Excerpt from the minutes of the regular monthly meeting of Sangguniang Barangay of Bentig, Calape,
Bohol held on November 15,2018 at Bentig Session hall 2:00 o’clock in the afternoon.

Section 3. POWERS AND DUTIES – The following are the powers and duties of the Barangay
Lucob Dangerous Drugs Administrative Board:
A.) Receive complaints for the abatement of drug related public nuisances;
B.) Conduct hearings in connection of the barangay;
C.) Declare a place or premises in question as drug related public nuisance if the
circumtances so needed; and
D.) Abate drug related public nuisances.
Section 4. ABATEMENT OF DRUG RELATED PUBLIC NUISANCES – Pursuant to Section 52 of
Republic Act 9165 and its implementing Rules and Regulations, otherwise known as the
Comprehensive Dangerous Drugs Act of 2002, any place or premises which have been used on
two more occasions as the site of the unlawful sale or delivery of dangerous drugs and other
similar activities may be declared to be a public nuisance and such nuisance may be abated
under the following procedures.
A.) Any employees, officers, or resident of Barangay Lucob, Calape, Bohol may bring a
complaint before the Calape Dangerous Drugs Administrative Board after giving not
less than three days written notice of such complaint to the owner of the place or
premises at his /her last known address;
Within three days from receipt of the complaint, hearing shall then conducted by the
Board with notice to both parties and the board may consider any evidence
submitted, including evidence of general reputation of the place or premises.
B.) The owner / manager of the place or premises shall also be given an opportunity to
present any evidence in his / her defense;
C.) After hearing, the Board may declare the place or premises to be a public nuisance;
and
D.) The hearing shall be determined within ten days from commencement.
The order issued by the Board shall expire after one year of the date issuance, or at such
ealier time as stated the order.The administrative Board may bring a complaint seeking a
permanent injunction against any nuisance described under Republic Act 9165 and its
Implementing Rules and Regulations.
The Board, upon showing that the place is no longer a public nuisance, may conduct
hearing with the complainant duly notified for possible lifting of the order.
Section 10. REPEALING CLAUSE – Any ordinance found to be inconsistent with this shall be
deemed repealed or modified accordingly;
Section 11. TRANSITORY PROCISION- The amount appropriated in the year 2019 the Barangay
Development Plan for Anti-Drug Abuse Council shall also cover expenses for the implementation
of this ordinance until such that a regular appropriation be enacted under Section 8 hereof;
Section 12. EFFECTIVITY – This ordinance shall take effect immediately after approval by the
Sangguniang Bayan;
