1. Context

GIZ GmbH (German Society for International Cooperation) is an international organization for
cooperation and sustainable development, founded by the German Federal Government and
operating in more than 130 countries of the world. On behalf of the Federal Ministry for
Economic Cooperation and Development (BMZ) of Germany, GIZ supports the Government
of the Republic of Tajikistan (RT) in the implementation of legal and judicial reforms. Within the
framework of the Program “Promotion of the Rule of Law in Central Asia”, GIZ supports the
RT in the further development of administrative procedural law. The focus is on the application
and optimisation of the Code on Administrative Procedure (CAP) and related special
administrative procedural laws. The work also aims to strengthen the ability of public service
employees to apply administrative procedural law. Furthermore, the knowledge of the public
on issues of administrative procedural law is to be improved. Target groups are state bodies
as well as the Tajik public. To these ends, GIZ is seeking two experts who will each
independently perform the tasks described below.

2. Tasks to be performed by the contractor(s)

The contractor is responsible for providing the following services:

• 10 days: trainings on administrative law for employees and trainers from public
administration and judiciary, in an interactive method together with other trainers, based
on GIZ’s training module;
• 10 days: advice to working groups on development of training materials and legal reform;
• 15 days: preparing and conducting up to 30 broadcasts live on one of the national radio
channels mainly on the subject of administrative procedural law (thematic information,
answers to listeners' questions).

Certain milestones, as laid out in the table below, are to be achieved by certain dates during
the contract term, and at particular locations:

4. Personnel concept

The below specified qualifications represent the requirements to reach the maximum number
of points.

Expert (named “Expert 1” in the assessment grid)

Tasks (in addition to section 2.)

- Overall responsibility for the advisory package (quality and deadlines);
- Coordinating and ensuring communication with GIZ, partners and others involved in
the project;
- Regular reporting in accordance with deadlines.

Qualifications of the expert

- Education/training (2.2.1): University qualification in Law;
- Language (2.2.2): Russian and Tajik as mother tongues;
- General professional experience (2.2.3): 5 years of professional experience in the law
sector;
- Specific professional experience (2.2.4): 5 years in administrative procedural law and
enforcement law;
- (Leadership/) management experience (2.2.5): 3 years of management experience as
trainer, trainer of trainers, legal consultant and law expert in radio and/or TV shows;
- Regional experience (2.2.6): native Tajik citizen;
- Development Cooperation (DC) experience (2.2.7): 3 years of experience in DC
projects;
- Other (2.2.8): 3 years of experience as trainer using interactive and activating training
methods.

5. Costing requirements

Assignment of personnel

Expert: On-site assignment for up to 35 expert days

Travel

The expert is required to calculate and list the expenses for up to 10 travel days to Khujand /
Tajikistan separately by daily allowance, accommodation expenses, flight costs (up to two
return flights) and other travel expenses.

6. Inputs of GIZ or other actors

GIZ and/or other actors are expected to make the following available:

• Transportation on site with own project vehicle

• Workshops logistics
• Co-trainers
• Radio moderator

7. Requirements on the format of the bid

The structure of the bid must correspond to the structure of the ToRs. The bid shall provide
substantial information with regard to the positively weighted criteria in the assessment grid
(not with zero). It must be legible (font size 11 or larger) and clearly formulated. The bid is
drawn up in Russian. The complete bid shall not exceed 1 page (excluding CVs).

The CV of the personnel proposed in accordance with Chapter 4 of the ToRs must be
submitted using the format specified in the terms and conditions for application. The CV shall
not exceed 4 pages. The CV must clearly show the positions and jobs the bidder held in the
reference projects and for how long. The CV can also be submitted in Russian.

If one of the maximum page lengths is exceeded, the content appearing after the cut-off point
will not be included in the assessment.

Please calculate your price bid based exactly on the aforementioned costing
requirements. In the contract the contractor has no claim to fully exhaust the
days/travel/workshops/ budgets. The number of days/travel/workshops and the budget
amount shall be agreed in the contract as ‘up to’ amounts. The specifications for pricing
are defined in the price schedule.

8. Confidentiality
An experts must keep confidential all material that is delivered to it for the performance of its
work and that is the property of the GIZ Program. Likewise, you may not give said material.

9. Special conditions

• Note: Proposals made for the supply of goods/services which are under sanctions or
whose manufacturers/Suppliers are under sanctions will not be considered.

• All questions should be submitted in writing and with the subject #83429558 to the
email address: Procurement.TJK@giz.de before 17:00 on 16th of January 2023.
• Bidders should not contact other GIZ personnel unless directed to do so by the GIZ
representative.
• The default size of e-mails is limited to 30 MB. Above that, GIZ's email servers refuse
the message and its attachments. If necessary, send more than one e-mail.
• In case of bigger files, it is possible to transfer the file via GIZ’s Filetransfer service:
https://filetransfer.giz.de GIZ accepts only this specific filetransfer solution for
submission of documents exceeding the default mail size of 30 MB.

 • GIZ is not responsible for the failure of electronic delivery of e-mail messages to the
address provided, either for technological problems on the part of GIZ or the candidate.
• This invitation to tender is in no way binding on GIZ. The GIZ’s contractual obligation
commences only upon signature of the contract with the successful Tenderer.
• Up to the point of signature, GIZ may either abandon the procurement or cancel the
award procedure, without the candidates or tenderers being entitled to claim any
compensation.
• All costs incurred in preparing and submitting tenders are borne by the tenderers and
cannot be reimbursed.
• All tenderers will be informed in writing on the results of this tender procedure.
• GIZ reserves the right to disqualify and reject proposals from Bidders who do not
comply with these guidelines.
• The successful candidate will be required to provide additional personal documents.

10. Submission of commercial offer:

• Technical proposal (CVs, certificates, and etc);
• Financial proposal in local currency (prepared in a separate PDF file)

Requirements for financial proposal:

• The price proposal must be dated and signed;

• Currency: Tajik somoni;
• Terms of payment: by transfer to the bank account.
