An Act to establish the Chhattisgarh Fire and Emergency Service, to lay dorvn the polvers and
functions of the Service and to provide for matters connected therewith and incidental thereto.

CHAPTER _ I
PRELIMINARY

(l) This Act may be cxlled the Chhattisgarh Fire and Emergency Service Short title, e)(tent
Act,2018. and
commencement.
(2) It extends to the whole State ofChhattisgarh.

(j) It shall come into force in any area on such date as the State
Govemment, may by notification in the Official Gazette, appoint and
diflerent dates may be appointed for different areas and for dillerent
provisions of this Act.

2. In thi' Act. unless Lhe conlert otherrvise requires.- Definitions.

(1) "Additional District Magistrate" means an officer of the


Government appointed as Additional District Magistrate
under sub-section (2) of Section 20 of the Code of Criminal
Procedure, 1973 (2 of 1974);

(2) "Appellate Authority" means an Officer two ranks aboye the


o{Icers nominated by the Competent Authority as per
prescribed rules;

(3) "Appropriate Judicial Authority" means Authority having


Jurisdiction to deal with matters related to prosecution:

(4) "Builcling" includes a high-rise building, house, outhouse,


stable, godown, shed, hut, wall(other than a houndarv
wall). 1'encing, platforrn and any other structure whether of
masonry, bricks, rvood, mud, metal or of any other material
whatsoever:

(5) "Building bye-lar.vs" rneans the bve-larvs, rules or regulations


under any relevant municipal laws and includes Bhumi Vikas
Niyam 1984, the development control rules or any other
building rules or regulations made under any other lau, for the
time being in lorce and are in operation;

(6) "Director Ceneral" means the Director Ceneral of Fire and


Emergency Services appointed uoder Section 8 ol this Act;

(1) 'Disaster" means a catasttophe, mishap, calamity or grave


occllrrence in any area, arising from natural or man-made
causes, or by accident or negligence, r,vhich resLrlts in
substantial loss ol ljti or human suff'eling or darnage to and
destruction of propel1y. or damage to or degradation of
environment, and is of such a nature or magnitude as kr be
beyond the coping capacity of the conlmunity of the affected
area as deflned in Disaster Managernent Act, 2005 (No.5.3 of

(8) "District Fire Officer" is a person appointed under sub-section


(4) of Section 9 ofthis Act;

(e) "District Magistrate" means an officer of the Covernment


appointed as Distriot Magistrate under sub-section (l) of
Section 20 of the Code of Criminal Procedure, 1973 (2 of
197 4)l

( 10) "Divisional Fire Officer" is a person appointed under sub-


section (4) ofSection 9 ofthis Act;

(1 l) "Emergency" lneans any serious situation or occurrence that


happens unexpectedly and demands inmediate action of the
Fire and Emergency Services;

( 12) "Emergency Services" means evacuation, rescue and relief in


any disaster;

( 13) "Erector ofpandal" means a person or association of persons,


whether corporate or otherwise, who erects or makes a pandal
or any structure for occupation of people on a regular or
temporary basis;

( 14) "Fire and Emergency Services" means the Fire and


Emergency Services established in the State by the
Govemment under Section 3 ofthis Act:

(15) "Fire Districts" means an administative unit constituted


under sub-section (1) ofSection 9 ofthis Act;

(16) "Fire Divisions" means an administrative unit constituted


under sub-section (1) ofSection 9 ofthis Act;

(17) "Fire Fees" means any fee levied, charged, imposed or


collected under different provisions of this Act for services
rendered by the Fire and Emergency Services;

( t8) "Fire fighting property" means and includes,-


(a) Lands and buildings used as fire stations;
(b) Fire engines, equipments, tools, implements and
whatsoever used for fire fighting;
(c) Motor vehicies and other means of transport used in
connection with fire fighting; and
(d) Uniforms and badges ofrank.
(19) "Fire Officer" means any operational member of the Fire and
Emergency Services appointed under sub-section (l) of
Section 7 ofthis Acti

(20) "Fire Prevention and Life Safety Fund" is a fund constituted


under sub-section (l) ofSection 28 of this Act and maintained
in a sepamte bank account;

(2 t) "Fire prevention and Life safety measures" means such


measures as are necessary r'n accordance with the Building
bye-laws/National Building Code of lndia lor the
containment, control and extinguishing of fire and for
ensuring the safety of lif'e and property in case of fire or as
may be prescribed in the rules made in this behalf;

