidelines developed by the IMO.
Annex V (DEFINITIONS)
• Special area means a sea area where for
recognized technical reasons in relation to
its oceanographical and ecological
condition and to the particular character of
its traffic the adoption of special
mandatory methods for the prevention of
sea pollution by garbage is required.
Annex V (DEFINITIONS)
• For the purpose of this Annex the special
area are the Mediterranean sea area, the
Baltic sea area, the black sea area, the
red sea area, the Gulfs area, the North
sea area, the Antarctic area and the Wider
Caribbean Region, which are defined as
follows:

• Discharge of the following garbage into the
sea outside special area shall only be
permitted while the ship is enroute and as far
as practicable from the nearest land, but in
any case not less than:
– 3 NM from the nearest land for food wastes
which have been passed through comminuter or
grinder. Such comminuted or ground food
wastes shall be capable of passing through a
screen with openings no greater than 25 mm.

OUTSIDE SPECIAL AREA)
– 12 NM from the nearest land for food wastes
that have not been treated in accordance with
the subparagraph 1 above.
– 12 NM from the nearest land for cargo
residues that cannot be recovered using
commonly available methods for unloading.
These cargo residues shall not contain any
substances classified as harmful to the
marine environment, in accordance with the
criteria set out in appendix I of this Annex.
Annex V (DISCHARGE OF GARBAGE
OUTSIDE SPECIAL AREA)
– For animal carcasses, discharge shall occur as
far as from the nearest land as possible, taking
into account the guidelines developed by the IMO
• Cleaning agents or additives contained in
cargo hold, deck and external surfaces wash
water may be discharged into the sea, but
these substances must not be harmful to the
marine environment, taking into account
guidelines developed by the IMO.

• Solid bulk cargoes as defined in regulation
VI/1-1.2 of the SOLAS 1974, as amended,
other than grain, shall be classified in
accordance with the appendix I of this
Annex, and declared by the shipper as to
whether or not they are harmful to the
marine environment.

• When garbage is mixed with or
contaminated by other substances
prohibited from discharge or having
different discharge requirements, the more
stringent requirements shall apply.

• Discharge of Garbage within Special Area:
• Discharge of the following garbage into the
sea within special areas shall only be
permitted while the ship is enroute and as
follows:

– Discharge into the sea of food wastes as far as
practicable from the nearest land, but not less
than 12 NM from the nearest land or the nearest
ice shelf. Food wastes shall be comminuted or
ground and shall be capable of passing through
as screen with openings not greater than 25 mm.
Food wastes shall not be contaminated by any
other garbage type. Discharge of introduced avian
products, including poultry and poultry parts, is
not permitted in the Antarctic area unless it has
been treated to be made sterile.
Annex V (DISCHARGE OF GARBAGE
WITHIN SPECIAL AREA)
– Discharge of cargo residues that cannot be
recovered using commonly available methods
of unloading, where all the following
conditions are satisfied:
• Cargo residues contained in hold washing water
do not include any substances classified as
harmful to the marine environment according to the
criteria set out in appendix I of this Annex;

• Solid bulk cargoes as defined in regulation VI/1-1.2
of SOLAS 1974, as amended, other than grain,
shall be classified in accordance with appendix I of
this Annex, and declared by the shipper as to
whether or not they are harmful to the marine
environment.
• Cleaning agents or additives contained in hold
washing water do not include any substances
classified as harmful to the marine environment
taking into account guidelines developed by the
IMO;

• Both the port of departure and the next port of
destination are within special area and the ship will
not transit outside the special area between these
ports;
• No adequate reception facilities are available at
those ports taking into account guidelines
developed by the IMO; and

• Where the conditions of subparagraphs 2.1 to 2.5
of this paragraph have been fulfilled, discharge of
cargo hold washing water containing residues shall
be made as far as practicable from the nearest
land or the nearest ice shelf and not less than 12
NM from the nearest land or the nearest ice shelf.

