Senators Thrasher and Crist moved the following:

3 Delete lines 1724 - 1737
4 and insert:
5 Section 36. (1) Any school district that received a grant
6 of at least $75 million from a private foundation for the
7 purpose of improving the effectiveness of teachers within the
8 school district may seek an annual exemption from the State
9 Board of Education of ss. 1008.222, 1011.626, Florida Statutes,
10 as created by this act, and the amendments to ss. 1012.22 and
11 1012.34, Florida Statutes, as amended by this act.
12 (2) To receive approval from the State Board of Education
13 for an exemption under this section, a school district must

14 demonstrate to the State Board of Education that it is


15 implementing the following:
16 (a) A teacher appraisal system that uses student
17 performance as the single greatest component of the teacher’s
18 evaluation.
19 (b) A teacher compensation system that awards salary
20 increases based on sustained student performance.
21 (c) A teacher contract system that awards contracts based
22 on student performance.
23 (3) The State Board of Education shall annually renew a
24 school district’s exemption if the school district provides a
25 progress report that demonstrates that the school district
26 continues to meet the requirements of subsection (2).
27 (4) The State Board of Education shall adopt rules pursuant
28 to ss. 120.536(1) and 120.54, Florida Statutes, to establish the
29 procedures for applying for an exemption under this section.

34 and insert:
35 teacher preparation programs; authorizing school
36 districts to seek an exemption from the State Board of
37 Education from the requirement of certain laws;
38 authorizing the State Board of Education to adopt
39 rules; providing for severability;