(22) "Fire Station" means any place declared generally or


specially, by the State Coyemment to be a fire station;

(23) "Fire Sub-Divisions" means an administrative unit constituted


under Section 9 ofthis Act;

(24) "Fire Tax" is a Tax levied by the Government on such land


and buildings as specified in this behalf in Section 26 of this
Act;

(25) "Form" means a form prescribed under this Act;

(26) "Government" means the Covemment of Chhattisgarh;

(2',7) "Local Authority" means a Municipal Corporation or a


Municipal Council or a Nagar Panchayat or an Industrial
Township constituted under any relevant municipal law or a
Town & Country Planning Development Authority or Special
Area Development Authority Constituted under Chhattisgarh
Town & Country Planning Act,1973 for the time being in
force in the State;

(28) "Local Fire and Emergency Services" means Local Fire and
Emergency Services ofany Local Authority ofthe State;

(2e) "Member" in relation to the Fire and Emergency Services


means a penon appointed to the Pire and Emergency Services
under this AcU

(30) "Member of Service" means any person appointed under


Section 7 ofthis Act;

(31) "Multi-storey building" means a building with such minimum


height as may be prescribed under the rules in this behalf, and
notified by the Local Authority or the Govemmentl

(32) "Natiooal Building Code of India, 2016" means the book as


amended ftom time to time, containing fire prevention and
life safety measures to be implemented in buildings, places,
premises, workshops, warehouses and industries, published
by the Bureau ol Indian Standards from time to time, \Yith or
without amendments;

(JJ' "Nominated Authority" means an omcer not below the rank


of District Fire Officer nominated by the Director General as
a nonlinated authority for the purposes ofthis Act;

(i4) "Nominated Officer" means an officer not bellow the rank ol


District Fire Officer nominated by the Director General for
the purpose ofthis Act:
. , Provided that, different officers may be nominated for
direrent areas;

(35) "Notification" means a notification published in the Official


Gazette and the word "notified" shall be construed
accordingly;

(36) "Occupancy" means the principal occupancy for which a


building or a pad of the building is used or intended to be
used includin! subsidiary occupancies which are contingent
upon it;

(37) "Occupier" shall mean and include,-


(a) any person who for the time being is paying or is
liable to pay to the ou4ler, the rent or any portion of
the rent of the land or building in respect of which
such rint i5 paid or payable:
(b) an owner in occupation ofor otherwise using his land
or building;
(c) a rent-free tenant ofany land or building;
(d) a licensee in occupation ofany land or building; and
(e) any personr who is liable to pay to the building
owner damages for the use and occupation of any
land or building;

(38) "Officer-in-charge of Fire Station" includes, when the


Officer-in-charge of the fire station is absent ffom the station
or unable fiom illness or other cause to perform his duties, the
Fire Officer next in rank to such oflcer and present at the
station;

(3e) "Offrcial Gazette" is the Gazette of the Govemment of


Chhattisgarh;

(40) "Operational Member" of the Fire and Emergency Services


means any member ofthe Fire and Emergency Services, who
is required to drive or operate a fire fighting vehicle,
firefighting equipment and appliances at the site of fire and
participate in the actual extinction offire;

(41) "OwneC' includes a person who, for the time being, is


receiving or is entitled to receive, the rent of any land or
building, whether on his own account or as an agent, tustee,
guardian or receiver or any other pe6on, who should
receive the rent or be entitled to receive it if the land or
building or part thereolwere let out to a tenanti

(42) "Pandal" means a temporary structure with a roof or walls


made of sbaw, hay, ulughass, golpatta, hogla durina, mat,
canvas, cloth or other like material which is not adopted for
permanenl or continuous occupancy:

(43) "Planning Authority" means any authority nominated by the


State Govemment for the determined specified area notified
under Chhattisgarh Town & Country Planning Act, 1973 (No.
23 of 1973),

(44) "Prernises" means any land or any building or part of a


building and includes garden, ground and outhouse, if any,
appertaining to a building or part of a building; and any land
or any building or part of a building appurtenant thereto,
which is used for storing explosives, explosive substances and
dangerously infl ammable substances:

have the same meaning as respectively assigned to them in
the Explosive Act, 1884 (4 of 1884), the Explosive
(Substances) Act, 1908 (6 of 1908) and the lnflammable
Substances Act, 1952 (20 of 1952)',

