TERMS & CONDITIONS
The following terms and conditions shall supplement and form an integral part of all catering and food services agreement, regardless of
form, entered into by K BY CUNANAN CATERING (hereinafter referred to as the “Caterer”) with
SUPERVENING CIRCUMSTANCE
By signing this contract, The Client hereby agrees that the Government-mandated community quarantines impose limitations on the
service that can be provided by The Caterer. Therefore, whichever of the aforementioned packages that pertain to the services to be
rendered by The Caterer, shall be chosen by the Caterer according to the prevailing government-mandated community quarantine rules
on the day of the event.
The Caterer reserves the right to further amend the terms and conditions of this contract should supervening circumstances render the
obligations herein outside the scope of the original contemplation of the parties.
CHANGES IN THE AGREEMENT
It is understood that any catering or food service agreement between the Caterer and the Client involves meticulous and very specific
preparations. Consequently, the Client is only allowed to make the following changes in the agreement no later than fourteen (14)
calendar days before the subject function: (i) choice of dishes, linens, and flowers; (ii) additions such as crew meals, and/or kiddie
meals; (iii) layouts of materials; and (iv) number of guests. The Caterer reserves the right to deny accommodation of these changes if
done beyond the foregoing period. Any of these changes must be communicated to the Caterer in writing, whether electronic or otherwise,
and shall always be subject to the conformity of the Caterer.
The Client also recognizes that the Caterer requires at least six (6) hours for ingress and setup at the venue. Should the venue’s
circumstances necessitate ingress or setup of less than the required six (6) hours, the Client agrees to shoulder costs that may be incurred
by the Caterer. The Caterer reserves the right to charge the Client for the additional manpower and trucking amounting to the following
based on number of pax:
Should external factors, such as trussing and heavy ceiling arrangements, cause delays and affect the six (6) hours allotted for ingress,
the Caterer shall not be liable for same.
Should the venue chosen for the function be an open venue (e.g. garden wedding) and/or be unable to provide a kitchen or pantry, the
Caterer reserves the right to require from the Client tents to cover the buffet area, reception area and/or the preparation area which, shall
be for the Client’s account.
In case of rain, transfer of the setup to an indoor or enclosed hall may be allowed without charges if the decision to transfer is
communicated at least twelve (12) hours before the start of service, and provided the transfer is to be made only within the venue or the
venue’s vicinity. If, however, setup has been made and is already in place, the Client shall be liable for an additional service charge,
equivalent to 10% of the total consideration of the agreement, for the transfer of the setup. The Caterer and its team members shall, on
a best effort basis, move all items within the allotted time given. The Caterer will, however, not be liable for failing to move items if or
when the given time for the transfer is too tight or close to arrival of guests.
The Client shall secure from the appropriate government and private agencies, any and all permits, authorizations, clearances, and/or
licenses required for the function. The Caterer shall have the right to demand presentation of such permits, authorizations, clearances
and/or licenses prior to the function.
Transportation and other additional expenses for functions outside Metro Manila shall be for the account of the Client.
• P100 for every exceeding wine bottle • P300 for every exceeding case of beer
• P200 for every exceeding hard liquor • P1000 for every exceeding keg of beer
Should the Client refuse to adhere to the safety protocols in place for the event, or to Government-mandated rulings and/or policies, the
Caterer has the prerogative to cease the provision of service.
STYLING
Should any of the flowers stated in the agreement be unavailable, the Caterer reserves the right to substitute flowers of a variety of equal
appeal and value, without altering the total look or feel of the arrangement.
The Caterer also reserves the right to refuse setting up decorations provided by the Client or any third-party supplier to any of its
catering and dining tables, unless these are stipulated in the contract.
The Client has the right to inventory the equipment or materials brought in by the Caterer for the function. The Client agrees to be
liable for any loss or damage to the Caterer's equipment not caused by the Caterer’s personnel.
The Client agrees that no sparklers or fireworks can be used within ten (10) feet from the Caterer’s tables or other setups covered in
linen. Otherwise, any damage to the Caterer’s linens and equipment shall be shouldered by the Client, in addition to a fixed penalty
in the amount of at least P2,500 per damaged piece of linen.
DURATION OF SERVICE
The Caterer shall provide a maximum of six (6) hours of service reckoned from the start of cocktail hour. In case of overtime, the Caterer
requires payment in check payable to CATHERINE CUNANAN CATERING, prior to the start of overtime, of the amounts
below.
• For 200 pax and below: Additional Ten Thousand Pesos (Php10,000.00) per hour in excess of six (6) hours, for a maximum of
two (2) hours only.
• For 201 pax - 400 pax: Additional Fifteen Thousand Pesos (Php15,000.00) per hour in excess of six (6) hours, for a maximum
of two (2) hours only.
• For 401 pax and above: Additional Twenty Thousand Pesos (Php20,000.00) per hour in excess of six (6) hours, for a maximum
of two (2) hours only.
Should the Client refuse to pay for the foregoing overtime charges, all tables, chairs, setup, decors, and glassware shall be packed up
regardless of presence of guests.
