Chardon Grass Cutting Ordinance Amendment

AN ORDINANCE AMENDING SECTION 521.11 PROVIDING THAT ONE
NOTICE FOR GRASS EXCEEDING SIX INCHES IN HEIGHT BE SERVED FOR
THE CALENDAR YEAR.
WHEREAS, the Codified Ordinances of the City of Chardon prevent grass, weeds
or plants other than traditional landscaping to grow to a height exceeding six inches; and
WHEREAS, 521.11 declares grass, plants or common weeds exceeding six inches
in height to be a nuisance; and
WHEREAS, numerous violations by the same property owner or person in
possession of land may occur during the calendar year; and
WHEREAS, the Council of the City of Chardon desires to adopt a policy to
expedite the abatement of the nuisance for the benefit of the adjoining property owners and
the citizens of the City of Chardon by allowing issuance of the notice to declare a nuisance
for the remainder of the calendar year.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Chardon,
State of Ohio, that:
SECTION 1. Section 521.11 NOTICE TO CUT WEEDS; REMOVE LITTER;
SERVICE OF VIOLATION NOTICE, is hereby amended to add subsection (d) which
reads in its entirety as follows:
(d) The notice served pursuant to subsection (c) above shall be a notice of a
nuisance violation for the current condition of the lot or land and a continuing nuisance for
the remainder of the calendar year. After the City cuts the high grass and/or removes the
vegetation in excess of six inches, the Manager or designee shall send written notice to the
persons entitled to notice in subsection (c) above that the high grass has been cut, and the
City will continue to cut the grass for the remainder of the year whenever it is higher than
six inches. The notice shall include the cost to cut the high grass and remove or cut other
vegetation. A notice of cutting and an invoice shall be sent to the persons entitled thereto
after each mowing or vegetation removal.
SECTION 2. The Manager or his designee are authorized to adopt a policy for the
enforcement of 521.11.
SECTION 3. In all other respects, 521.11 shall remain in full force and effect
except as amended by the addition of the foregoing subsection.
SECTION 4: It is found and determined that all formal actions of this Council
concerning and relating to the adoption of this ordinance were adopted in an open meeting
of this Council and that all deliberations of this Council and any of its committees that
resulted in such formal action, were in meetings open to the public, in compliance with the
law, including 121.22 of the Ohio Revised Code.
SECTION 5. This ordinance shall become effective on the earliest date allowed by
law.