(45) "Prescribed" means prescribed by rules made by the State

Government under this Act;

(46) "Prescribed Authority" is the authority notifled by the State


Covernment to act in some matters on its behalf or in its
name;

(47) "Relevant Nhroicipal Law" means any law framed by a


Municipal Corporation or a Municipal Councilr

(48) "Rujes" means rules made under this Act;

(4e) "Schedule" means a Schedule appended to this Act;

(50) "Service" means the Chhattisgarh Fire and Emergency


Services established and maintained under this Act:

(s l) "State" means the State ofChhattisgarh;

/s)l "State Rules" means rules made under Article 309 of the
Constitution oflndia by the State Govemment:

(s3) "Station Fire Officer" is a person appointed under sub-section


4 ofSection 9 ofthis Act;

(s4) "Sub Divisional Magisbate" means an olficer of the


Covernment appointed as Sub Divisional Magistrate under
Sub-Section (4) of Section 20 of the Code of Criminal
Procedure, 1973 (2 of 1974);

(s s) "Subordinate Operational Staft" includes every member of


&e Fire and Emergency Service of the rank of hreman,
leading fireman, driver and any other equivalent rank.

CHAPTER II
ORGANIZATION, SUPERINTENDENCE, CONTROL AND
MAINTENANCE OF THE FIRE AND EMERGENCY SERVICE

(1) There shall be one Fire and Emergency Service for the one Fire and Emergency
whole of the State and all offiiers and subordinate ranks ol Service for the whole of the

Provided that, the Govemment may, by notification in


the Official Gazette, declare any Fire Brigade or any other
local Fire Brigade or any other local Fire and Emergency
Services of any local authority of the State, by whatever
name called, that the same shall form or shall not folm the
paft ofthe State Fire and Emergency Services at any time:

Provided funher that this position shall not apply to


the private Fire and Emergency Services maintained for
proVihing flre prolection coverage to a specific building or
industry by the owner or occupier thereof

(2) Notwithstanding anything contained in this Act or any other


law for the time being in force relating to the Local
Authority. the Covernment rnay, by notification in the
Olficial Cazette, declare the services relating to any file
brigade or fire prevention a part of the State Fire and
Emergency Services with efl'ect liom such dates as may be
specified in the notification.

(j) Upon such declaration under the sub-section (2),

(D all proceedings pending before any File Officer,


immediately before the declaration, shall be deemed to be a
proceeding pending betbre him in his capacity as the holder
ofthe office-

(iD all assets, rights and liabilities relating to the Local Fire and
Emergency Services of such Local Authorities shall stand
transfened to the State Fire and Emergency Services, subject
to such terms and conditions as the Covernment may deem
fit;

(iii) The Government may take such other necessary aclions as it


deems fit.

Auxiliary Fire and 4. Whenever it appears to the Goyemment that it is necessary


Emergency Service. to augment the Fire and Emergency Service, they may raise
an auxiliary service by enrolment of volunteers for such area
and on such terms and conditions as per rules.

Creation of Fire Stations, 5. The Government shall create Fire Divisions, Fire Districts,
Fire Sub-Divisions and Fire Stations so as necessary, to
increase the reach ofthe Fire and Emergency Services up to
rural areas.

Superintendence of Fire 6. The superintendence of and control over the Fire and

different posts ofthe Fire and Emergency Service;

the mode of recruitment of staff, grade of post,


qualifications, pay, allowances and other conditions of
service of the officers and other staff engaged therein and

matters connected therewith.

Appointmert of Director 8. (t) The Fire and Emergency Services shall work under the
General of Fire and direction and supervision ofthe State Government. The State
Emergency Service. Government shall appoint a Director General, who shall
exercise such powers and pertbrm such duties and other
functions as are specified by or under this Act and such
Director General shall be deemed to be a Fire Officer.

(t) The Govefnn]ent may appoint or cost to appoint such other


olflcers and staff as ma), be necessary from tinre to time to
assist the Dilector Ceneral rvhile exercising the powers or
discharging the duties or functions conferred under this Act
or the rules made thereunder.

(j) The jurisdiction of the Director Ceneral so appointed, shall


extend to the entire State in matters relating to the Fire and
Emergency Services.