The Caterer’s setup for tables and chairs is to be used only during the reception proper. If the function involves a separate ceremony,
e.g. wedding, which takes place where the Caterer’s setup is, the service time is understood to start during the ceremony.
The Caterer shall have the prerogative to shorten total service time in compliance to gorverment-mandated curfews, to ensure that all
staff are able to make their way back in a timely manner. In cases wherein the Client wishes to request for the Caterer's equipment of
only tables and chairs to be left behind overnight, the Client hereby agrees to shoulder next day pick up of equipment for at least
P5,000.
LEFTOVER FOOD
The Caterer has the right to disallow the wrapping, for takeaway of food items that are prone to spoilage such as, but not limited to, the
following: cold items (e.g., appetizers and salads); rice and desserts (e.g. ice cream and sorbet); hot items (e.g., soup); and/or food with
cream or coconut milk, tomatoes, or seafood in them.
The Caterer shall not be held responsible for the potential consequences of food spoilage with respect to any food item that was brought
home by the Client or any of the Client’s guests or crew.
In the case of postponement, the validity of the paid booking fee of P10,000 is one (1) year from the original event date, with the new
chosen date of the Client subject to availability of the date and upon confirmation of the Caterer. Should the Client decide to postpone
their event date past the one-year validity of their booking fee, re-booking fees shall apply.
The Client hereby agrees to shoulder reasonable costs incurred by the Caterer due to change of event date and change of venue.
PENALTIES
The Client shall be liable to pay the corresponding penalties for the following contingencies:
• If the event is cancelled more than sixty (60) days prior to the function date: the Client shall forfeit the booking fee of Ten Thousand
Pesos (Php10,000.00).
• If the event is cancelled within sixty (60) days prior to the function date: the Client shall, in addition to forfeiting the booking fee,
pay at least 50% of total package.
• If the event is postponed within two (2) weeks prior to the function date: the Client shall pay shoulder applicable expenses incurred in
preparation for the function. Previous payments made, in exception of any expense that the Caterer had already incurred, may be carried
over to the new date.
• If the event is cancelled within two (2) weeks prior to the function date: the Client shall, in addition to forfeiting the booking fee, pay
at least 50% of total package plus the expenses already incurred in preparation for the function.
PAYMENT TERMS
The following payment terms are for the strict compliance of the Client, and failure to comply herewith shall constitute breach of the
agreement by the Client:
In case of weddings and socials, the Client agrees to pay Ten Thousand Pesos (Php10,000.00) as booking fee for the purpose of
reserving the function date. This booking fee is non-refundable but deductible from the total charges. Thereafter, the Client agrees to
pay a down payment equivalent to 50% of the total amount for the agreement no later than sixty (60) days prior to the function. The
remaining balance must be paid in full no later than two (2) weeks prior to the function date. If payment is to be made by checks, said
checks must be made payable to CATHERINE CUNANAN CATERING. If the payment is to be made via bank deposit, a copy
of the deposit slip must be sent to the Caterer for validation.
For corporate clients, full payment must be made on the day of the event. Payments to be settled fifteen (15) to thirty (30) days after the
event can only be accommodated if prior approval of the Caterer is obtained. A signed contract, together with a purchase order, must be
given no later than one (1) week before the function.
Failure of the Client to comply with the foregoing payment terms and to provide signed copies of the final contract shall result in the
automatic cancellation of the function, forfeiture of the booking fee, down payment, or any amount delivered by the Client under the
agreement.
The Caterer shall not be liable for any failure or delay in the performance of any of its obligations, if such failure or delay is caused by
force majeure (such as, but not limited to, fire, earthquake, floods, typhoons, acts of public enemy, riots, war, rebellion, insurrection,
sabotage, terrorism, acts of God, strikes, lockouts or other industrial disturbances, order of competent government authority, order of
any court or regulatory or arbitrage body of competent jurisdiction, power, communications or transportation service interruptions,
suspension of supplies, or any other unforeseen event or causes beyond the reasonable control of the Caterer).
The Caterer reserves the right to cancel any function, should it determine that the lives of its employees, staff, and/or officers shall be
put in peril by virtue of the function, or circumstances relevant thereto, or by any reason of any force majeure. In such cases, the Client
shall be entitled to a rebooking of the function at a more favorable date. and time, if rebooking. is still feasible and preferred, or to a
refund of all payments made, except the booking fee.
In cases of breach by the Client, the Caterer shall have the right to terminate the agreement, cancel or discontinue preparation, set up
and service, and forfeit the booking fee, down payment and balance, as the case may be.
ATTORNEY’S FEES
The Client acknowledges and accepts that, should the Caterer require the services of legal counsel to enforce the agreement or collect
thereon, whether judicially or extra-judicially, the Client shall also be liable for the payment of the lawyers' fees, and/or
collection/litigation expenses.
LIMITATION OF LIABILITY
The Caterer shall not be responsible for the actss of third persoons and/or its employees who act beyond the scope of their authority.
