    Dumaguete City, Negros Oriental ) S.S.

    JOINT AFFFIDAVIT OF ARREST

    WE, PO1 Placido Xandro Paclauna, member of the Philippine National


    Police assigned in Dumaguete City, and Ricardo Sales, Barangay Councilor
    of Barangay Looc, Dumaguete City, under oath in accordance with law, do
    hereby depose and say that:

    1. The Dumaguete City Police Station had received information from


    concerned citizens on the rampant proliferation distribution and
    usage of Methamphetamine Hydrochloride commonly known as
    “shabu”, specifically within the areas of Barangay Looc, Dumaguete
    City;

    2. Acting on said information, on March 22, 2011 PO1 Placido Xandro


    Paclauna led a team composed of Barangay Looc Councilors
    Ricardo Sales, George Balungag and Eldy Catipay as well as
    Barangay Tanods of the same barangay on a foot patrol within the
    vicinity of Barangay Looc, Dumaguete City;

    3. During the foot patrol, at about 11:00 in the evening, the team saw
    the accused. Barangay Councilor Sales did not recognize the
    accused as a resident of the barangay prompting them to approach
    him. Noticing their presence, the accused acted suspiciously and
    placed inside his pocket which he earlier held in his hand. PO1
    Paclauna asked the accused what was that he was holding and then
    placed inside his pocket, to which inquiry the accused responded by
    taking out the matchbox and lighter. When the police officer asked
    the accused to open the matchbox, he did so and the matchbox’s
    content was ascertained to be the dangerous drug marijuana;

    4. The accused was placed under arrest after he was informed his
    statutory and constitutional rights in a dialect known to him. There
    from, the accused was immediately brought to the Dumaguete City
    Police Station. He was booked, fingerprinted and photographed in
    compliance with the existing Standard Operating Procedure (SOP)
    of the PNP;

    5. Therefore, the accused is recommended to be charged with and


    prosecuted for violation of Sec. 3, Article II of Republic Act 9165
    or the Comprehensive Dangerous Drugs Acts of 2002 for illegal
    possession of dangerous drugs;

    6. We are executing this Joint Affidavit of Arrest to attest to the


    truthfulness of the foregoing facts to support our recommendations;
    IN WITNESS WHEREOF, we are hereunto set our signatures this
    March 23, 2011 in Dumaguete City, Negros Oriental.
