While I was with the DILG, I rendered several Legal Opinions for the Department
I was tasked with reviewing Proposed Model Ordinances for LGUs (Province, City,
Municipality, and Barangay)
• Review of Ordinances, Resolutions, and Other Issuances from several LGUs
• Review or provide comments on Congressional Bills/resolutions requiring the
comments and recommendation of the Department;
• Review or provide comments on Contracts/Memorandum of Agreements/ Memorandum of
Understandings entered into by the Department Officials and/or local officials;
o Drafting Decisions on
- appeals against audit decisions (Notice of Disallowance (ND), Notice of
Suspension (NS), and Notice of Charge (NC)) of the auditors and
- decisions on the denial/approval of Requests for Write Offs and Requests for
Relief from Accountability
o Drafts Answers to the Petition for Review filed against the Decision rendered by
the Regional Office
o Prepares comments and memorandum on Requests for Relief from Accountability,
Condonation, and Write Off
o Renders legal assistance to auditors in compliance with court issued directives
such as subpoena duces tecum and subpoena ad testificandum
Perform all other legal assistance or answer legal queries required to be rendered
by the Regional Office
Legal Opinions
The proposed output indicator for the revised target for CY 2023 is definitely more
preferred and a bit better than the previous indicator since the latter which
requires the Cluster/Regional Office to produce at least 12 Decisions per lawyer,
including the Division Chief, per semester, may not be possible as there are times
when there are not enough cases filed during such period or semester and a case is
only deemed filed when an appeal on the subject disallowance was made by an
Appellant.
However, the parameter in determining the number of outstanding cases, i.e., "prior
and current cases, respectively" are somewhat vague and not wholly identified which
may cause confusion the concerned Offices. As such, we recommend that "prior cases"
to mean cases that are pending/outstanding as of the end of the preceeding year. An
example of which is, for CY 2023, its prior cases are those cases that have yet to
be decided as of December 31, 2022 since such cases would be carried over in CY
2023.
Since the term "current" means existing, we recommend that "current cases" to mean
cases that are received by a Cluster/Regional Office for the current year. For
example, cases filed before a Cluster/Regional Office on CY 2023 are its "current
cases".
Applying the above discussion and for uniform interpretation by all concerned, for
CY 2023, 30% of a Cluster/Regional Office's outstanding cases (prior and current
cases) are pending cases as of December 31, 2022 plus cases filed before a
Cluster/Regional Office on CY 2023.
With this in mind, it resectfully suggeste that for purposes of coming up with an
inventory or list of outstanding cases as basis for the aforementioned 30%
computation, cases filed prior to the said subivision of Offices should not be
considered nor included in the said list of outstanding cases of said Office.

Measures.

Appellant previously filed a Motion for Extension to file Appeal Memorandum dated

of the Regional Office No. IV wherein it was subdivided into two Regional Offices,
i.e., Regional Office Nos. IV-A (CALBARZON) and IV-B (MIMAROPA). Because of such
situation, there are case files and documents which were lost or missing and could
not be found despite best effort.
As such, those appeals that were made prior to the creation of this Regional Office
should not be considered nor included in the list of outstanding cases of said
Office.
If such Cluster/Regional Office had decided at least 30% of its outstanding cases,
would that automatically merit the highest rating of "5.0" in the proposed Output
Indicator?

Culandanum, Bataraza, Palawan, is included in the cycylical audit this Calendar
Year (CY) 2021 for the conduct of regular audit on the operations and transactions
of the said Barangay for CYs 2015-2021 which would be due on September 30, 2021
hence, the latest BAAR for the same Barangay is only for CY 2014.
