1st Indorsement dated 16 August 2019 of Gloria S. Evangelista, Supervising
Administrative Officer, Office of the City Mayor, to Atty. Leticia O. Clemente, City
Budget Officer, forwarding for information and appropriate action the letter dated
25 July 2019 of Atty. Brenner L. Bengwayan, Secretary to the Sanggunian, re: Letter
dated 02 May 2019 of Hon. City Mayor Mauricio G. Domogan, requesting reversion of
the amount of Three Million Eight Hundred Thousand Pesos (Php3,800,000.00),
obligated under Account No. 1011-18-12-947 (Salaries and Wages-Regular) of the City
Mayor's Office, to the surplus account of the General Fund, and to reappropriate the same
for the Peace and Order Program of the different barangays.

4. Committee Report Nr. MARKET-2019-033
Resolution No. 038, series of 2019 of Pacdal Barangay entitled "A resolution requesting
Hon. Coun. Philian Louise Weygan-Allan to include Pacdal covered court to the
modernization of District Satellite Market of Gibraltar Barangay".
The Committee on Market, Trade, Commerce and Agriculture recommends that the
abovementioned Proposed Barangay Resolution be ADOPTED and APPROVED
and to request the City Building and Architecture Office (CBAO) Head,
Engr. Nazita F. Banez for the preparation of the design and cost estimate aligned
with the design of the District Satellite Market of Gibraltar Barangay.

5. Committee Report Nr. PROTECTION-2019-032


Proposed Ordinance Nr. PO 0086-19 introduced by Hon. Lilia A. Fariñas entitled
"Prohibiting the flying of drones over barangay residential areas, condominiums, and
other private properties and providing penalties hereof [Barangay Drone Prohibition
Ordinance]".
(NOTE: [a] FIRST READING 22 July 2019 Regular Session [Agenda Item Nr 26]; and
[b] Rule IV, Sec. 2. B. a. of the Internal Rules of Procedure states "Second reading
(Publication). The committee concerned shall report out proposed penal or regulatory
ordinances in due and proper form for publication in at least one newspaper of general
circulation in Baguio City before the same shall again be calendared for second reading
and be considered by the Sangguniang Panlungsod on second reading of the proposed
ordinances, discussion shall be allowed";
[c] Proposed Ordinance Nr. PO 0008-18 introduced by Hon. Leandro B. Yangot Jr. entitled,
"Baguio City Drone Regulation Ordinance". The matter was deferred during 24 June 2019
regular session; and
[d] Letter dated 29 January 2018 of PS/Supt. Ramil Ladyong Saculles, forwarding comments
on Proposed Ordinance Nr. PO 0008-18 introduced by Hon. Leandro B. Yangot Jr. entitled,
"Baguio City Drone Regulation Ordinance.")

The Committee on Public Protection and Safety, Peace and Order recommends that
the proposal be RETURNED to the proponent to consolidate with PO Nr. 0008-18
and to consider the Drone-Rules and Laws in the Philippines.

6. Committee Report Nr. PROTECTION-2019-031


Proposed Resolution Nr. PR 0204-19 introduced by Hon. Vice Mayor Faustino A.
Olowan, Hon. Joel A. Alangsab, Hon. Benny O. Bomogao, Hon. Betty Lourdes F.
Tabanda, Hon. Elaine D. Sembrano, Hon. Maria Mylen Victoria G. Yaranon,
Hon. Isabelo B. Cosalan, Jr., Hon. Francisco Roberto Ortega VI, Hon. Arthur L.
Allad-iw, Hon. Vladimir D. Cayabas, Hon. Fred L. Bagbagen, Hon. Lilia A. Fariñas,
Hon. Philian Louise W. Allan, Hon. Michael L. Lawana and Hon. Levy Lloyd B. Orcales
entitled "Urging the Baguio City Police Office to finalize their master action plan and
patrol plan named as 'Oplan Somabat' which will incorporate the movement of all mobile,
motorcycle, and beat patrollers to bring them to the parts of the city where and when they
are most needed".
(NOTE: Resolution Nr. 22, series of 2011 URGED THE BAGUIO CITY POLICE OFFICE
(BCPO) TO CREATE A SPECIAL TASK FORCE TO COMBAT ROBBERIES AND THEFT IN
THE CITY OF BAGUIO.)

