AN ORDINANCE CREATING THE LOCAL LEGISLATIVE–EXECUTIVE

DEVELOPMENT ADVISORY COUNCIL (LLEDAC) IN THE PROVINCE OF DAVAO
DE ORO
EXPLANATORY NOTE
The Province of Davao de Oro aims for an effective local public policy
formulation and this requires cooperation and partnership between the Executive
Department and the Legislative Department.
Pursuant to Republic Act 7640 otherwise known as “An Act constituting the l
Legislative-Executive Development Advisory Council (LEDAC)”, it is the policy of the State
to formulate after consultations with appropriate public agencies, the private sector, and local
government units socioeconomic development programs taking into account the requirements of
conservation and ecology and in accordance with its constitutional mandate to promote a more
equitable distribution of opportunities, income, and wealth; a sustained increase in the amount of
goods and services produced by the nation for the benefit of the people; an expanding
productivity as the key to raising the quality of life for all, especially the under privileged.
In order to institutionalize regular coordination, collaboration and cooperation among the

Local Chief Executive, the Sangguniang Panlalawigan and various offices under them in all
areas of local governance including but not limited to: formulation of the local development
plan, formulation of the Executive-Legislative Agenda (ELA), policy formulation,
implementation and evaluation, service delivery and public consultation, a Local Legislative-
Executive Development Advisory Council (LLEDAC) is hereby created to support the
implementation of socio-economic developments in the Province and to constitute an effective
advisory and consultative mechanism to ensure consistency in coordinating executive and
legislative development planning.
AN ORDINANCE CREATING THE LOCAL LEGISLATIVE–EXECUTIVE

DEVELOPMENT ADVISORY COUNCIL (LLEDAC) IN THE PROVINCE OF DAVAO
DE ORO
Be it ordained by the 8th Sangguniang Panlalawigan of the Province of Davao de

Oro in its Regular Session that:

SECTION 1. TITLE – This ordinance shall be known as the “Local Legislative-
Executive Development Advisory Council in the Province of Davao de Oro and
Appropriating Funds Thereof”.
SECTION 2. DECLARATION OF POLICY – It shall be the policy of the

Provincial Government of Davao de Oro to establish unified and harmonized measures
or mechanisms for public welfare and socio-economic progress.
SECTION 3. DEFINITION OF TERMS – As used in this Ordinance, the following

words and phrases shall mean:
a. Executive – refers to the branch of the government vested with the power to
execute, implement laws, rules and regulations and to manage, control
programs, projects and activities.
b. Legislative – refers to the branch of government vested with the power to

make laws, alter and repeal them.
c. Policy – refers to a rule for action, manifesting or classifying specific
organization goals, objectives, values or ideas and often prescribing the
obligatory or most desirable ways and means for their accomplishment.
d. Offices – refers to positions conferred by an exercise of governmental
authority and are grouped primarily on the basis of major functions to achieve
simplicity, economy and efficiency on government operations and minimize
duplication and overlapping of activities.
e. Ordinance – refers to a law or decree established by authority for local
application
f. Council – refers to an assembly convened for consultation, deliberation and
advice.
g. Advisory – refers to having the power and authority to provide advice
SECTION 4. CREATION AND COMPOSITION OF LOCAL LEGISLATIVE-

EXECUTIVE DEVELOPMENT ADVISORY COUNCIL (LLEDAC) – The Provincial
LLEDAC shall be created and composed of the following:
Chairperson - Governor
Vice-Chairperson - Vice Governor
Members - All SP Members
Department Heads of the Provincial Government
AFP – Philippine Army
PNP – Davao de Oro Police Provincial Office
DILG – Davao de Oro
One (1) Civil Society Organization Representative
SECTION 5. DUTIES AND FUNCTIONS OF THE LLEDAC – The LLEDAC shall

have the following duties and functions:
a. To determine and recommend socioeconomic development goals in pursuance

of established policies which shall guide the formulation and implementation of
the Provincial Development Plan;
b. To assess the effectiveness of implementation of the Provincial Development

Plan;
c. To recommend to the Executive Department appropriate and necessary

measures requiring enactment by the Sangguniang Panlalawigan;
d. To regularly review the Executive-Legislative Agenda, update and prioritize to

attune to the needs of the changing socio-economic and political order;

e. To receive, and in appropriate cases, require reports on, and study measures to
improve, the implementation of official development assistance from multilateral
and bilateral entities;
f. To monitor the implementation by the Executive Department of all resolutions

and ordinances approved by the Sangguniang Panlalawigan;
g. To assess the effect or impact or approved measures and/or policies on the

citizens of Davao de Oro and concerned sectors;
h. To recommend legislative measures to the Sangguniang Panlalawigan for

legislation;
i. To study and recommend to the Executive and Legislative, sources of revenue as well
as measures to reduce unnecessary expenditures to the end that the resources of the
Province of Davao de Oro will be used to the optimum;
j. To enjoin all government offices, civil society and private sectors to converge and create
joint efforts in the pursuit of programs, projects and activities aimed at alleviating the
quality of life of the constituents of the Province; and
k. To perform other duties and functions as maybe necessary or prescribed by law,

ordinances or issuances.
SECTION 6. CREATION AND COMPOSITION OF THE SECRETARIAT – A

Secretariat shall be created and composed of the following:
- Provincial Administrator
- Provincial Planning and Development Coordinator
- Secretary to the Sangguniang Panlalawigan
SECTION 7. FUNCTIONS OF THE SECRETARIAT – The Secretariat shall have

the following functions:
a. Responsible in keeping records of the council;

b. In charge of informing all members in the schedule of meetings, trainings, and
other similar activities;
c. In charge of recording the minutes of the council and prepare communications
addressed to clients and others concerned.
The implementation of this Ordinance shall continue to be in force and in effect

until lifted or revoked by the Provincial Governor or the Local Chief Executive.
SECTION 8. MEETINGS – The Council shall meet at least once a year after the
delivery of the State of the Province Address (SOPA) of the Governor to discuss on the
progress and actions taken on priority concerns.
SECTION 9. APPROPRIATIONS – The Provincial Government shall set aside

reasonable allocation as initial funding to ensure functionality of LLEDAC in the
performance of its duties and functions.
SECTION 9. DISSEMINATION – Let copies of this ordinance be posted in

conspicuous places in the Provincial Capitol, Municipal Halls, Barangay Halls, other
public places and also in tri-media (television, radio, and social media) and newspaper
of general circulation by the Provincial and Municipal Information Office.

SECTION 10. SEPARABILITY CLAUSE – If for any reason, any section or
provision of this Ordinance is declared unconstitutional or invalid by a competent court,
the remaining sections or provisions not affected hereby shall continue to be in full force
and effect.
SECTION 11. REPEALING CLAUSE – All Ordinances are hereby repealed or

amended accordingly including all resolutions, rules or regulations inconsistent with or
contrary to the provisions of this Ordinance.
SECTION 12. EFFECTIVITY – This ordinance shall take effect immediately after
publication.
