Things Student-Athletes and Agents Should Know – UK Athletics

Student-athletes are permitted use an athlete agent solely for purposes of assisting with contracts for compensation. The use of an “athlete agent” for purposes of assisting with contracts for compensation for the student athlete’s name, image and likeness shall conform to KRS 164.6901-.6935 and comply with the Sports Agent Responsibility and Trust Act established in 15 U.S.C. Section 7801, et seq. Any individual involved in assisting with promotional activities for student-athletes should be registered with the UK Athletics Compliance office and the Commonwealth of Kentucky.

Outside of assisting with contracts for compensation and in sports other than men’s basketball, current student-athletes will become ineligible if they have agreed, orally or in writing, to be represented, now or in the future, by an agent.  The individual could also be ruled ineligible if they, or their family or friends, have accepted a benefit from the agent.

In men’s basketball, any individual who solicits a prospective or enrolled student‐athlete to enter into an agency contract or attempts to obtain employment for an individual with a professional sports team or organization or as a professional athlete must be certified and maintain active certification per the policies and procedures of the NCAA agent certification program. A family member of a prospective or enrolled student-athlete or an individual acting solely on behalf of a professional sports team or organization is not required to be certified through the NCAA agent certification program. NCAA-certified agent is presumed responsible for the actions of all employees who report, directly or indirectly, to the NCAA-certified agent. Improper conduct of an NCAA-certified agent’s employees shall subject the agent to disciplinary action pursuant to the NCAA agent certification program. Kentucky Agent Registration: The Agent Registration form must be completed by all Athlete Agents aspiring to do business with UK student-athletes.  Also, it is a state law that all prospective agents register with the State of Kentucky through the Division of Occupations and Professions.  If you have not already registered with the State as an Athlete Agent, please go to http://raa.ky.gov and do so.

A file will be opened under your name upon receipt of this form.  You may want to include information about your company that would be beneficial for our student-athletes to know.  Please note that all renewal registration forms are mailed in the summer for the following school year.  You will be asked to fill a renewal form out again at that time.
