INTRODUCTION

The meaning of the concept of quasi legislative power.

Quasi legislative power according to Mollel, H. A. (2010). Explained the meaning of quasi legislative
power as a power to make rules and regulations that having the forces of law. This means that an
authority has a power to control and direct all activities in their areas of jurisdictions through such kind
of power which granted to them. Forexample the federal aviation administration will pass rules and
regulations surrounding safety requirement for aircraft operating in United State.
Also according to Swai, I.L. (2017). Defined quasi legislative power as an authority delagated by the law
making body to the administrative body to adopt rules and regulations intended to carry out the
provisions of law and implementations legislative policy. The quasi legislative power also are performed
by judiciary, the traditional institutions, the civil services and the execultive.

Generally the concept of quasi-legislative power refers to the authority granted to certain
administrative bodies or agencies to create rules and regulations that have the force of law. Quasi-
legislative power allows these bodies to make decisions and establish policies, filling in gaps left by
legislative bodies or advancing specific goals within their designated areas of expertise. This power is
often given to regulatory agencies or administrative bodies in order to address complex and specialized
issues that cannot be adequately handled through traditional legislative processes.

Quasi-legislative power is typically exercised by administrative agencies that are created and
empowered by legislation passed by the legislative branch of government. These agencies are delegated
authority to carry out specific functions, such as regulating industries, overseeing public health and
safety, or enforcing certain policies. While the legislature sets the overall policy framework and
objectives, it is the quasi-legislative power of administrative agencies that enables them to make
detailed rules, standards, and regulations to implement and enforce those policies effectively.

MAIN DISCUSSION

The parliament of the United Republic of Tanzanian delagates power to Local Government Authorities to
make their own laws, rules, regulations and policies inorder to soft their own administration activities.
The decision is most important to local government authorities. This is because the parliament wants
these authorities to be more independently in performing their duties and responsibilities in their areas
of jurisdictions. So here we are looking on the rationales which make the parliament of the United
Republic of Tanzanian to delagates this power to Local Government Authorities.The followings are the
rationales for the delagation of quasi legislative power to Local Government Authorities.

To ensure the effective service delivary in local areas. Local government authorities given are
power to make rules and regulations that have the forces to control and direct various activities in local
areas like rural areas as well as in urban areas. The services like health care, electricty,water and
education services all of these are directed and controlled by the local government authorities. Elkhalil,
Y. (2017). Also in Urban Local Government Authority Act 8 of 1982 in section(55) sub-section (1) (h) To
provide for and maintain a supply of electric lighting orother means of lighting the streets and trunk
roads (including bridges carrying trunk roads) and to provide such lamps,lamp posts, and other materials
and apparatus as rnav bedeemed necessary for lighting its area. This section explain the functions of
urban local government authority in provisions of various services like electricty services.

To promotes local people participation. Local government authorities were given power of
making by laws, formulating and establishing news Local Government areas like district councils, village
councils, municipal councils as well as town councils by considering the rules and regulations as well as
the procedures of establishment of these new local government areas. So these activities which are
conducted in local government authorities helps the local people to participate in these activities. Swai,
I.L. (2017). In urban local government authority Act 8 of 1982 in section 81(1) explain the procedures
that Local Government Authorities requared to follow in making by laws in local government authorities
among of the examples of these procedures is where urban authority proposes to make any by-laws it
shall, at authority makes by- least two weeks before the meeting of the authority, at which it is
proposed to consider the by-laws, give notice to the inhabitants of the area of its jurisdiction of its
intention, in such manner as may most probably bring the notice to the attention of all persons likely to
be affected by the by-laws indicating the presise purport of the by-laws proposed, and calling upon all
interested persons within the area to lodge any objections or representations in writing with lawsthe
authority within such time as may be prescribed. So this show that the local people are effectively
participating in local government activities.

To ensure the local economic development. The local government authorities were given these
power inorder to make sure that the local areas are being sucessful in economic development through
various projects and planning forxample agricultural project and planning like the establishment of
irrigation schemes which promotes good agricultural products to support industrial production and
development. So through settings various economic projects and planning will promotes the local
government economic development also it promotes the occurrence of job opportunities to local people
also it lead to the improvements of local people living standards as well as the individual development.
Also local government authorities has given power of revenue collection in various commercial centre
like market, and shops which provide the income for the local areas development. This is because these
revenue are used in establishment of various services like water and health care services. Angasisye, M.
(2019).