The Committee on Public Protection and Safety, Peace and Order recommends
APPROVAL of the Proposed Resolution.

7. Committee Report Nr. PWORKS-2019-072


Letter dated 25 September 2019 of Hon. City Mayor Benjamin B. Magalong, urging
support for the development of the Baguio City Public Market and informing the
Sangguniang Panlungsod that the development plan for the City Market prepared and
spearheaded by Hon. Maria Mylen Victoria G. Yaranon, Hon. Philian Louise
Weygan-Allan and Hon. Joel A. Alangsab will be submitted the soonest for review and
approval.
The Committee on Public Works NOTES the above-mentioned matter as per
Resolution Numbered 340, series of 2019 (A Resolution approving the Master
Redevelopment Plan for the Baguio City Public Market submitted by the Technical
Working Group/ Committees subject to conditions).

8. Committee Report Nr. HEALTH-2019-021


Proposed Resolution Nr. PR 0205-19 introduced by Hon. Vice Mayor Faustino A.

Olowan and Hon. Joel A. Alangsab entitled "Informing the Department of Health (DOH)
of the City Government of Baguio's ownership of two ambulance vehicles under the
Baguio City Emergency Medical Services, Health Services Office, in compliance to the
DOH's requirement for licensure of ambulances".
(NOTE: Resolution Nr. 390, series of 2018 STRONGLY ENDORSED THE REQUEST OF THE
HONORABLE CITY MAYOR MAURICIO G. DOMOGAN TO THE DEPARTMENT OF
BUDGET AND MANAGEMENT FOR THE PROVISION OF TWO (2) UNITS OF AMBULANCE
WITH A TOTAL COST AMOUNTING TO SIX MILLION PESOS (P6,000,000.00) TO BE USED
BY THE CITY GOVERNMENT OF BAGUIO AND ITS CITIZENRY.)

The Committee on Health and Sanitation, Ecology and Environmental Protection


recommends APPROVAL of the above Resolution.

9. Committee Report Nr. PWORKS-2019-073


Resolution No. 07, series of 2019 of Greenwater Village Barangay entitled "A resolution
realigning the completion of barangay hall (installation of windows) to the concreting of
pathway at Sector 4 in the amount of One Hundred Fifty Thousand Pesos
(Php150,000.00)".
The Committee on Public Works recommends APPROVAL of the above-mentioned
matter.
The Committee further recommends APPROVAL of the attached Proposed
Ordinance PO Nr. 0162-19 on first reading dispensing with the second and third
readings.
9a. Proposed Ordinance Nr. PO 0162-19 introduced by Hon. Maria Mylen Victoria G.
Yaranon and Hon. Michael L. Lawana entitled "Realigning the amount of One Hundred
Fifty Thousand Pesos (Php150,000.00) under the 2016 Annual Investment Program (AIP)
from the project 'Continuation of barangay multipurpose hall' to 'Concreting of pathway
at Sector 4', Greenwater Village Barangay, Baguio City".

10. Committee Report Nr. SSWUP-2019-031


Proposed Resolution Nr. PR 0203-19 introduced by Hon. Joel A. Alangsab entitled
"Supporting the implementation of responsible parenthood and family planning law in the
workplaces of the city government and public offices, business establishments, malls and
other businesses in the City of Baguio".

The Committee on Social Services, Women and Urban Poor recommends that the
above Proposed Resolution be APPROVED.
Hon. Betty Lourdes F. Tabanda, a Committee Member, signified: "How will the
City support the Family Planning Program?"

