WHEREAS, Section 122, Article G, Chapter IV of City Ordinance No. 01, Series of 1996,
otherwise known as the 1996 Revenue Code of General Santos City reads: The fees herein
prescribed shall be paid before any business or occupation can be lawfully began or pursued and
renewable every year thereafter within the first twenty (20) days of January; xxx

WHEREAS, it IS administratiVely improbable for the aty Health Office to iSsue the atmost
70,000 health certificates in the first twenty days of January of every year as prescribed in the
GSC Revenue Code, hence, the need to decongest the health card issuance process;

WHEREAS, RA 110321, otherwise known as An Act Promoting Ease of Doing Business and
Efficient Delivery of Government service Amending for the Purpose Republic No. g4S·S,otherwise
known as the Anti-Red Tape Act of 2007, and for other Purposes, states in Section 11 (e):
Business permits shall be valid for a period of one year. The city/municipality may have the option
to renew business permits within the first month of the year or on the anniversary date of the
issuance of the business permit;
NOW, THEREFORE, on motion of City Councilor Ramon R. Melliza, duly seconded by City
Councilors Jose Orlando R. Acharon, Lucio D. Cawayan, Sr., John Salvador D. Demdam,
Dominador S. Lagare, Jr., and Rosalita T. Nunez, be it-

RESOLVED,as it is hereby resolved, to enact this Ordinance.

AN ORDINANCE AMENDING SECTION 122, ARTICLE G, CHAPTER IV OF CITY


ORDINANCE NO. 01, SERIES OF 1996, OTHERWISE KNOWN AS THE 1996
REVENUE CODE OF THE CITY OF GENERAL SANTOS, SO AS TO ADOPT SOME
CHANGESIN THE TIME OF PAYMENT

Section 1. Section 122, Article G, Chapter IV of City Ordinance No. 01, Series of 1996,
otherwise known as the 1996 Revenue Code of General Santos City is hereby amended to
read as:

Section 1.22. Time of Payment, Surcharge, and Interest. The health


certificate and its official receipt shall be valid and effective for one year and shall
be renewable on the anniversary date of its issuance.

Health certificates issued in the year 2018 shall be effective until the
birthday of the holder in 2019. Henceforth, in the ensuing year, the anniversary
date shall be on the issuance date of the health certificate.

In case of failure to pay the fee herein imposed within the time prescribed,
the fee shall be increased by 25% of the original amount due, such surcharge shall
be paid at the same manner as the fee.

In addition to the surcharge imposed herein, there shall be imposed an


interest upon the unpaid amount at the rate of twenty-four percent (24%) per
annum from the due date until the fee is fully paid, but in no case the interest on
the unpaid amount or portion thereof shall exceed three (3) years.

Section 2. Repealing Clause. All Ordinances or any part thereof, which are contrary to
or inconsistent with any provision of this Ordinance are hereby repealed or amended
accordingly.

Section 3. Separability Clause. If for any reason, any section or provision of this
Ordinance shall be declared unconstitutional or invalid, the other provisions not declared and
not affected by such declaration shall remain in full force and effect.

Section 4. Effectivity Clause. - As provided for under Section 188 of the Local
Government Code of 1991, this Ordinance shall take effect immediately after its publication in
full for three (3) consecutive days in a newspaper of general circulation within the city.

Enacted by the 18th Sangguniang Panlungsod, City of General Santos, on its 3rd
Special Sessionheld on December 20, 2018.
