CONFIDENTIAL Copy __of ___copies Philippine National Police Capiz Police Provincial Office Roxas City, Capiz April 28, 2018 (CIPLAN: SITG “ASIS”) 1. AUTHORITY: a. Report on Shooting Incident victimizing Punong Barangay ELVIS ASIS y ANTIOQUIA, elected official and re-electionist and resident of Barangay Lawaan, Roxas City who was shot to death by still unidentified suspect/s at around 8:20 PM of April 27, 2018 at Bray. Lawaan, Roxas City near the Tri- Star Establishment; b. Composition of Special Investigation Task Group as Special Order No. 53, CPPO dated April 28, 2018; c. PNP Standard Operating Procedure Number 2012-006 (Procedure in the Investigation of Heinous and Sensational Crimes) d. Police Operational Procedures Revised 2013 UB SITUATION: At about 08:15 P.M. of April 27, 2018, Roxas City PS received a telephone call from concerned citizen, informing that there was a shooting incident transpired ray. Lawaan, Roxas City near the Tri-Star Establishment. Immediately, elements of Roxas City PS led by PSI Larnel Frial together with the PO3 Ronnie Recto, Investigator on Case responded to the area to verify the veracity of said information, Upon arrival at the crime scene, the victim was not already at the scene of incident but was hurriedly brought by the populace at Capiz Doctors Hospital for medical treatment but was pronounce dead on arrival by Dr. Alex Bulquerin, Attending physician. Victim sustained three (3) gunshot wounds through in through; one (1) was from the back of the head, one (1) on the back of the body and one (1) on the right arm. Immediately police responders with the assistance of the populace cordoned the area while IOC process the crime scene to gather pieces of evidence. Initial investigation disclosed at around 8:20 PM of April 27, 2018 at Bray. Lawaan, Roxas City near the Tri- Star Establishment, the victims were riding a motorcycle Suzuki smash 110 colored black and for registration owned and driven by Joselito Casila. The two (2) victims were heading North going to Patag, Brgy. Lawaan, Roxas City and while on their way the driver heard a sound similar to a gunshot but he never minded until he found out that his back rider Punong Barangay Elvis Asis fall on the ground. The driver immediately stops his motorcycle and he discovers that PB Asis sustained gunshot wound and the same he was also hit on the right arm. Victim Joselito Casila ran on the other side of the road and asked for help. Afterwards, said unidentified suspects fied using his motorcycle to unknown direction. Continuous pursuit operation is being conducted by Roxas City Police Station against the suspects. Ul, MISSION: The SITG “ASIS” of Capiz Police Provincial Office on its concurrent mission and functions shall conduct thorough investigation on the death of Punong Barangay Elvis Asis to identify his assailant and filed appropriate charges in court if evidence warrantIV, EXECUTION: Concept of Operation: A. PLANNING AND PREPARATION PHASE 1. Creation of Special Investigation Task Group “ASIS”, SO No. 53, CPPO dated April 28, 2018. 2. Convene the members of SITG “ASIS”. 3. Conduct thorough evaluation of the case 4. Identification and profiling of suspect/s. 5. Gather physical and testimonial evidence to support complaint. 6. Prepare an airtight case against the suspects. 7. Others may be included in order to support the successful prosecution of the case. B. POST OPERATION PHASE: The SITG “ASIS” together with the other Law Enforcement Agencies shall orchestrate the conduct of operation upon identification of suspect/s, will assist the filing of appropriate complaints against the suspect/s. Gather evidence to establish the strong case against the suspect/s through the following: 1. Secure sworn statements/affidavits from the eyewitnesses; 2. Clearly establish the identity of suspect/s and their cohor'’s; 3. Prepare the necessary affidavits, complaints, and agency referrals. C, MONITORING/EVALUATION PHASE 1. Conduct Case Review. 