(4) Subject to the control, directions and superintendence ofthe


Covemment. the Dilector Ceneral shall exercise such
porvers and pelform such duties as are confened and
imposed upon him by this Act or the rules made thereunder.

9. (1) 'Ihe Government may constitute Fire Divisions and Fire Constitution of Fire
Districts within the state. Divisions, Fire Districts,
Fire Sub-Divisions and
Fire Stations.

(2) The Govemment may divide such Fire Districts into Fire
Sub-Divisions as deemed necessary and specify the Fire
Stations in each Fire Division, Fire District and Fire Sub-
Division respectively.

(j) The Covernment may modily the limits and extent of such
Fire Divisions, Fire Districts, Fire Srtb-Divisions and Fire
Stations, as may be necessary for administrative and
operational effi ciency.

(4) (D The Govemment may appoint or cost to appoint for each,-


(a) Fire Division, a person as the Divisional Fire Oflficer;
(b) Fire Distlict, a person as the District Fire Officer;
(c) Fire Station, a person as the Station Fire Officer.
( ii) The qlralilications for appointment and other tenns and
conditions of service of the Fire Officer, appointed under
this sub-section shall be such as may be prescribed.
(iiD The Coyernment may, by an order, dilect a Local Authority
or any other authority, as the case may be, to appoint a
person to be the Fire Officer.

(5) (i) Subject to the control, direction and superintendence of the


Director General, Fire Offlcers appointed under sub-section
(4), shall exercise such powers and pertbrm such duties as
are conferred and imposed upon him by this Act or rules or
orders made tlrereunder.
( ii) Without prejudice to the provisions of the above clause, in
case olfire prevention and disaster, as the case may be, the
Fire Officer shall. for their jurisdiction, in case of any fire or
ernergency, act as Commanding Officer for that event and all
other local or private Fire and Enrergency Services engaged

(2) l hereupon, such person shall have the powers, lunctions and
privileges as entrusted under this Act or rules and orders
made thereunder.

(3) A cenilicate shall become null and void, when the person
named therein ceases to belong to the Fire and Emergency
Service or shall remain inoperative during the period such
person is suspended from the Fire and Energency Service.

Effect of susPension of Fire ll. The porvers, functions and privileges vested in a Fire Officer
officer. shall rernain suspended rvhile such Fire Officer is under
suspension iiom offlce:

Provided that notrvithstanding such suspension, such


person shall nor cease to be a Fire O{ficer and shall continue
to be subject to the control of same authorities to which he
lvould have been ifhe had not been under suspension.

General Porvers of the t2. The Director General shall, subject to the superintendence
Director General. and control of the Government, direct and regulate all
matters of fire safety, firefighting equipment, machinery and
appliances, training, observation of persons and everts,
of larvs, orders
mutual relations, distribution ofduties, study
and modes of proceedings and all matters of executive detail
or the lulfillment ofduties and maintenance ofdiscipline of
Fire Officers and members of the Fire and Emergency
Service under him, as per the state rules. The Director
General shall function as Head of the Department and in
addition to above shall exercise such porvers and perform
such duties and functions as may be conferred, imposed or
allotted to him by or under the provisions of this Act or
prescribed rules.

Role of Volunteers in tht I :1. (t) ln order to encourage public participation in the Fire and
Fire and EmergencY Emergency Selvices, the Director General may enroll
Service. volunteers for such areas and on such terms and conditions

(2) Every nrember enrolled under sub-section (I ) shall,-

(i) receive a certificate in the prescribed forml

( ii) be vested with all or any of the powers, functions and


privileges of a member of the service as are specially
mentioned in the certificate; and

( iii) be subject to the orders of the Director Geneml or an ofticer


norrinated by hirn.

(3) Any organization, institutions. Authority. agency or body, as


specitiedby the Covernment. shall create a group ol
volunteers. rvho will operate in an emergency.

(r) The volunteers shall be trained by the Fire and Emergency


Trainins Center:

FIRE PREVENTION AND SEI,F REGULATION

11. (l) The Governnent may, b) notification in the Offlcial PreYentive Measures.
Gazette, declare any class of premises or buildings or
occLrpancy and pandals, which in its opinion, is likely to
cause a risk of fire.