11. Committee Report Nr. SSWUP-2019-032


Proposed Ordinance Nr. PO 0117-19 introduced by Hon. Maria Mylen Victoria G.
Yaranon entitled "Encouraging the various civil society organizations and private
business operating in the City of Baguio to pursue and implement their corporate social
responsibilities in order to promote the general welfare of the constituents of the city".
(NOTE: [a] FIRST READING 02 September 2019 Regular Session [Agenda Item Nr 44]; and
[b] Rule IV, Sec. 2. B. a. of the Internal Rules of Procedure states "Second reading
(Publication). The committee concerned shall report out proposed penal or regulatory
ordinances in due and proper form for publication in at least one newspaper of general
circulation in Baguio City before the same shall again be calendared for second reading
and be considered by the Sangguniang Panlungsod on second reading of the proposed
ordinances, discussion shall be allowed".)

The Committee on Social Services, Women and Urban Poor recommends that the
above Proposed Ordinance be RETURNED to the proponent and that the same

12. Committee Report Nr. MARKET-2019-034


Joint Manifesto of Punong Barangays of District 1 & 11-Baguio City entitled "In support
of the proposed construction of satellite market at Pacdal Circle within the jurisdiction of
Gibraltar Barangay which initially has already an allocated funding for the said project".
(NOTE: [a] Proposed Ordinance Nr. PO 0139-19 introduced by Hon. Philian Louise Weygan
Allan, entitled "An Ordinance known as the Pacdal/Gibraltar District Satellite Market
Ordinance of 2019 providing for the construction, appropriation and adjudication of the
stalls" which was referred to the Committee on Market, Trade, Commerce and Agriculture
on 24 September 2019; and

[b] Resolution Nr. 267 series of 2019 REQUESTED THE HONORABLE CITY MAYOR
BENJAMIN B. MAGALONG TO CREATE A TASK FORCE COMPOSED OF
REPRESENTATIVES FROM THE CITY PLANNING AND DEVELOPMENT OFFICE, THE
CITY ACCOUNTING OFFICE, THE CITY BUILDINGS AND ARCHITECTURE OFFICE,
AND THE CITY ENGINEERING OFFICE TO CONDUCT AND COMPLETE WITHIN
THREE (3) MONTHS FROM ITS CREATION A FEASIBILITY STUDY ON THE
PROPOSED CONSTRUCTION OF A NEW SATELLITE MARKET AT PACDAL
BARANGAY, BAGUIO CITY.)

The Committee on Market, Trade, Commerce and Agriculture recommends FOR


THE ADOPTION of the above-mentioned Joint Manifesto of the Punong Barangays
of Districts 1 and 11- Baguio City as resolved in a Proposed Resolution PR 0224-19
attached herewith.
12a. Proposed Resolution Nr. PR 0224-19 introduced by Hon. Philian Louise Weygan Allan
entitled "A resolution adopting the Joint Manifesto of the various punong barangays of
District 1 and 11, Baguio City entitled 'In support of the proposed construction of satellite
market at Pacdal Circle within the jurisdiction of Gibraltar Barangay which initially has
already an allocated funding for the said project'".

13. Committee Report Nr. MARKET-2019-035


Proposed Resolution Nr. PR 0216-19 introduced by Hon. Philian Louise Weygan-Allan
entitled "Resolution reiterating the implementation of 'one vendor, one stall' and the
creation of a data bank for occupants of the city market, satellite markets, night market,
roving/ambulant vendors/business owners utilizing designated public vending space and
city lot/land renters".
The Committee on Market, Trade, Commerce and Agriculture recommends the
APPROVAL of the above Proposed Resolution.
Hon. Joel A. Alangsab, a Committee Member signified: The creation of a data bank
should be fast tracked to truly implement the "one vendor, one stall" policy as I've
known that this is not being followed. Also, stalls are being rented. I could provide
stall numbers that are being rented.