2. The SITG “ASIS" shall analyze, monitor and evaluate the case filed in court. V. CONTINGENCY: Ensure counter intelligence measures to deny the perpetrator of information and resources to deny the allegation and mislead the investigation. Conduct the proper filing of case in court. Prepare the necessary After Operations Report to be submitted to the higher office/RIDMD for the purpose of information update, and conduct the necessary interview to all the victim's relatives that will form part of the evidence and strengthen the case VI. ADMINISTRATION AND LOGISTICS Composition of SITG “ASIS” (Annex “A”) All units are tasked accordingly under this CIPLAN and shall perform, among others, additional tasks necessary within their mandates for the successful accomplishment of the mission herein specified: 1. Provincial Director, Capiz PPO - shall act as the SITG Commander and the over- all supervisors in the implementation of this CIPLAN. 2. CHIEF, CIDT, Capiz - shall act as the Assistant SITG Commander and shall assist the SITG Commander in over-all supervision in the implementation of this CIPLAN. 3. Chief, PPHRDBa. Issue appropriate orders for the personnel to compose the SITG “ASIS" to lead the investigation of the incident ;and b. Performs other tasks as directed. 4. Chief, PIB a. Provide intelligence coverage in all places of engagement in coordination with the intelligence operatives of the seventeen (17) police stations within the Province of Capiz including other concemed intelligence agencies; b. Identification and profiling of possible suspect/s; ©. Provide timely and relevant intelligence and estimates of the situation to all tasked units, and; c. Performs other tasks as directed. 5. Chief, PIDMB a. Assist the Investigator On-Case purposely to fast-track the build-up of the air-tight case against the perpetrators; b. Conducts ocular inspections, and assists in the filing of complaints, c. OPR of the SITG and prosecution of the case; d. Update the SITG Commander on any development of the conduct of investigation; e. Perform other tasks as directed, 6. Chief, PLB a. Provide necessary logistical support needed by the SITG “ASIS” and other tasked units; and b. Perform other tasks as directed. 7. Finance Section a. Provide fund support to all operating PNP units; b. Prepare funding requirements. c. Perform other tasks as directed. 8. Chief, PIO a. Initiate press release in any development of the case; b. Issue official statement as approved by SITG Commander; c. Perform other tasks as directed 9. CC, CPMF a. Provide security personnel; b. Provide SWAT team if necessary; and c. Perform other tasks as directed 10. COP, Roxas City PS a. Shall be the lead Office in the conduct of investigation in coordination with CIDG; b. Update the SITG any development of the case; c. Shall designate liaisoning to the family of the victim; and d. Perform other tasks as directed 41. All COPs/OICS MPSvil. a. Assist the SITG in the conduct of investigation; b. Provide necessary information and documents to the SITG for the building of the case; c. Task their respective investigator and intelligence section to identify other possible suspect/s ; and d. Perform other tasks as directed. 12. PC, CPCLO: a. Provide scientific and forensic service in the conduct of investigation; b. Examine all the pieces of evidence gatheredjand . Perform other tasks as directed. COMMAND AND COMMUNICATION: 4. Respect for human rights shall be paramount and strict adherence with the Police Operational Procedures (Revised Rules of Engagement) shall always be observed in the conduct of actual operation; 2. Adopt the QUAD concept of operations to foster maximum cooperation and coordination in the implementation of this CIPLAN; 3. All tasked units shall re-assess respective resources and capabilities; 4. Maximum coordination with LGUs, DOJ, NBI, DILG, RHU-DOH and all sectors of the community is highly encouraged; and 5. Lateral coordination with other law enforcement agencies is authorized and highly encouraged. 