3. During the foot patrol, at about 11:00 in the evening, the team saw
the accused. Barangay Councilor Sales did not recognize the
accused as a resident of the barangay prompting them to approach
him. Noticing their presence, the accused acted suspiciously and
placed inside his pocket which he earlier held in his hand. PO1
Paclauna asked the accused what was that he was holding and then
placed inside his pocket, to which inquiry the accused responded by
taking out the matchbox and lighter. When the police officer asked
the accused to open the matchbox, he did so and the matchbox’s
content was ascertained to be the dangerous drug marijuana;
4. The accused was placed under arrest after he was informed his
statutory and constitutional rights in a dialect known to him. There
from, the accused was immediately brought to the Dumaguete City
Police Station. He was booked, fingerprinted and photographed in
compliance with the existing Standard Operating Procedure (SOP)
of the PNP;
SUBCRIBED AND SWORN TO, before me, this March 23, 2011 in
Dumaguete City, Negros Oriental. I further certify that I have personally
examined the herein Affiants and I am fully convinced that they freely and
voluntarily executed their statements and that they understood the same.
