1. (a) "Exemption clause in the contract is alien to, the

determination of liability in tort." Comment.

(b) S was owner of 300 sq. yds. of land in an approved

residential colony. MCD approved building plan for 2!12

storey building on that land. S, in violation of sanction,

constructed 31h storey and on the top of it also

constructed a 5,000 litre water storage tank. MCD

demolished one storey constructed beyond sanction

resulting in the demolition of water tank also. S claims


·damages from MCD pleading malice. Decide giving

reasons.

2. (a) As a part of grow more food campaign, a dam was

constructed for irrigation across a river. Provision was

made for release of excess water through sluice. Due

to exceptionally heavy rainfall sluice proved inadequate

and extra opening was made. resulting in flooding the

agricultural land of X. X suffered a severe loss of

agricultural production. Can X recover damages for the

loss ? Decide.

(b) A horse, who was left unattended on a highway by

its owner, bolts causing risk of grave injury to

people. A spectator rushes to stop it, and is in

the process gets injured. Can he recover damages

from the owner ? Would it make any difference to

your answer if spectator was a police official on

duty ?

3. Discuss the tortious liability of medical professionals for the

-loss suffered by their patients due to their negligence in the

light of the recent judicial decisions.

4. Mr. X, along with his wife Y, was travelling by a bus from

Delhi to Meerut. Due to the negligence of the driver the bus

plunged into river Hindon, as a consequence of which, X

died on the spot and Y became uncons~ious. On regaining

consciousness, she was informed about the death of her

husband, Which caused her nervous shock ~nd she remained

bed ridden for a month. She filed a suit, claiming damages

for

(i) causing death of her husband

(ii) her physical injuries

(iii) causing nervous shock to her

Decide, in the light of judicial decisions.

5. Discuss the liability of the Government for the tortious acts

of its employees. In what way is Indian law different from

English law ?

A military vehicle driven by a military driver was returning

after collecting tents from an outdoor training area. The tents

were to be brought back to the regiment. The vehicle fatally

knocked down Mr. A. The widow and $6n of Mr. A filed

a suit to recover compensation against the Union of India.

Union of India pleaded sovereign immunity in defence~ Decide

7. What are the essential elements of the tort of defamation ?

Is Z liable for the tort of defamation in the following

cases

(i) Z is not having good relations with his mother-in-law.

He tells his wife, '·there is hardly a day when your

(ii) Z tells his unmarried sister that she should not mix· up

toxic gas and other chemicals in its building in concrete tanks.

Due to some unknown reason, one of the tanks collapsed

and gas leaked. Exposure to the gas caused death of numerous