may be discharged into the sea, but only if
these substances are not harmful to the
marine environment, taking into account

• EXCEPTIONS:
• Regulations 3, 4, 5 and 6 of this Annex
and section 5.2 of chapter 5 of part II-A of
the Polar Code shall not apply to:
– The discharge of garbage from a ship
necessary for the purpose of securing the
safety of a ship and those on board or saving
life at sea; or

– The accidental loss of garbage resulting from
damage to a ship or its equipment, provided
that all reasonable precautions have been
taken before and after the occurrence of the
damage, to prevent or minimize the accidental
loss; or
– The discharge of fishing gear from a ship for
the protection of the marine environment or
for the safety of that ship or its crew.
ANNEX V (PLACARDS, GMP and
GARBAGE RECORD KEEPING)
• Every ship of 100 GRT and above, and every ship
which is certified to carry 15 or more persons, and
fixed or floating platforms shall carry a garbage
management plan which the crew shall follow. This
plan shall provide written procedures for
minimizing, collecting, storing, processing and
disposing of garbage, including the use of the
equipment on board. It shall also designate the
person or persons in charge of carrying out the
plan. Such a plan shall be base on the guidelines
developed by the IMO and written in the working
language of the crew.
ANNEX V (PLACARDS, GMP and
GARBAGE RECORD KEEPING)
• Every ship of 400 GRT or above and every
ship which is certified to carry 15 or more
persons engaged in voyages to ports or
offshore terminals under the jurisdiction of
another state party to the convention and
every fixed and floating platforms shall be
provided with a Garbage Record Book. The
GRB, whether as part of the ship’s official log
book or otherwise, shall in the form specified
in appendix II to this Annex:
ANNEX V (PLACARDS, GMP and

– Each discharge into the sea or to a reception
facility, or a completed incineration, shall be
promptly recorded in the GRB and signed for on
the date of the discharge or incineration by the
officer in charge. Each completed page of the
GRB shall be signed by the Master of the ship.
The entries in the GRB shall be at least in
English, French or Spanish. Where the entries
are also made in an official language of the State
whose flag the ship is entitled to fly, the entries in
that language shall prevail in case of a dispute or
discrepancy.
ANNEX V (PLACARDS, GMP and
GARBAGE RECORD KEEPING)
– The entry for each discharge into the sea
under regulation 4, 5, 6 or section 5.2 of this
chapter of part II-A of the polar code shall
include date and time, position of the ship
(lat/long), category of the garbage and the
estimated amount (in m3) discharged. For the
discharge of cargo residues the discharge
start and stop positions shall be recorded in
addition to the foregoing;;

– The entry for each completed incineration shall
include date and time and position of the ship
(lat/long) at the start and stop of the incineration,
categories of garbage incinerated and the
estimated amount incinerated for each category
in m3.
– The entry for each discharge to a port reception
facility or another ship shall include date and time
of discharge, port or facility or name of ship,
categories of garbage discharged, and the
estimated amount discharged for each category
in m3.
ANNEX V (PLACARDS, GMP and
GARBAGE RECORD KEEPING)
– The GRB along with receipts obtained from
the reception facilities shall be kept on board
the ship for the fixed or floating platforms, and
in such a place as to be readily available for
inspection at all reasonable times. This
document shall be preserved for a period of at
least two years from the date of the last entry
made in it;

– In the event of any discharge or accidental loss
referred to in regulation 7 of this Annex an entry
shall be made in the GRB, or in the case of any
ship of less than 400 GRT, an entry shall be made
in the ship’s official log book, of the date and time
of occurrence, port or position of the ship at time of
occurrence (lat/long and water depth if known), the
reason for the discharge or loss, details of the
items discharged or lost, categories of garbage
discharged or lost, estimated amount for each
category in cubic meters, the reasonable
precautions taken to prevent or minimize such
discharge or accidental loss and general remarks.

• The Administration may waive the
requirements for GRB for:
– Any ship engaged on voyages of one (1) hour
or less in duration which is certified to carry
15 or more persons; or
– Fixed or floating platforms.

