LEAVE AND LICENSEE AGREEMENT

THIS AGREEMENT is made on this day of October, 2023, BETWEEN SRI


RAJ KUMAR CHOWDHURY s/o Sukdeb Chowdhury, by faith – Hindu, by
occupation – Business, residing at 10, Umacharan Bose Lane, P.S- Shibpur,
District- Howrah Pin - 711102, hereinafter referred to as “LICENSOR” (Which
expression shall unless excluded by or repugnant to the subject or context be
deemed to mean and his heirs, executors, administrators, legal
representatives and assigns) of the FIRST PART.

AND

SRI KAMLESH KUMAR, s/o Motilal Gupta, by faith – Hindu, by occupation –


Business, residing at 4, Rashik Lal Banerjee Lane, P.S- Shibpur and District-
Howrah, Pin -711102, hereinafter referred to as “LICENSEE” (Which
expression shall unless excluded by or repugnant to the subject or context be
deemed to mean and her heirs, executors, administrators, legal
representatives and assigns) of the SECOND PART.

WHEREAS the Licensor is the owner and occupier of one flat, being no
– 203, in the Second floor, measuring about more or less 480 sqft including
super built-up area, comprised in H.M.C holding no – 1, Kailash Bose 4 th Bye
Lane, P.S and District- Howrah, Pin - 711101, which is fully described in the
schedule below.

AND WHEREAS the Licensee, because of some difficulties, approached


the Licensor for permission for use of the schedule noted flat for residential
purpose for a period of 11months duly effective from 1 th November, 2023,
which the Licensor has agreed to grant reserving his exclusive possession, the
care, maintenance and service of the schedule mentioned flat to the Licensee
on the basis of “Leave and Licensee” only ( which shall stand ipso facto
revoked on the expiry of the term or earliest for such other reasons as are
mentioned hereinafter).

NOW IT IS HEREBY EXPRESSLY AGREED AND DECLARED by and between


the parties as follows:-

1. That the Licensor hereby grants to the Licensee on the basis of leave
and license to use and occupy the schedule mentioned flat for
residential use for a period of 11 months only and on the terms and
conditions noted hereunder and the Licensee accepts the said license
with the said terms and conditions.
2. That this agreement shall never be constructed as a Tenancy
Agreement or Lease nor otherwise create any other rights or interest in
the property of the Licensor viz. the schedule noted flat in favour of the
Licensee which is not at all the intention of the parties but on the
contrary merely a temporary arrangement to allow the Licensee to use
and occupy the schedule mentioned flat for residential purpose.

3. That the leave and license agreement shall be commenced on and from
1th November 2023 to 30h September 2024 and shall remain in force for
the period of 11 months.
4. That the licensee in consideration of such accommodation in the
schedule mentioned flat shall bound to pay the monthly license fees at
Rs. 5,000/- (Rupees Five Thousand) only per month to the Licensor
which will be payable till 5th of each English Calendar Month,
5. That the licensee shall also bound to pay Rs 2,00,001/-(Rupees Two
Lakhs and one rupee) only as security deposit to the Licensor at the
time of this agreement and the said security money will be refundable
by the licensor to the licensee after completion of tenure of this
agreement as well as handing over the possession of the schedule
mentioned flat by the licensee to the licensor.
6. That the Licensee shall pay the monthly electric charges regularly as
per the meter reading of the one separate meter installed for the said
schedule mentioned flat in the name of Licensor. After payment of such
electric bill licensee shall bond to submit electric bill to the licensor
within the date of 18th as per the every English Calendar month, and
licensee shall also be responsible for payment of monthly flat
maintenance charges as per the agreed terms and conditions.
7. That the Licensee shall bear all the cost of maintenance of the inside of
the schedule mentioned flat.
8. That on revocation of License and/or surrender and delivery of
possession of the schedule mentioned flat to the Licensor, the Licensor
shall be entitled against the Licensee all arrears of charges including
other charges as provided hereunder or otherwise permitted in law.
9. That if the Licensee vacant or surrender or delivery of possession of the
schedule mentioned flat to the Licensor before the expiry of this

agreement or earlier revocation of the same, Licensee shall be informed


the Licensor before three month from the date of the vacant or
surrender the schedule mentioned flat.
10. That the Licensee shall not sublet, assign or transfer the license or any
part with the occupation of the schedule mentioned flat or any party
thereof under any circumstances.
11. That the Licensee shall use and occupy the schedule mentioned fat
exclusively for residential purpose.
12. That the Licensee shall has no right to make any addition, alteration of
the schedule mentioned flat under occupation and at the time of the
surrender of the same on expiry of tenure of this agreement or earlier
revocation thereof shall repair all the damages, if any, caused to the
said schedule mentioned fat.
13. That the Licensee shall surrender, vacant and peaceful possession of
the schedule mentioned flat under occupation in the same condition
(subject to normal wear and tear) to the Licensor on the expiry of the
Agreement or earlier revocation of the same.

SCHEDULE
ALL THAT PIECE AND PARCEL of one flat, being no – 203, in the third floor,
measuring about more or less 480 sqft including super built-up area,
comprised in H.M.C holding no – 1, Kailash Bose 4 th Bye Lane, P.S and District-
Howrah, Pin - 711101, together with common passage and facility and other
easement rights, which s butted and bounded by :-
IN THE NORTH:- Stairs and flat no - 201
IN THE SOUTH:- Open to sky.
IN THE EAST :- Open to sky.
IN THE WEST:- Flat no - 202.