14. Committee Report Nr. PWORKS-2019-074


Letter dated 11 September 2019 of Engr. Nazita F. Bañez, City Building Official, City
Buildings and Architecture Office, forwarding list of business establishments at the
Central Business District (CBD) that were notified with the Resolution Numbered 248,
series of 1996.
(NOTE: Resolution Nr. 248, series 1996 URGED ALL OWNERS OF BUSINESS
ESTABLISHMENT BUILDINGS IN THE CENTRAL BUSINESS DISTRICT (CBD) OF THE
CITY OF BAGUIO TO PAINT THEIR RESPECTIVE BUILDINGS.)

The Committee on Public Works recommends that the the above-mentioned letter
be NOTED.

15. Committee Report Nr. MARKET-2019-036


Proposed Resolution Nr. PR 0191-19 introduced by Hon. Betty Lourdes F. Tabanda
entitled "Requesting the Tripartite Committee to allow the use of the Cordillera Crafts
and Productivity Center located at DPS Compound, Upper Session Road, Baguio City, as
Pasalubong Center for products of the micro and small enterprises in the City of Baguio".
The Committee on Market, Trade, Commerce and Agriculture recommends the
APPROVAL of the Proposed Resolution.

16. Committee Report Nr. BRGY-2019-105


a. Annual Budget of Victoria Village Barangay for Calendar Year 2020 amounting
to Php3,957,818.00.
b. Annual Budget of Malcolm Square Barangay for Calendar Year 2019 amounting
to Php3,844,759.74.
c. Annual Budget of Lower Magsaysay Barangay for Calendar Year 2019
amounting to Php2,340,230.00.
d. Supplemental Budget No. 1 of Scout Barrio Barangay for Calendar Year 2019
amounting to Php1,474,728.40.
e. Supplemental Budget No. 1 of West Quirino Hill Barangay for Calendar Year
2019 amounting to Php1,440,899.33.
The Committee on Barangay Affairs recommends FAVORABLE REVIEW the
above Annual Budgets and Supplemental Budgets and returning the same to the
concerned barangays through the City Budget Officer for implementation.

17. Committee Report Nr. PUTTL-2019-062
Proposed Resolution Nr. SCOFAD 07-19 introduced by Hon. Senior Citizen Councilor
Caroline Z. Santiago entitled "A resolution urging the Land Transportation Franchising
and Regulatory Board (LTFRB), along with the Punong Barangay and a representative
from the Philippine National Police-Baguio to conduct an actual ocular inspection on the
submitted sketch and photo of the garage being presented by vehicle owners when
registering their vehicles".(Item 7, 07 October 2019 Agenda)
The Committee on Public Utilities, Transportation and Traffic Legislation
recommends the ADOPTION and APPROVAL of the resolution, with the
amendment that it applies only to PUVs as per existing LTFRB Circular No.
2011-012.

Proposed Resolution Nr. SOFAD 02-19 introduced by Hon. Scout Councilor Jairo M.
Peña entitled "A resolution requesting that the designated loading/unloading areas for
taxis on both sides of Session Road and Harrison Road be fully utilized and appropriate
signages be put up for easier identification".(Item 3, 14 October 2019 Agenda)
The Committee on Public Utilities, Transportation and Traffic Legislation
recommends that the matter be INDORSED to the City Engineering Office, Traffic
Management Division for appropriate action.

19. Committee Report Nr. PUTTL-2019-064


Proposed Resolution Nr. SOFAD 04-19 introduced by Hon. Scout Councilor Nathaniel
Jose B. Revilla entitled "Urging the City Government of Baguio to 'Include mandatory
pine tree planting as pre-requisite before buying or owning a vehicle' to support green
activity of the city".(Item 5, 14 October 2019 Agenda)
The Committee on Public Utilities, Transportation and Traffic Legislation
recommends the matter be NOTED.

