    MANIFESTATION

    The undersigned counsel for the accused and unto this


    Honorable Court most respectfully manifests:

    That the herein counsel would like to inform this Honorable


    Court that ROCHELLE PERDIZ the accused in this case already died
    on September 2, 2015 as duly proven by the Certified True Copy of
    her Death Certificate which is hereto attached and marked as
    ANNEX “1”.

    That said accused was not yet arraigned and under the
    Revised Penal Code, particularly article 89 paragraph 1, states that:

    “Art. 89. How criminal liability is totally


    extinguished.

    1. By the death of the convict, as to the personal


    penalties; and as to pecuniary penalties,
    liability therefore is extinguished only when
    the death of the offender occurs before final
    judgment;

    Xxx”

    2. With the foregoing view, counsel prays for the dismissal


    of the case.