6. This CIPLAN shall take effect upon approval. Lawaan, Roxas City CASE INVESTIGATION PLAN (CIPLAN) Copy 4 of 5 copies Philippine National Police Date: _April 30, 2018 CIPLAN PROPOSAL: REFERENCES: 1 SITUATION a. Background information on merits of CIPLAN proposal that leads to the justification of the project. On April 27, 2018 at about 8:20 in the evening a cellular phone call received by the desk officer SPO2 Loygay Fantilaga from a concerned citizen of Barangay Lawaan this city informing that there was a shooting incident at the said Barangay. The desk officer immediately call the undersigned investigator-on- case and informed the same wherein it was instinctively advise by the IOC to call for the SWAT team and proceed therein while the OC ad the Intel/Operative will also proceed at the place of reported incident. At 8:24 in the evening of the ‘same date the SWAT team led by PO3 Dizon arrived at the place of incident, however, the body of the victim was already removed and was brought at the \ Capiz Doctors Hospital of the same Barangay. Some bystanders helped the flow of the traffic while some barricading the alleged fired cartridges which was found ‘on the area. Minute later, the IOC and the Intel/Operative arrived at the place of incident. The IOC immediately conducted investigation at the place of incident while the Intel/Operative PO2 Marlon Apruebo and PO1 Devic June Ganzon were gathering some information with regards to the incident. . Investigation conducted disclosed that the Shooting Incident transpired on SEBS. Aptil 27, 2018 at about 8:20 in the evening at Brgy. Lawaan, Roxas City Me particularly near the Tri-Star Establishment and the estimated distance of incident from the Roxas City PS is more or less 1km. The victims were identified boggy aie as Barangay Chairman Elvis Asis y Antioquia, 51 years old, married, and a Ne2[Pag Joselito Casila y Quijano, 30 years old, married, driver and both are resident of Brgy. Lawaan this city. The suspect/s was unidentified during the time. Further disclosed that the victims were riding a motorcycle Suzuki smash 110 colored black and for registration owned by Joselito Casila. The two (2) victims were heading north going to Patag Lawaan this city and while on their way; the driver Joselito Casila heard a sound similar to a gunshot but never mind it until he found out that his back rider Brgy. Chairman Elvis Asis fall on the ground. The driver immediately stops the motorcycle and for he was also hit on the right arm. Victim Joselito Casila ran on the other side of the road and asked for help wherein some bystanders help trafficking on the road. Victims were brought at the Capiz Doctors Hospital, Brgy. Lawaan this city. At about 9:53 in the evening of the same date, victim Elvis Asis was pronounced dead by the attending physician Dr. Alex Bulquirin for he sustained three (3) gunshot wounds through in through, one (1) was from the back of the head, one (1) on the back of the body and one (1) on the right arm. Meanwhile, victim Joselito Casila survived for he only sustained a gunshot wound on his right arm. The IOC recovered four (4) fired cartridges of alleged .45 at the crime scene. The IOC immediately requested for ballistic examination on the said recovered fired cartridges. On the following day April 28, 2018 the Roxas City Police Station requested Ballistic Examination on the four (4) fired cartridges which was recovered by the IOC at the crime scene and at the same time, the family of the victim and Chief of Police requested an Autopsy to the dead body of the victim Barangay Chairman Elvis A. Asis to determine the marks, wounds and caused of death of the said victim. While on the other hand, PS! Larnel F Frial, DCOP, PO3 Balgos, Investigator, SPO1 R Ibafiez were tasked to request all CCTV Footage which was installed at the area of Brgy. Lawaan this city for possible identification of the perpetrator/s. and on the very same date, PSSUPT SAMUEL S NACION, Provincial Director of CPPO calls for immediate Case Conference Re Shooting Incident victimizing the aforementioned Barangay Chairman. The said case conference was attended by PSUPT BATILES, DPDA, PCI BUCCAT, CPPO Intel Officer, PS GERVERO, PDU, CPPO Staff and the Roxas City PS led by PSUPT DANTE S TAYCO, COP, RCPS with SPO3 M De Joseph, C,IDMS, SPO1 A Buenvinida, C, Intel/Operative and the PO3 RA Recto, IOC. The conference ended at