To ensure the effective decentralize of power to Local Government Authorities. Due to work
overload to the parliament the parliament of the United Republic of Tanzanian, The parliament vested a
quasi legislative power to Local Government Authorities to make rules, regulations and implementations
in their areas of jurisdictions. Examples of these powers which are vested to Local Government
Authorities are the power to disssolve councils in defaults, the power to make by laws, and the power to
collect revenue. The aim objectives of the parliament of the United Republic of Tanzanian to give the
local government authorities these powers is to ensure the power are being decentralized and
performed effectively so as to promotes the local government accountability and transparency. Etim,

To maintain public defence and security.Local government authorities ensure the defense and
security of their local community through a range of measures and initiatives. Firstly, they collaborate
closely with law enforcement agencies to maintain a visible and responsive police presence, ensuring
the safety of residents and businesses through crime prevention programs and regular patrols.
Additionally, they invest in and maintain an effective emergency response system, including well-
equipped fire and ambulance services, to swiftly address any accidents or crisis situations. Local
authorities also foster community resilience by promoting citizen engagement and awareness through
initiatives such as neighborhood watch programs and safety workshops, encouraging residents to
actively participate in protecting themselves and their neighbors. Furthermore, they work with other
relevant organizations to address and mitigate potential security threats, such as supporting
infrastructure to withstand natural disasters or terrorism, implementing robust cybersecurity measures,
and coordinating disaster management plans. By employing these multi-faceted approaches, local
government authorities strive to ensure the defense and security of their community, creating a safe
and resilient environment for residents. Mollel, H. A. (2010).

To promotes and strength decision making to local government authorities. The local
government authorities has power to make various decision making in their areas of jurisdictions. The
local government standing commettees like finance administration and planning standing commettee,
health water and education commettee also the economic affairs works and environment commettees.
These commettee make various decision making in provisions and establishment of public services also
make decision in different various conflicts which happen to local people. Forexample solving the
conflicts between livestockers and farmers in local government. Also through democratic
depresentation the local government authorities provide a means for local residents to participate
directly in the decision-making process. By delegating powers to these authorities, parliament ensures
that the voices of local communities are represented and heard at the local level. This enhances the
democratic process by bringing decision-making to the grassroots level and allowing citizens to have a
say in shaping policies that directly impact their lives. Elkhalil, Y. (2017).

To promotes the effective resource allocation. Local government authorities are responsible for
managing local resources, such as infrastructure, public services, and land use. Quasi-legislative powers
enable them to allocate these resources effectively based on local needs and priorities. They can
develop regulations that guide development, zoning, and public services according to local demands,
ensuring the optimal use of resources and promoting sustainable growth. Local government authorities
ensure effective resource allocation through various mechanisms. Like conducting comprehensive needs
assessments to identify the priorities and demands of their local communities. This includes gathering
data on population demographics, infrastructure requirements, and social and economic indicators.
Based on this information, authorities develop strategic plans and budgets that allocate resources
efficiently and effectively to address the identified needs. They may also engage in participatory
budgeting processes, involving community members in decision-making to ensure their voices are heard
and resources are allocated in line with their preferences. Additionally, local governments employ
performance monitoring and evaluation systems to track the implementation and outcomes of resource
allocation, enabling them to make adjustments and improvements as needed. Through these methods,
local government authorities aim to maximize the impact of limited resources and ensure they are used
to meet the diverse and evolving needs of their communities. Angasisye, M. (2019).
CONCLUSION

By concluding, The parliament of the United Republic of Tanzanian delegates power to local
government authorities to promote decentralization, efficient governance, democratic representation,
policy experimentation, and to ensure that decisions are made by those with local knowledge and
expertise. These factors collectively contribute to more effective and responsive governance at the local
also local government authorities plays cruial role in national development through revenue collection
frome various institutions like market and shops as well as private institutions like bars, lodges parks and
clubs which are alocated in local areas. The presence of various economic activities like industrial and
agricultural activities in local areas also promotes the occurrence of job opportunities to local people
and helps the local people to improve their standard of living. And also it promotes the local
government revenue generation and hence lead to local economic development.
