An Act to establish the Chhattisgarh Fire and Emergency Service, to lay dorvn the polvers and
functions of the Service and to provide for matters connected therewith and incidental thereto.

CHAPTER _ I
PRELIMINARY
(l) This Act may be cxlled the Chhattisgarh Fire and Emergency Service Short title, e)(tent
Act,2018. and
commencement.
(2) It extends to the whole State ofChhattisgarh.
(j) It shall come into force in any area on such date as the State
Govemment, may by notification in the Official Gazette, appoint and
diflerent dates may be appointed for different areas and for dillerent
provisions of this Act.
(28) "Local Fire and Emergency Services" means Local Fire and
Emergency Services ofany Local Authority ofthe State;

ORGANIZATION, SUPERINTENDENCE, CONTROL AND
MAINTENANCE OF THE FIRE AND EMERGENCY SERVICE
(1) There shall be one Fire and Emergency Service for the one Fire and Emergency

9. (1) 'Ihe Government may constitute Fire Divisions and Fire Constitution of Fire
Districts within the state. Divisions, Fire Districts,
Fire Sub-Divisions and
Fire Stations.
(2) The Govemment may divide such Fire Districts into Fire
Sub-Divisions as deemed necessary and specify the Fire
Stations in each Fire Division, Fire District and Fire Sub-
Division respectively.
(j) The Covernment may modily the limits and extent of such
Fire Divisions, Fire Districts, Fire Srtb-Divisions and Fire
Stations, as may be necessary for administrative and
operational effi ciency.
10. (l) Every Fire Officer belorv the rank of Station F-ire Otficer lssue of Certificate

(2) l hereupon, such person shall have the powers, lunctions and
privileges as entrusted under this Act or rules and orders
made thereunder.
(3) A cenilicate shall become null and void, when the person
named therein ceases to belong to the Fire and Emergency
Service or shall remain inoperative during the period such
person is suspended from the Fire and Energency Service.

Role of Volunteers in tht I :1. (t) ln order to encourage public participation in the Fire and
Fire and EmergencY Emergency Selvices, the Director General may enroll

as may be prescribed by the Government,

LEVY OF FIRE'IAX, FEE AND OTTIER CHARGES
Levy of Fire Tax. 26. The Govemment nray levy a Fire Tax (not more than l07o of
the annual property tax) on lands and buildings which are
situated in any area in which this Act is in force and on
rvhich propeny tax by rvhatever name called is levied by any
Local Authority in that area and this shall be levied and
collected as prescribed.
Mode of assessment, 2'1 . (l) The authorities empowered to assess, collect and enforce
collection, etc. of Fire Tax, payment of property tax under the Ia!v authorizing the Local
Authority of the area to levy such tax shall, on behalf of the
Covemment and subject to any rules made under this Act,
assess, collect and enforce payment of the Firc Tax in the
sarne manner as the property tax is assessed, paid and
collected; and for this purpose. they may exercise all or any
of the por'vers they have under the larv aforesaid and the
provisions of such larv including provisions relating to
retums, appeals, reviervs, reference and penalties shall apply
accordingly.
(2) The proceeds of the Fire Tax collected under this Act, shall
be paid to the Government in such manner and at such
intervals as may be prescribed.
Constitution of fund. 28. (t) There shall be constitLrted a fund to be known as the "Fire
Prevention and Life Safety Fund".
(2) The proceeds of fire fees, charges and penalties, other than
fines, recovered under th.is Act, shall be credited to this fund.
(4) Fees for services render by the Fire and Emergency Service
for issuing a no objection cenificate, conducting a fire audit
and any other fire service shall be charged as a fee in the
manner as nray be prescribed by Covernment and credited to
this fund.
Fee on deployment of Fire 29. (l) Where members ol the Fire and Emergency Service are sent
and Emergbncy Service beyond the limits of any alea in which this Act is in tbrce, in
beyond the limits of the order to extinguish a fire in the neighborhood of such limits

Penalties for violation of 35. Whoever contravenes any provisions of this Chapter shall,

MISCELLANEOUS
Deployment to other arca. 36' The Director Ceneral or any Fire Officer authorized by the
Government in this behalf may, on the occasion of a fire or
other emergency in any neighboring area in which this Act is
not in force, order the dispatch of the members of the Fire
and Emergency Service ryith necessary appliances and
equipment to carry out fire fighting operations in such
neighboring area and thereupon, all the provisions of this
Act and the rules made thereunder, shall apply to such areas
during the period of fire emergency or durine such period as
the Director Ceneral rnay specify on such charges as may be
prescribed from time to time.

(6) The powers ofthe Director General under this Section may
be exercised by any Fire Officer authorized by the
Covernment.

laid as soon as may be, before the House ofthe Legislative
Assembly while it is in session for a total period of thirty
dals which may be comprised in one session or in tro or
more successive sessions, and if, before the expiry of the
session immediately following the session or the successive
sessions albresaid, the House of the Legislative Assembly
agrees in making any modifications in the rule or the House
of the Legislative Assembly agrees that the rule should not
be made, the rule shall thereafter have etfect only in such
modified form or be of no eff'ect, as the case may be; so,
horvever, that any such modification or annulment shall be
without prejudice to the validity ofanything previously done
under that rule.
Delegation of powers. 66. (l) The Government or the Director Ceneral or any Fire Officer
may, direct that any power exercisable by it under this Act
shall, subject to such conditions, if any, as may be specified
in the notification, be exercisable by any of the officers of
the Government or by the. Director Ceneral or by any Fire
Officer.
(l) The Director General may, by order, direct that any polyer
conferred or any duty imposed on him by or under this Act
shall, in such circumstances and under such conditions, il
any, as may be specified in the order, be exercised and
performed also by any officer of the Fire and Ernergency
Service specified in the order.
Power to remove 61. (l) lfany difficulty arises in giving etTect to the provisions of
Difficulties. this Act, the Government rnay, by an order published in the
Official Gazette, make such provisions not inconsistent with
the provisions ofthis Act, as ma), appear to it to be necessary
or expedient for removing the difflculty.
(:) Every order made under this Section shall be laid, as soon as
may be after it is issued, before the Legislative Assernbly of
State.