about 10:33 in the morning of the same date with the creation and composition of the Special Investigation Task Group (SITG) on the above-mentioned named. Through the SITG Diligent and exhaustive effort to unmask the culprits behind the killing of Brgy.Chairman Elvis A. Asis were later identified as Rogelio Buarony Bechayda alias Nonoy Buaron and Joey Bacus y Cumawas alias ‘Tata’ while one (1) John Doe was unidentified. The undersigned IOC filed a case at the City Prosecutors Office, Hall of Justice, Roxas City for the crime of Murder with NPS DOCKET NO. VI-16-INV-18E-00086 and Frustrated Murder with NPS DOCKET NO. VI-16-INV-18E-00090 dated May 3, 2018. b. Factors that surround the situation: 1, Barangay Chairman Elvis A. Asis was killed at the Barangay Road of Bray. Lawaan, Roxas City while back riding on Suzuki smash 110 colored black driven by Joselito Casila. The said road was dim. 2. The families and friend of the victim serves as the witnesses of the crime and executed an affidavit. 3. FIVE STAR GAMING AND ENTERTAINMENT CORPORATION (SMALL. TOWN LOTTERY) and the illegal number games were factors of the crime surrounded therein. Il. RATIONALE AND OBJECTIVES OF THE CIPLAN PROPOSAL. 1. The rationale and objectives of the CIPLAN proposal was to established an airtight prosecution of this particular case in order to attain conviction of the — suspect/s. 2. Provide security to the complainant likewise with the witnesses from threat and harassment and other unlawful acts considering that the principal by inducement was influential. 3. Provide Police Security during Preliminary Investigation. Ill, OUTLINE OF CIPLAN OPERATIONS a. Tasking of CIPLAN personnel * PISUPT DANTE S TAYCO —Chief of Police of Roxas City Police Station was in- charge in the deployment of CIPLAN investigation personnel, 2. Chief intelligence * Task and Supervise Intelligence personnel to identify and locate the suspects and one (1) John Doe. © Coordinate with other intelligence groups or confidential informants to gather more information about the incident. 3. Investigator on Case© Liaison with the prosecution team, witnesses and other informants * Provides security police escort to the witnesses. © Attend court hearings ‘Follow-up other information that could help in the prosecution of the case. b. Planned operations © Coordinate with other intelligence groups or confidential informants to locate the whereabouts of the suspects and the one (1) John Doe. © Conduct surveillance operations on the activities of the suspects if located c. Witness and informant Management 1. Provide police security escorts to the witnesses o>) 2. Continuous coordination to the witnesses. 3. Counter check any information given by any informant c. Reports and frequency of submission of Criminal Assessment Reports 1. Submit updates on a weekly basis and as soon as there is a development 2. Submit a weekly Investigative Assessment Report. IV. OUTLINE OF CIPLAN ADMINISTRATIVE FUNCTIONS Logistical support is needed in the case plan listed as follows: Gasoline/Transportation Allowance : 10,000.00 Meals : P 6,000.00 Other expenses - P 4,000.00 Total 5 20,000.00 a. Finance Officer© Provide financial assistance to personnel needed on each and every operation that includes transportation/gasoline, food and allowances Record all financial disbursements . Supply and Equipment Personnel © Provide supply and equipments necessary for the operation to be conducted . Transportation Personnel « Provide vehicle/s needed for operation d. Communication personnel Provide communication equipment/s necessary for the operation e. Liason personnel Liason with all non-PNP units that are part of the CIPLAN Perform other tasks when needed V. INITIAL ASSESSMENT ON CIPLAN PROPOSAL. There was only circumstantial evidence which points out the principal by inducement, however, there was an eye witness to the killing of Barangay Chairman Elvis A. Asis and that was the driver Joselito Casila. Other evidence/s and witnesses needed to ensure the conviction of the suspect/s and to name the one (1) John Doe on this case to give justice to the victim and his family.