• Entries in GRB shall be made on each of
the following occasions:
– When garbage is discharged to a reception
facility ashore or to other ships:
• Date and time of discharge
• Port or facility, or name of ship
• Categories of garbage discharged
• Estimated amount discharged category wise in m3
• Signature of office in charge of the operation

ANNEX VI (APPLICATIONS)
• The provision of this Annex shall apply to
all ships, except where expressly provided
otherwise in regulation 3, 5, 6, 15, 16, 18,
19, 20, 21, 22 and 22A of this Annex
ANNEX VI (DEFINITIONS)
– Emission means any release of substances, subject
to control by this Annex, from ships into the
atmosphere or sea.
– Emission control area means an area where the
adoption of special mandatory measures for
emissions from ships is required to prevent, reduce
and control air pollution from Nox or Sox and
particular matter or all three types of emissions and
their attendant adverse impacts on human health
and the environment. Emission control areas shall
include those listed in, or designated under,
regulations 13 and 14 of this Annex.
ANNEX VI (DEFINITIONS)
– Fuel oil means any fuel delivered to and
intended for combustion purposes for
propulsion or operation on board a ship.
Including gas, distillate and residual fuels.
ANNEX VI (DEFINITIONS)
– Nox Technical code mans the Technical code
on control of Emission of Nitrogen Oxides
from Marine Diesel Engines adopted by
resolution 2 of he 1997 MARPOL Conference,
as amended by the IMO provided that such
amendments are adopted and brought into
force in accordance with the provisions of
article 16 of the present convention.
ANNEX VI (DEFINITIONS)
– Ozone depleting substances means controlled
substances defined in paragraph (4) of article 1
of the Montreal Protocol on Substances that
deplete the ozone layer, 1987, listed in Annexes
A, B, C or E to the said protocol in force at the
time of application or interpretation of this Annex.
• Ozone depleting substances that may be found
onboard ship include, but are not limited to:
– Halong 1211 (Bromochlorodifluoromethane)
– Halon 1301 (Bromotrifluoromethane
– Halon 2402 (1,2 – Dibromo – 1,1,2,2 – tetrafluoroethane)
(Also known as Halon 114B2)

– CFC-11 (Tricchlorofluoromethane
– CFC-12 (Dichlorodifluoromethane)
– CC-113 (1,1,2 – Trichloro – 1,2,2 – trifluoroethane)
– CDC-114 (1,2 - Dichloro – 1,1,2,2 – tetrafluoroethane)
– Cfc-115 (Chloropentafluoroethane)

