Abstract

El presente trabajo aborda el estudio del marco legal de las empresas de inserción (en adelante EI), calificación que reciben determinadas sociedades que realizando cualquier actividad económica tienen como finalidad la integración socio laboral de personas en situación de exclusión social como tránsito al empleo ordinario. El artículo comienza analizando la conceptualización de las EI y su categorización como empresas de la economía social, empresas sociales, y WISEs. Posteriormente, se expondrá la distribución geográfica y en temporal de las EI que está estrechamente relacionada con la promulgación de normativas sobre estas. Este apartado nos permitirá abordar nuestro objetivo principal que, como el título indica, es desgranar el marco legal y régimen jurídico de las EI en el ordenamiento español. Para ello, primero analizaremos el marco legal de las EI, así como la discutida distribución de competencias que se realiza con la promulgación de la Ley 44/2007 de ámbito estatal (LEI). En segundo lugar, se expondrá el régimen legal de las EI, lo que nos dará pie a realizar un estudio comparado de la legislación estatal y autonómica, que se contextualizará con la posible reforma de la LEI en el marco de la anunciada Ley Integral de Impulso de la Economía Social que actualmente se plasma en un anteproyecto de 2023.