(2) 'Ihe Government may, by notification in the Official


Cazette, require orvner or occupiers, or both, of premises or
buildings or erectors of pandals, notifled under sub-section
(l), to take such fire prevention and flre safety measures as
rnay be prescribed.

15. (r) Notwithstanding anything contained in this Act, the eiectors Fire Prevention and Fire
of pandals shall be deemed to be self-regulators for taking Safety measures in pandals

sub-section (2) olSection 14.

(2) The erector ofa pandal. shall display at a prominent place in


the pandal a declaration in the prescribed form and under his
own signature, to the etlect that he has taken all the
prescribed fire prevention and firc safety measures therein.

(3) It shall be iawful for the Director Ceneral, nominated


Authority or any other Ofticer authorized by the
Covemment in this behalf, to enter and inspect a pandal with
a view to veri0/ the correctness of the declaration so made
by the erector under sub-section (2) and to point out the
shortcomings, if any, with directions to remove them within
a specified time. [fthe directions ofthe inspecting officer are
not complied with lvithin the time so given, the inspecting
officer shall seal the pandal.

(l) Any erector ol a pandal rvho lalsely declares that he has


complied r,vith the prescribed flre prevention and fire safety
measures in the pandal shall be deemed to have comnlitted
an offence punishable under Section 50 of this Act.

16. (t) Where a notification has been issued under Section 14. it Removal of

(2) On receipt of a report under sub-section (1). thc Sub-


Divisional Magistrate shallgive, by means of a notice served
in such manner as he may think fit, a reasonable opportunity
of showing cause agaiust the removal of encroachrnent or
. objects or goods likely to cause a risl( or obstruction to

firefighting.

(3) After giving the orvner or occupier or erector, as the case


may be, a reasonable opportunity of ntaking a representation
under sub-section (2), the Sub-Divisional Magistrate may
make an order to seize, detain or remove such
encroachments or objects or goods.

(,1) The person charged rvith the execution ofthe order as made
in sub-section (3) shall forthrvith make an inventory of the
objects and goods, rvhich he seizes under such order, and
shall, at the same time, give a written notice as may be
prescribed in this behalt to the person in possession thereol.
at the time of seizure, that the said objects or goods will be
sold as therein mentioned if the same are not claimed within
lhe period,liplllaled in rhe st d norice.
(5) On the failure of the pelson, in whose possession the obiects
or goods rvere at the time of seizule, to claim the seized
goods pursuant to notice given under sub-section (4), the
Sub-Divisional Magistrate shall sell them by public auction.

(6) Any person aggrieved by any notice or order of the Sub-


Divisional Magistrate may, within thirty days from the date
of recaipt o1'such order, prefer an appeal to the Distrjct
Magistrate or an Additional District Magistrate nominated
by him.

(.7) An appeal under sub-section (6) shali be made in such fbrm


and ryith such f'ees as may be prescribed and shall be
accompanied by a copy of the notice or order appealed
against.

(s) An order passed in an appeal under sub-section (7) shall be


final.

Poryers of members of the t7. On the occasion of fire rescue in any area in which this Act

(iv) require the authorily in charge ofwater supply in the area to


regulate the water nrains so as to provide uater at a specifled
pressure at the place where fire has broken out and utilize the
watcr ofany strearn. cistern, well or tank or ofany available
source of water, public or private, lor the puipose of
extinguishing or liniiting the spread ofsuch flre and carrying
oLlt rescLre operalions:

(u) exercise the same powers for dispersing an assembly ol


persons likely to obstruct the firefighting operations, as it
'"vere an offlcer-in-charge ofa police station and as if such
an assembJy rvere an unlarvful assembly and shall be entitled
to the same inrmunities and protections as such oftlcer. in
respect ofthe exercise olsuch porvers;

(vi) arrest a person, who willfully obstructs and hinders a Fire


and Emergency Service personnel in firefighting and rescue
operations and shall hand him over to a police oflicer or at
the nearest police station without delay along a brief

note giving the time, dale and reason ofanest; and

(vii) generally take such measures as may appear to him to be


necessary tbr extinguishing the fire or for the prolection of
life or propefiy, or both.

18. Every owner and occupier or an associatjon of such owners Appointment of Fire Safety

Director Geneml, may be recovered from him by way of
penalty fbr each month ofdefault or pad thereoL

The amount due as penalty under sub-section (2) shall be


recovered as an arrears of land revenue.