20. Committee Report Nr. PUTTL-2019-065


Proposed Resolution Nr. SOFAD 12-19 introduced by Hon. Scout Councilor Xyrel Mae
T. Lonogan entitled "Proposed resolution mandating the Traffic Management Unit and
Highway Patrol Group to strictly implement the loading and unloading zones within the
City of Baguio".(Item 15, 14 October 2019 Agenda)
The Committee on Public Utilities, Transportation and Traffic Legislation
recommends the matter be NOTED.

21. Committee Report Nr. PUTTL-2019-066


a. Letter dated 29 November 2018 of Mr. Richard dela Peña Ferrer to Hon. Benny O.
Bomogao requesting an endorsement required by the Land Transportation Franchising
and Regulatory Board (LTFRB) for his new application of school service franchise.
b. Certification and endorsement dated 28 February 2019 of SLU LES Family Council,
certifying Mr. Richard Ferrer of Riverside, Ambiong, La Trinidad, Benguet, is the
owner of a Toyota Hiace Commuter Van with temporary Plate No. 030106 and
endorsing Mr. Ferrer who is applying for a permit to operate one (1) school service
from residence to SLU LES.
c. Letter dated 23 July 2019 of Mr. Richard D. Ferrer requesting consideration of the
recommendation of the Committee on Public Utilities, Transportation and Traffic
Legislation with regards to the approval of his request to endorse his application for
new school service franchise at the Land Transportation Franchising and Regulatory
Board, (LTFRB).
(NOTE: Mr. Richard dela Peña Ferrer and Atty. Jessie C. Balagot, Officer-in-Charge, Land
Transportation Franchising and Regulatory Board (LTFRB)-CAR were invited during the
regular session on 17 June 2019.)

b. Ordinance No. 18-001, series of 2018 of South Central Aurora Hill Barangay entitled,
"An ordinance on no parking of vehicles along Rimando Road and Immaculate
Conception Street, South Central Aurora Hill Barangay."
(NOTE: Rule XVII, ART. 111 of the Rules and Regulations Implementing the Local
Government Code of 1991 provides "Review of Barangay Ordinances by the Sangguniang
Panlungsod or Sangguniang Bayan. (b) If the Sangguniang Panlungsod or Sangguniang
Bayan, as the case may be, fails to take action on barangay ordinances within thirty (30) days
from receipt thereof, the same shall be deemed approved." The Barangay Ordinance was
received on 31 January 2019.)

The Committee on Public Utilities, Transportation and Traffic Legislation
recommends APPROVAL of the proposed ordinance on SECOND READING
AFTER PUBLICATION.
The above proposed ordinance was posted on the bulletin boards of City Hall,
Baguio Public Market, Baguio City Post Office, Baguio City Library and the Baguio
City Health Services starting 07 May 2019.

23. Committee Report Nr. PUTTL-2019-068


Notice of Hearing dated 16 August 2018 issued by Mr. Adriano B. Consunji, Chief,
Commission Secretariat, National Telecommunications Commission, regarding the
application of Megamanila Telecom Corp., under NTC CASE NO. 2019-105 scheduled
on 30 September 2019 at 10:00 in the morning at the Legal Department, 3rd Floor,
National Telecommunications Commission, BIR Road, East Triangle, Diliman, Quezon
City, regarding the request for:
[a] issuance and grant in favor of applicant a Certificate of Public Convenience and
Necessity(CPCN) to install, operate and maintain a Nationwide Data Communications
Network/Service; and
[b] Provisional Authority (P.A.) to operate the service be issued in its favor pending final
determination of the application.

