“ASSIGNEE”
WHEREAS:
2. The “ASSIGNOR” has agreed to sell the land hereby assigned to the
“ASSIGNEE” and the “ASSIGNEE” agreed to take the said piece or parcel of
land, Two (2) plots situated at 59, Abaranje Road Ikotun Lagos Nigeria Now being
conveyed, subject to the necessary consent for the sum of Twenty Million
Six-Fifty Hundred Thousand Naira Only (N20, 650,000.00).
TO HOLD the same UNTO the “ASSIGNEE” from 1st day of June, 2018 for all the
residual now unexpired in the customary right of Occupancy deemed granted to the
“ASSIGNEE” by virtue of the Land Use Act 1978.
1.1 That the Assignor and Assignee agree that the land is absolutely for building
and no digging of sand is allowed on the said land.
1.2 Now that the land’s sale price is paid, I the “ASSIGNOR” do hereby declare
and say that on and as from date, the said piece of parcel of landed property
becomes bonafide property of the “ASSIGNEE” (MRS. OLOTEWO ERIABOME
EGURIASE) my heirs, assigns, executors and legal personal representatives
has no any claims (Rights or interest) whatsoever on the parcel of the landed
property now said, assigned, sealed and delivered to the “ASSIGNEE” in the
presence of the undersigned witnesses.
1.3 That the “ASSIGNOR” shall not after the execution of this Deed of
ASSIGNMENT create or cause to be created any mortgage, lieu, charge,
attachment or any other encumbrance (whether or not the same as the
enumerated particulars on the property).
1.4 That the “ASSIGNOR” shall indemnify the “ASSIGNEE” in full for all claims,
cost actions or other loss, damages, disadvantages (whether or not the same
category as the enumerated particulars) that the “ASSIGNEE” may suffer as
a result of this transaction whether or not the loss, damages, disadvantages
etc. is caused by a person or group of persons having or claiming superior
titled to the “ASSIGNOR” property provided it is caused by the negligence of
the “ASSIGNOR” whether willful or otherwise.
1.5 NOW that the land’s sales price is paid in full; the “ASSIGNEE” shall
peacefully hold and enjoy property without any interruption or disturbance by
the “ASSIGNOR” or any one lawfully claiming though, form for, against,
under or in trust for him.
1.6 That the “ASSIGNOR” shall make available on request to the “ASSIGNEE”
or the “ASSIGNEE’S” Solicitors, all documents, and execute such forms or
may be required by the Lagos State Government to be so produced and/or
executed to facilitate the perfection of the “ASSIGNEE’S” title to the piece or
parcel of the landed property herein assigned.
IN WITNESS WHERE OF, the “ASSIGNOR” and the “ASSIGNEE” with their
witnesses herein unto set their hands this day and year, first above written.