(r) Notwithstanding anything contained in any law for the time


being in force, no Authority emporvered to sanction the
consflrction plan ofany building or part ofa building and to
issue certitlcate of completion thereof, shall issue any
cerlitlcate of completion or part completion ftereof', unless it
is satistled that the orvner has complied with the measures
prescribed under sub-section (2) of Section l'1.

(3) 'lhe orvner or occupier, as the case lnay be, of prenlises or


buildings notified under sub-section (2) ol Section 14, shall
furnish to the Director Genet'al, or the Nominated Officer, a
ceftificate regarding the compliance of the prescribed
measures in such form and procedure as may be notified by
the Government.

(4) No person shall tamper with, alter, rerrove or cause any


iniury or damage to any fire prevention and life safety
equipment in any such building or pafi thereof or instigate
any other person to do so.

(s) where a nolitlcation has been issued, under sub-section (2)


of Section 14, it shall be lawful for the Director Ceneral, or
No[rinated Offlcer, to direct the removal of objects or goods
likely to cause the risk of fire, to a place of sat'ety and on
failure by the owner or occupier to do so, the Director
General or Fire Oflicer may, after giving the owner or
occupier a reasonable opportunity of making a
representation, seize, detain or remove such obiects or
goods.

(6) The Director General. or Norninated Officer, while


pertbrrning his duties in fire-fighting operations or any other
duties of seizure, detention or removal of any goods
involving risk offire, may require the assistance ofpolice or
mernbers ofthe police force as an aid in performance ofsuch
duties then it will be the duty of the police of all ranks or
such members to aid the Director General or such fire officer
in the execution oftheir duties under this Act.

CHAPTER IV
CONI'ROL AND DISCIPLINE OF FIRE AND EMERCENCY SERVICE

Calling of returns, reports, 21. l'he Government may call lor such returns, reports or
statcmcnts, etc. statements on any subject connected rvith fire prevention and

23. Without prcjudice to the provisions of any other law on the Declaration of Fire and

(iv) being absent on leave, fails without reasonable cause to


report himself for duty on expiration ofsuch leave; or

(v) accepts any other employment or office engages himself in


business in contravention ofthe provision ofthe rules,

Shall be punishable with imprisonmenl which may extend to


three months or with fine which may extend to an amount
not exceeding three months' pay of such member, or with
both, in addition to any departmental administrative action
he may be subject to.

25. (l) No Member of the Fire and Emergency Service shall, Restrictions respecting

published any book, Ietter or other document except where
such communication or publication is in the bonafide
discharge of his duties or is of a purely literary, artistic or
scientific character.

Explanation.- If any question arises as to whether any


society, institution, association, or organization is of purely
social, technical, recreational or religious nature [nder clause
Il of this sub-section. the decision of the Government
thereon shall be final.

t2) No member of the Fire and Emergency Service shall


participate in, or address, any meeting or take part in any
demonstration organized by anybody or persons for any
political purposes or for such other puryoses as may be
prescribed.

CHAPTER V
LEVY OF FIRE'IAX, FEE AND OTTIER CHARGES

Levy of Fire Tax. 26. The Govemment nray levy a Fire Tax (not more than l07o of
the annual property tax) on lands and buildings which are
situated in any area in which this Act is in force and on
rvhich propeny tax by rvhatever name called is levied by any
Local Authority in that area and this shall be levied and
collected as prescribed.

Mode of assessment, 2'1 . (l) The authorities empowered to assess, collect and enforce
collection, etc. of Fire Tax, payment of property tax under the Ia!v authorizing the Local
Authority of the area to levy such tax shall, on behalf of the
Covemment and subject to any rules made under this Act,
assess, collect and enforce payment of the Firc Tax in the
sarne manner as the property tax is assessed, paid and
collected; and for this purpose. they may exercise all or any
of the por'vers they have under the larv aforesaid and the
provisions of such larv including provisions relating to
retums, appeals, reviervs, reference and penalties shall apply
accordingly.

(2) The proceeds of the Fire Tax collected under this Act, shall
be paid to the Government in such manner and at such
intervals as may be prescribed.

Constitution of fund. 28. (t) There shall be constitLrted a fund to be known as the "Fire
Prevention and Life Safety Fund".

(2) The proceeds of fire fees, charges and penalties, other than
fines, recovered under th.is Act, shall be credited to this fund.

