B. RESULTS OF INITIAL TECHNICAL REVIEW/EVALUATION:

Initial review of the documents showed:

The request is not among the technical evaluation tasks specified under Section
IV.2.f, COA Memorandum No. 2009-074 dated July 23, 2009;


There is no categorical statement on the results of the legal and auditorial review
that the contract is legally and auditorially in order and not disadvantageous to the
government contrary to -

Section II of COA Memorandum 2005-027 dated February 28, 2005 stating


among others that-

“The review of the legal aspects of the contracts subject to post audit is
made by the Auditors concerned before review/evaluation of the
technical aspect is done to ensure that the contract is in order with
respect to the legal aspect”.

Section 3.1.4 of COA Circular No. 2009-001 dated February 12, 2009 stating
among others that-

“The auditorial review shall consist in the evaluation of compliance


with the requirements of applicable laws, rules and regulations,
completeness of documentary requirements and an initial evaluation
that the contractual covenants are not disadvantageous to the
government”.

Section I of COA Memorandum No. 91-704 dated February 27, 1991 stating among
others that –

“Review of the technical aspects of the contract would be an exercise in futility


if the contract or any part thereof is auditorially or legally objectionable”.