Energy Regulatory Commission, re: ERC Case No. 2019-014 RC entitled "In the
matter of the application for the approval of the Ancillary Services Procurement
Agreement between the National Grid Corporation of the Philippines and SN Aboitiz
Power-Benguet, Inc., (For Ambuklao), with prayer for the issuance of Provisional
Authority, National Grid Corporation of the Philippines (NGCP) and SN Aboitiz
Power-Benguet, Inc. (SNAP-BI), Applicants".
(NOTE: The matter is related to the following:
a]Letter dated 10 May 2019 of Fernan V. Tongco, AVP/Plant Manager, SN Aboitiz, requesting
Certification attesting that the [i] Order and [ii] Notice of Public Hearing were duly posted at
the bulletin board of the Sangguniang Panlungsod, re: SN Aboitiz Power-Benguet
(ERC Case No. 2019-014 RC).The letter was approved for posting during the regular session
on 03 June 2019 and a certification was also posted in the Sangguniang Panlungsod bulletin
board on 04 June 2019; and

The Committe on Barangay Affairs recommends FAVORABLE REVIEW the

Letter dated 11 October 2019 of Atty. Leticia O. Clemente, City Budget Officer to the
Honorable Members of the Sangguniang Panlungsod, submitting the Proposed Annual
Budget for Calendar Year 2020 in the amount of Two Billion Two Hundred Thirty
Million Pesos (Php2,230,000,000.00).
(NOTE: SECTION 319. Legislative Authorization of the Budget reads, "On or before the end of
the current fiscal year, the Sanggunian concerned shall enact, through an ordinance, the
annual budget of the local government unit for the ensuing fiscal year on the basis of the
estimates of income and expenditures submitted by the local chief executive.")

The Committee on Appropriations and Finance Cluster A (Budget, Appropriations


and Expenditures) recommends APPROVAL of the INCOME portion of the
proposed annual budget for Calendar Year 2020 amounting to Php2,230,000,000.00.

37. Committee Report Nr. LAWS-2019-042


Ordinance No. 04, series of 2019 of Santo Rosario Valley Barangay entitled "An
ordinance declaring all Communist-Terrorist Groups (CTGs) as 'Persona-Non-Grata' in
Santo Rosario Valley Barangay".
The Committee on Laws, Human Rights and Justice acknowledges the noble
intention of the Barangay Ordinance which is to maintain peace and order in the
Barangay. What is noteworthy is the strategy of
"x x x x x
d. Taking appropriate and immediate actions to prevent or stop the spread of rebel
recruitments, specially in the youth."
The groups to be banned are indicated in Barangay Resolution No. 30-2019. The
records also show that the Ordinance was presented and approved at the general
assembly held on October 19, 2019.

In view thereof, this Committee recommends FAVORABLE REVIEW of said
Ordinance. The Barangay, however, is advised to coordinate with the proper
concerned offices/agency before implementing said Ordinance.

Letter dated 09 October 2019 of Maralyn Caoili Quero, regarding the vindictive and
grave abuse of authority committed by Kag. Lolita V. Ariola, of City Camp Proper
Barangay.
(NOTE: [a] The above case is docketed as Barangay Administrative Case No. 018-2019; and
[b]Resolution Nr. 290 series of 2017 REVISED THE RULES ON RECEIVING, DOCKETING,
AND ASSIGNING OF BARANGAY ADMINISTRATIVE CASES FILED AGAINST
BARANGAY OFFICIALS OF THE CITY OF BAGUIO.)

A review of the submitted documents will show that the letter was addressed to
Ms. Evelyn B. Trinidad, City Director of the DILG-CAR. The Sangguniang
Panlungsod was only copy furnished a copy of said letter and the Division cannot
assume the intention of the proponent by just furnishing the City Council a copy of
said complaint.
In case the complainant would want to pursue a formal administrative complaint
with this office, the complainant should comply with the requirements set forth
under Ordinance Number 100-2009, specifically Section 2 which states:
"SECTION 2. Form and Filing of Administrative Complaints.-
A verified complaint against any erring barangay official shall be filed
before the Sangguniang Panlungsod ng Baguio."
Thus, Division I on Barangay Administrative Cases recommends that the above
cited letter be NOTED without prejudice to any action or step the complainant may
take in the future.