(3) The Covemnlent will formulate rules tbr the operation of


this Fund.

(4) Fees for services render by the Fire and Emergency Service
for issuing a no objection cenificate, conducting a fire audit
and any other fire service shall be charged as a fee in the
manner as nray be prescribed by Covernment and credited to
this fund.

Fee on deployment of Fire 29. (l) Where members ol the Fire and Emergency Service are sent
and Emergbncy Service beyond the limits of any alea in which this Act is in tbrce, in
beyond the limits of the order to extinguish a fire in the neighborhood of such limits
State. on the request of any State Govemment or local body or FiIe
and Emergency Service Authority, they shall be liable to pay
such fee as may be prescribed by the Covernment from time
to time in this behalf.

(l ) lhe t'ee referred to in sub-section (l) shall be payable within


one month of the service of a notice oI demand by the
Directot Gencral or the State Covernrrrent o[ local body or
Fire and Enrergency Service Authority, as the case nray bc,
and if it is not paid r.vithin that period, shall be recoverable as

provided with all possible assistance by the owner or
occupier, as the case may be, oi such place or building or

(j) The owner or occupier or any other person empowered shall


not obstrLrct or cause any obstruction to the entry of a person
emporvered or authorized under this section into or upon any
land or build ing.

(4) Where the inspection is carried or pad by the Nominated


OlJicer under the preceding provision ol this section, he
shall give a repod ofany such inspection to his superior Fire
Officer.

(5) 'fhe Norninated Officer shall. after completion ol the


inspection of the place or building or paft thereof under sub-

part thereof, and issue a notice to the owner or occupier of
such building or pad thereoL directing him to undertake
such rneasures within such time as may be specified in the
notice.

Appeals. 34. (t) Any person aggricved by any notice or order of the
Nominated Authority, issued or made under this Chapter,
may pret'er an appeal against such notice or order to the
Appellate Authority within thirty days from the date of
receipt ofthe notice or older appealed against:

Provided that. the Appellate Authority may cntcrtain an


appeal after the expiry of the said period of thirty days, if he
is satisfied that there was sufficient cause for not tiling it
within that period.

(2) An appeal to the Appellate Authorib/ shall be made in such


fbrm and shall be accompanied by a copy of the notice or
order appeaied against and by such fees as may be
prescribed by the Covernment.

(3) An order ofthe Appellate Authority on an appeal under sub-


section ( l) shall be final.

Penalties for violation of 35. Whoever contravenes any provisions of this Chapter shall,
provisions of Section 33. without prejudice to any other action taken against him
under this Act and rules made thereunder, be punishable
'with imprisonment tbr a term which may extend to six
months, or with fine which may extend to fifty thousand
rupees, or with both and where the offence is a continuing
one rvith a further fine which may extend to thousand rupees
for every day after the first during which such olfence
continues.

CHAPTER VII
MISCELLANEOUS

Deployment to other arca. 36' The Director Ceneral or any Fire Officer authorized by the
Government in this behalf may, on the occasion of a fire or
other emergency in any neighboring area in which this Act is
not in force, order the dispatch of the members of the Fire
and Emergency Service ryith necessary appliances and
equipment to carry out fire fighting operations in such
neighboring area and thereupon, all the provisions of this
Act and the rules made thereunder, shall apply to such areas
during the period of fire emergency or durine such period as
the Director Ceneral rnay specify on such charges as may be
prescribed from time to time.

39. The Director General, or any Nominated Authority may, for Polver to obtain

specified, the available lvater supplies and nreans of access
there-to anv other material particulars, ancl such owner or
occupier shall furnish all the information in his possession.

10. (t) The Nominated Axthority or any Fire Officer authorized by Polver of entrv.
general or special order in this behalf may enter any of the
places specified in any notification issued under sub-section
(2) ol Scction 1.1 ior the purpose of determining whether
prevention and salety measures against fire required to be
taken on such ptace have been so taken.

(2) The Nominated A[thority, or the authofized Fire Officer,


shall atler the completion ofthe inspection ofthe building or
premises under sLrb-section (l), record its views on the
deviations fiom or the contravention of, the notification
issued under sub-section (2) of Section l4 with regard to the
fire prevention and fire salety measures and the inadequacy
of such rneasures provided therein with reference to the
occLrpancy of the building or the nature of activities carried
on in such building or premises and issue a notice to the
orvner or occupier ofsuch building or premises directing him
to undedake such measures as may be specified in the
notice.

