Agreement Termination

This notice is from a lawyer to Sri Pradip Maity informing him that their client Smt. Mousumi samanta Raul who had rented a shop from Sri Maity and his brother wishes to terminate the rental agreement. The client had deposited Rs. 150,000 as security and had been running a beauty parlor called "Womens Dream" in the shop. However, due to difficulties, the client can no longer continue the business and wants to vacate the premises by September 30th, 2020 as permitted by the two month notice period in the agreement. Under the instruction of my client Smt. Mousumi samanta Raul
W/O- Sri Akash Raul of Rabindranagar, P.O.- Midnapore, P.S.-
Kotwali, Dist- Paschim Medinipur, at present residing at the C/O her
father Sri Sudhansu Sekhar Samanta of Srikrishnapur, ward No. 7,
P.S.- Kharagapur (Town), Dist- Paschim Medinipur, I hereby serve
you this notice which as follows,-
1. That by a tenancy agreement my client has taken a shop from
you and your brother Sandip as you and your brother Sri Sandip
Maity are the exclusive owners of the tenanted premises as
described below.
2. That in the said premises my client started a Beauty Parlour
under the name and style “womens Dream”.
3. That as per conditions mentioned in the said instrument , if the
tenant is willing to leave the premises before termination of the
tenancy agreement, then the tenant, i.e. my client has to give a
prior two months notice to the landlords for vacating the
premises before termination of the tenancy agreement which is
valid upto 30/11/2020.
4. That an amount of Rs. 1,50,000/- has been kept deposited to
you by my client as security deposit, which is refundable if my
client leaves the shop after termination of the agreement or
before by giving two months notice.
5. That due to some difficulties and unavoidable circumstances, my
client is not in a position to continue the Beauty parlour
business in the said premises and she has decided to quit and
vacate the premises on and from 30th September,2020.
6. That as per the tenancy agreement, I on behalf of my client
sending you this notice for terminating the tenancy agreement
and if any rent is due, then that dues money kindly deducted
from the security money and the rest amount will returned to my
client.
Under the above facts and
circumstances, I would request you
to terminate the tenancy agreement
on and from 30.09.2020 and to
return the security deposit lying
with you as per agreement.