– Shipboard incineration means the incineration


of wastes or other matter onboard a ship, if
such wastes or other matter were generated
during the normal operation of that ship.
ANNEX VI (DEFINITIONS)
• Tanker in relation to chapter 4 means an oil tanker as
defined in MARPOL Annex I, regulation 1 or a
chemical tanker or an NLS tanker as defined in
MARPOL Annex II, regulation 1.
• Container ship means a ship designed exclusively for
the carriage of containers in holds and on deck.
• General cargo ship means a ship with a multi deck or
single deck hull designed, primarily for the carriage of
general cargo. This definition excludes specialized dry
cargo ships, which are not included in the calculation
of reference lines for general cargo ships, namely
livestock carrier, barge carrier, heavy load carrier,
yatch carrier, nuclear fuel carrier.
ANNEX VI (DEFINITIONS)
• Refrigerated cargo carrier means a ship designed
exclusively for the carriage of refrigerated cargoes in
holds.
• Combination carrier means a ship designed to load
100% deadweight with both liquid and dry cargo in
bulk.
• Passenger ship means a ship which carriers more
than 12 passengers.
• Ro-Ro cargo ship (Vehicle carrier) means a multi
deck roll-on roll-off cargo ship designed for the
carriage of empty cars and trucks.
• RO-RO cargo ship means ship designed for the
carriage of Roll-on Roll-off cargo transport units.
ANNEX VI (DEFINITIONS)
• Ro-Ro passenger ship means a passenger ship with
roll-on roll-off cargo spaces.
• LNG carrier in relation to chapter 4 of this Annex
means a cargo ship constructed or adapted and used
for the carriage in bulk of LNG.
ANNEX VI (DEFINITIONS)
• Cruise passenger ship in relation to chapter 4 of
this Annex means a passenger ship not having a
cargo deck, designed exclusively for commercial
transportation of passengers in overnight
accommodations on a sea voyage.
• Cargo ship having ice-breaking capability in
relation to chapter 4 of this Annex means a cargo
ship which is designed to break level ice
independently with a speed of at least 2 knots
when the level ice thickness is 1.0m or more
having ice bending strength of at least 500 kpa.
ANNEX VI (GENERAL
EXCEPTIONS & EXEMPTIONS)
• Regulations of this Annex shall not apply
to:
– Any emission necessary for the purpose of
securing the safety of a ship or saving life at
sea; or
ANNEX VI (GENERAL
EXCEPTIONS & EXEMPTIONS)
– Any emission resulting from damage to a ship
or its equipment:
• Provided that all reasonable precautions have
been taken after the occurrence of the damage or
discovery of the emission for the purpose of
preventing or minimizing the emission; and

• Except if the owner or the master acted either with


intent to cause damage, or recklessly and with
knowledge that damage would probably result.
EEDI/SEEMP
• Energy Efficiency Design Index (EEDI)
• The EEDI for new ships is the most important
technical measure and aims at promoting the use
of more energy efficient (less polluting) equipment
and engines. The EEDI requires a minimum
energy efficiency level per capacity mile (e.g. tonne
mile) for different ship type and size segments.
Since 1 January 2013, following an initial two year
phase zero, new ship design needs to meet the
reference level for their ship type.
EEDI/SEEMP
• The level is to be tightened incrementally every
five years, and so the EEDI is expected to
stimulate continued innovation and technical
development of all the components influencing
the fuel efficiency of a ship from its design
phase. The EEDI is a non-prescriptive,
performance-based mechanism that leaves the
choice of technologies to use in a specific ship
design to the industry.
EEDI/SEEMP
• As long as the required energy efficiency level is
attained, ship designers and builders are free to
use the most cost-efficient solutions for the ship
to comply with the regulations. The EEDI
provides a specific figure for an individual ship
design, expressed in grams of carbon dioxide
(CO2) per ship's capacity-mile (the smaller the
EEDI the more energy efficient ship design) and
is calculated by a formula based on the technical
design parameters for a given ship.
EEDI/SEEMP
• Ship Energy Efficiency Management Plan
(SEEMP) and Energy Efficiency Operational
Indicator (EEOI)
• The Ship Energy Efficiency Management Plan
(SEEMP) is an operational measure that establishes
a mechanism to improve the energy efficiency of a
ship in a cost-effective manner. The SEEMP also
provides an approach for shipping companies to
manage ship and fleet efficiency performance over
time using, for example, the Energy Efficiency
Operational Indicator (EEOI) as a monitoring tool.
EEDI/SEEMP
• The guidance on the development of the
SEEMP for new and existing ships incorporates
best practices for fuel efficient ship operation, as
well as guidelines for voluntary use of the EEOI
for new and existing ships (MEPC.1/Circ.684).
The EEOI enables operators to measure the fuel
efficiency of a ship in operation and to gauge the
effect of any changes in operation,
EEDI/SEEMP
• e.g. improved voyage planning or more
frequent propeller cleaning, or introduction
of technical measures such as waste heat
recovery systems or a new propeller. The
SEEMP urges the ship owner and
operator at each stage of the plan to
consider new technologies and practices
when seeking to optimise the performance
of a ship.

• Emission Control Areas (ECAs)
designated under regulation 13 of
MARPOL Annex VI (NOx emission
control)

• The North American area (regulation
