Despite the conviction of seven co-defendants, the Supreme Court cited a 71.77%
judicial error rate in capital cases from 1993 to 2004. Later, the Highest Court
allowed post-conviction DNA testing without need of prior court order.
This could have been applied in this controversial case. Had there been a well-
preserved biological sample, it could have led to the reversal of conviction.
2nd option:
After the conviction, the Supreme Court of the Philippines released information in
2004 that cited a 71.77 percent judicial error rate in capital cases in the period from
1993 to 2004, when capital punishment was still legal -- a percentage determined by
the total number of death convictions that had been either reversed or pardoned.
Thus, we adhere: Lessons from the past may not always ward off doom, but
they can provide insights into the present, and even the future.
3rd option:
Until now, it is still puzzling that a case, involving abduction, rape and murder, did not
consider full appreciation of medical evidence. How can there be proof beyond
reasonable doubt when the conviction was built almost entirely on the testimony of
one young man?
4th option:
Just like the Chiong case, there may be thousands in the system who were
wrongfully convicted.