(3) The Nominated Authority shall also give a repon of any


inspection made by it under sub-section (l) to the Divisional
Fire Olficer.

(4) Save as otherwise expressly provided in this Act, no claim


shall lie against any person for compensation for any damage
necessarily caused by any entry made under sub-section ( l).

4t. (l) Where, on receipt of a report fi'om the Nominated Authority Pow€r to seal buildings or

that the condition of any building or premises is dangerous

require the person in possession or occupation of such
building or premises to remove themselyes from such

(?) lf an ordel made by the Direclor Ceneral under sub-section


(l) is not complied with. the Director Ceneral may direct any
police officer having jurisdiction in the area to rernove such
persons liom the building or prenrises and such otllcer shall
comply with such directions.

(j) Atter the removal of the persons under sub-section (l) or
sub-section (2), ds the case may be, the Director Ceneral
shall seal the building or premises.

(.1) No person shall renrove such seal except under an order


made by the Director Ceneral.

(5) Any person, who renroves such seal, except Lrnder an order
made by the Director Ceneral shall be punishable rvith
imprisonment for a terr \,vhich may extend to three months,
or with tlne whlch extend to twenty flve thousand rupees, or
,vith both.

(6) The powers ofthe Director General under this Section may
be exercised by any Fire Officer authorized by the
Covernment.

after the institution of prosecution, be compounded by such
ot'ficers of the Fire and Emeryency Service and fbr such
amount as the Government may, by notification in the
Official Cazette, specify in this behalf:
Provided that, no offence shall be compoundable
which is committed by failure to comply with a notice, order
or requisition issued by or on behalfofthe Government or of
any of the ollicers authorized under this Act until the same
has been complied with so lar as the cornpliance is possible.

(2) Where an otfence has been compounded under sub-


sectiol (l), the otl'ender, if in custody, shall be discharged
and no t'urther proceedings shall be taken against him in
respect of such off'ence.

52. Notwithstanding anything contained in any other law or act, Bar ofjurisdiction of

knowledge or that he had exercised all due diligence tct

(l) Notrvithstanding anlthing contained in sub-section (l),


rvhere any oflence under this Act has been committed by a
company and it is proved that the offence has been
committed with the consent or connivance o1'. or is
attributable to any neglect on the part, of any director,
manager, secretary or other officer of the company, such
djrector, manager, secretary or other officer shall also be
deemed to be guilty of that offence and shall be liable to be
proceeded against and punished accordingly.

Explanation.- For the purposes ofthis section -


L 'Company' means a body corpomte and includes a
firm or other association of individuals; and

(3) Every rule made by the Government under this Act shall be
laid as soon as may be, before the House ofthe Legislative
Assembly while it is in session for a total period of thirty
dals which may be comprised in one session or in tro or
more successive sessions, and if, before the expiry of the
session immediately following the session or the successive
sessions albresaid, the House of the Legislative Assembly
agrees in making any modifications in the rule or the House
of the Legislative Assembly agrees that the rule should not
be made, the rule shall thereafter have etfect only in such
modified form or be of no eff'ect, as the case may be; so,
horvever, that any such modification or annulment shall be
without prejudice to the validity ofanything previously done
under that rule.

Delegation of powers. 66. (l) The Government or the Director Ceneral or any Fire Officer
may, direct that any power exercisable by it under this Act
shall, subject to such conditions, if any, as may be specified
in the notification, be exercisable by any of the officers of
the Government or by the. Director Ceneral or by any Fire
Officer.

(l) The Director General may, by order, direct that any polyer
conferred or any duty imposed on him by or under this Act
shall, in such circumstances and under such conditions, il
any, as may be specified in the order, be exercised and
performed also by any officer of the Fire and Ernergency
Service specified in the order.

Power to remove 61. (l) lfany difficulty arises in giving etTect to the provisions of
Difficulties. this Act, the Government rnay, by an order published in the
Official Gazette, make such provisions not inconsistent with
the provisions ofthis Act, as ma), appear to it to be necessary
or expedient for removing the difflculty.

(:) Every order made under this Section shall be laid, as soon as
may be after it is issued, before the Legislative Assernbly of
State.
